    العقاب المدرسي بين الشريعة الإسلامية والتربية الحديثة : دراسة تحليلية

    The study aimed to shed light on the concept of school punishment, and to clarify the view of sharia on punishment, as well as the view of educational scholars and their views on school punishment. And this motivated me to choose this study, for reasons including: getting acquainted with the vision of Islamic law and its view of school punishment, and the way in which the Prophet Mohammad dealt with punishment and the alternatives that he established, And comparing the opinions of Muslim and Western scholars on punishment. To bring this research to light, I have adopted each of the following approaches: descriptive, historical, and analytical; In gathering information from its sources, comparing it, studying it, and then analyzing its content to reach the desired results. The study reached several results, the most important of which are: 1. In applying Sharia punishments, sharia aimed at reforming and refining the individual and establishing a just order; To achieve justice in the world. 2. Punishment is not limited to one form, but has multiple forms, including: physical and social. It does not depend on one method, but has multiple methods, including: exclusion, exclusion and deprivation. The Prophet mohamad used alternatives to punishment, including: advice, guidance, desertion, turn away, and threats. 3. sharia permits the use of punishment; To deter the learner; But it indicated the controls for using the punishment tool, its specifications, and the method of use. 4. Muslim educators permit the use of punishment while avoiding cruelty in that. As for Western education scholars, they argue that physical punishment should not be used, or that the teacher resort to force to preserve order. Based on the results of the study, the researcher recommends that parents should observe their children, take care of them, and watch after them, whether in school or in their personal lives, and the teacher should be patient with the learners, and avoid using punishment except in the need of the needy.

    جدلية زيارة المسجد الأقصى المبارك في ظل الإحتلال الإسرائيلي (دراسة فقهية تحليلية)

    This thesis is entitled "Controversy over visiting Al-Aqsa Mosque while being under the Israeli occupation" taking the form of an analytical juristic study. I have selected this title due to my deep strong and limitless love of the holy Aqsa Mosque. The first incentive is the ideological love a long with the fear regarding the fate of the location of the nocturnal journey–Prophet Mohammad's (peace be upon him) midnight journey and his ascention to the seven heavens which faces capaingns of Judaization desecration and penetrations by fanatic Zionists. The significance of this thesis stems from the fact that it comes at a time when current growing controversy is going on every where including the religions and political platforms regarding visiting Jerusalem and Al-Aqsa Mosque while being under the Israeli occupation there ate those who strongly advocate on the one hand and those who oppose on the other each side based their stand on juristic and mental evidence. Moreover they bring in their tetimony giving argumentation and attestation for their opponents. In addition the significance of this study is that it comes at a time when increasing legal opinions prohibit visiting the Holy Aqsa Mosque while being under the Israeli occupation such Fatwas are being issued by prominent contemporary jurists. This thesis aims at raising and tackling the issue of visiting the Holy Aqsa Mosque under the Israeli occupation from juristic and legal point of view. It also aims at scrutinzing the proattitudes and those that are against through analysis refutation discussion and criticism. The issue of visiting Al-Aqsa Mosque has become political issue rather than being religious mater falls under the fiqh rule that Al-Aqsa Mosque is (Dar Islam) Throughout this study the researcher has proven a number of important outcomes the researcher used the historical approach combined with the analytical reasoning to reach the results of the study. Jerusalem a long with Al-Aqsa Mosque are considered a pure Islamic home and not at all a zone of war even though it is extra ordinarily affected by the Israeli occupation. Another result is that a visit to the Holy aqsa Mosque under the Israeli occupation is considered as extraordinary without precedent i.e the previous jurists have never tackled the issue in research by all means . therefore the research in this area should be left to Islamic scholars.. The researcher has also concluded that according to the Islamic Shareeha visiting Jerusalem and Al-aqsa Mosque under these critical and hard circumstances is considered obligatory for each and every Muslim with the conditions that the visit doesnot lead to recognition or normalization with the Zionist enemy. Nobody is exempted from this duty except for those who have legitimate excuses. The Israeli occupation should not be taken as an excuse for not visiting Al-Aqsa Mosque for prayer and worship a long with abserving different religious events there. Further the study recommends the prior coordination with respect to the Al-Aqsa Mosque visit with the Palestinian minstrey of AL-awqaf. Finally the researcher recommends instant and serious efforts on the Arabic and Islamic levels to support the Holy aqsa Mosque. And make it possible for all Muslims to visit and work ship the holy placed in Palestine

    أثر الحفريات الإسرائيلية في تهويد البلدة القديمة من مدينة القدس خلال الفترة (1967 – 2018م)

