| dc.description.abstract | هدفت هذه الدّراسة للإجابة عن سؤال رئيس تمثل بـ هل تقع مسؤوليّة دوليّة على إسرائيل (كدولة عضوٍ في الأمم المتّحدة وكسّلطة قائمة بالاحتلال) جراء استيلائها على ثروات فلسطين الطّبيعيّة في ظلّ مجموعة الإجراءات غير المشروعة الّتي قامت وتقوّم بها، مثل الاستيطان، وبناء الجدار العازل، ومصادرة الأراضي، الأمر الّذي تسبّب بضرر كبير للدّولة الفلسطينيّة وشعبها. ووضعت فرضيّة لهذه الدّراسة تنصّ على إمكانيّة حماية الثّروات الطّبيعيّة الفلسطينيّة؛ ولتحقيق أهداف دراستنا تمّ حصر حدودها بالجوانب القانونيّة والاقتصاديّة دون التّطرّق إلى الجوانب السّياسيّة، كما تمّ اعتماد المنهج القانونيّ الاستنباطيّ للإجابة عن تساؤلات الدراسة. وأظهرت النّتائج الّتي توصلت إليها الدّراسة أنّ الدّولة الفلسطينيّة تتمتّع بحقّ السّيادة الكاملة على ثّرواتها الطّبيعيّة، وأنّ إسرائيل كدولة عضوٍ في الأمم المتّحدة وكسّلطة قائمة بالاحتلال تساءل عن فعلها غير المشروع دوليّاً، والمتمثّل بالاستيلاء على الثّروات الطّبيعيّة لدولة فلسطين من خلال المسؤوليّة الدّوليّة وأركانها الثّلاثة، فالاستيلاء فعل مجرّم بالقانون الدّوليّ، ونتيجة لهذا الفعل فإنّه يقعّ مجموعة من الآثار القانونيّة المتنوّعة؛ منها ما يقع على إسرائيل بصفّتها الدّولة المتسبّبة بالضّرر، ومنها ما يقع على الدّولة الفلسطينيّة بصفّتها الدّولة المتضرّرة، ومنها ما يقع على طرفاً ثالثاً. وأظهرت النّتائج ثبوت صحّة فرضيّة البحث، وأنّ الدّولة الفلسطينيّة لها دور مهمّ في حماية ثرواتها الطّبيعيّة، حيث يقع عليها واجبات محلّيّة لحماية الثّروات مثل توثيق الانتهاكات وتقدير الأضرار، وأيضاً واجبات دوليّة من خلال تفعيل الأدوات والوسائل القانونيّة والدّبلوماسيّة الّتي أوجدها القانون الدّوليّ. وعليه أوصت الدّراسة الحكومة الفلسطينيّة بمجموعة من التوصيات أهمها: إنشاء جهة مستقلّة ومختصّة لتوثيق جميع الانتهاكات الّتي تقع على الدّولة الفلسطينيّة وثرواتها وشعبها بالوقائع والأرقام وبشكل مهنيّ، والاستمرار في رفع تقارير منتظمة حول الانتهاكات إلى المنظّمات الدّوليّة، دعم الجمعيّات والمؤسّسات المحلّيّة والمنظّمات والحركات الدّوليّة المدافعة عن حقوق دولة فلسطين وشعبها في ثرواتهم الطّبيعيّة والسّيادة عليها، وأيضاً إشراكهم في أعمال توثيق الانتهاكات وتقدير التّعويضات، ورفد فريق المفاوضات الفلسطينيّ بخبراء محلّيين ودوليين في شتّى المجالات (القانون الدّوليّ، والاقتصاد والمال، والثّروات الطّبيعيّة لا سـيّما الأرض والماء، والخرائط، والعلاقات الدّوليّة)، والمطالبة بالجبر الكامل للأضرار الّتي أصابات الدّولة الفلسطينيّة وشعبها وثرواتها من إسرائيل (السّلطة القائمة بالاحتلال) فالجرائم الدّوليّة لا تسقط بالتّقادم. الكلمات المفتاحيّة: الثّروات الطّبيعيّة، المسؤوليّة الدّوليّة، الأراضي الفلسطينيّة المحتلّة، إسرائيل. | ar |
| dc.description.abstract | This study aims to answer a central question: Does Israel — as a Member State of the United Nations and an occupying power—bear international responsibility for its confiscation of Palestine’s natural resources, in light of a series of unlawful actions it has undertaken and continues to undertake, such as settlement expansion, the construction of the separation wall, and land confiscation, all of which have caused substantial harm to the State of Palestine and its people? The study is based on the hypothesis that the protection of Palestinian natural resources is possible. To achieve its objectives, the study was limited to legal and economic aspects, deliberately excluding political considerations. The deductive legal method was adopted to answer the research questions. The findings revealed that the State of Palestine enjoys full sovereignty over its natural resources, and that Israel—as a UN member state and occupying power—bears international legal responsibility for its unlawful confiscation of those resources, based on the three established elements of international responsibility. Confiscation is a criminalized act under international law, and as such, it entails a range of legal consequences—some of which fall upon Israel as the state causing harm, others upon Palestine as the harmed state, and yet others upon third parties. The results confirmed the validity of the hypothesis, demonstrating that the State of Palestine has a crucial role in protecting its natural resources. This includes domestic duties such as documenting violations and assessing damages, as well as international obligations through the activation of legal and diplomatic tools established by international law. Accordingly, the study recommends that the Palestinian government adopt several measures, most notably: establishing an independent and specialized entity to professionally document all violations committed against the State of Palestine, its resources, and its people, supported by facts and figures; continuing to submit regular reports on these violations to international organizations; supporting local associations and international organizations and movements that defend the rights of the State of Palestine and its people to their natural resources and sovereignty; involving these entities in documentation and damage assessment efforts; strengthening the Palestinian negotiation team with local and international experts in diverse fields—including international law, economics and finance, natural resources (especially land and water), cartography, and international relations; and demanding full reparations from Israel, the occupying power, for the harm inflicted upon the State of Palestine, its people, and its resources — bearing in mind that international crimes are not subject to any statute of limitations.