    حظيت مدينة القدس، ومنذ غابر الأزمان بالتقديس والاهتمام البالغ، فقدسيتها بدأت منذ وضع الله سبحانه، وتعالى المسجد الأقصى المبارك فيها. ونظراً لأهمية مدينة القدس لدى العالم الإسلامي، من الناحية الدينية، والتاريخية، كان الإهتمام الخاص بها، وقد تعاقب المسلمون على رعايتها، والاهتمام بها منذ: الراشدين إلى الأمويين إلى العباسيين إلى الطولونيين إلى الإخشيديين إلى الفاطميين إلى المماليك فالعثمانيين، وكلهم يوليها الاهتمام الجدير بها، وقد ظلت إسلامية عربية منذ العهدة العمرية سنة (15هـ- 636م) حتى سنة (1387هـ - 1967م) باستثناء فترة الحروب الصليبية (1099م – 1290م). ومنذ أن تمكنت سلطات الاحتلال الإسرائيلي من بسط سيطرتها على ما تبقى من أراضي فلسطين التاريخية، وفي أعقاب حرب العام (1967م)، حيث بدأت في تطبيق سياساتها الاستيطانية في مجمل أراضي الضفة الغربية، وبالأخص مدينة القدس، وقد استخدمت الحفريات الأثرية، كأحد وسائل تهويد أراضي فلسطين، والعمل من خلالها على إثبات الحق اليهودي بهذه الأرض، وهدم المسجد الأقصى المبارك وبناء "الهيكل" مكانه، ونظراً لكون هذا الموضوع ذو مجال واسع، وبحاجة إلى المزيد من الدراسة والبحث، إضافة الى طول الفترة الزمنية للحفريات في فلسطين، والتي انطلقت عام (1863م)، فقد ارتأيت تسليط الضوء على الحفريات الاسرائيلية والتي يتم اجراؤها في محيط البلدة القديمة من مدينة القدس، وخلال فترة زمنية محددة. بعد أن تمكنت سلطات الإحتلال الإسرائيلي من الإطباق على ما تبقى من أراضي فلسطين التاريخية في أعقاب حرب العام (1967م)، شرعت في تهويد المدينة المقدسة، وذلك بعد ستة أيام من احتلالها، فقد قامت آلة الهدم الإسرائيلية بهدم حارة المغاربة، والتي تعد من أقدم حارات المدينة المقدسة، بحجة توسيع الساحة المواجهة لحائط (البراق)، لكن الهدف من وراء ذلك واضح للعيان؛ وهو طمس المعالم التاريخية، والدينية الاسلامية؛ بغية الوصول إلى ما يصبو اليه الاحتلال الإسرائيلي، وهو الكشف عن بقايا "الهيكل"، وإعادة بنائه، إضافة الى ذلك فقد شرعوا في القيام بالعديد من الحفريات في محيط المدينة المقدسة، والأحياء المجاورة لها، وكان التركيز على محيط المسجد الأقصى المبارك وأسفله، وذلك لتقويض أساساته واضعافها تمهيداً لهدمه - لا سمح الله - لتنفيذ ما يصبو إليه وهو بناء هيكلهم مكانه. شملت الحفريات الإسرائيلية غالب محيط المسجد الأقصى المبارك، بالإضافة إلى ما يحيط به من أحياء عربية، إلا أن هذه الحفريات، وبشهادة علماء الآثار اليهود أنفسهم، بعدم وجود أي دليل على وجود "الهيكل"، وأن هذه الحفريات، ذات أهداف سياسية بالدرجة الأولى.

    رعاية ذوي الإعاقة في الشريعة الإسلامية والقانون الوضعي الفلسطيني (محافظة نابلس نموذجا _ دراسة تحليلية مقارنة)

    The study discussed the caring the of disabled according to the Islamic Shareea and Palestinian Law. The researcher has indentified the concept of the disability linguistically and technically and how this meaning developed through history. The researcher also talks about the types of the disability and the position of the disabled in Quran and Suna, and according to the Caliphs and scientists. He also affirmed the importance of taking care of disabled in Islam through religious texts and historical evidences. It also included a group of Palestinian law materials. The researcher didn’t ignore the practical side of the study through indentifying many Palestinian institutions that take care of the disabled in Nablus Governorate through an explanatory questionnaire . The importance of this study lies in how it focuses objectively and scientifically on how Islamic and Palestinian law take care of the disabled through considering Shareea’ and its interpretations in addition to considering how good or bad the application of these official and civil institutions of the Palestinian law and Islam. The researcher depended on the prescription and analytical method in his study which fits in with the theme of the study and its objectives through religious evidences which affirms the right of the disabled in care and interest. The study’s problem lies in the presence of a big difference between the Islamic instructions and Palestinian materials law on one side, and between the healthy people's behavior with the disabled on the other side . The researcher has concluded that the Islam and the Palestinian Law have offered the disabled everything they need such as health safety , labor and care in all fields-despite the bad application sometimes, and the Palestinian Law is still in need of some amendments such as penal provisions while Islamic Sharrea’ included worldly and after death punishments. The researcher’s recommends that there is a necessity for forming the National Council for the disabled affairs, and the disabled parents are to be taught that the disability is a matter of God’ will. And the concerned establishments and the organizations must offer help, advice and educating programs to the disabled and their families and provide them with amenities which reduce their suffering.
