Abstract
This research aims at identifying the obstacles of Public Private Partnerships PPPs for sustaining water and sanitation services. Furthermore, it provides a general perspective of PPPs in Palestine with a focus on identifying their justification, appropriate forms as well as the opposing and supportive legal environments so as to form a qualitative and quantitative accumulation that presents a better logical framework to develop PPPs policies for the Palestinian water sector.
The research is based on the qualitative and quantative method to answer the research questions. In order to collect appropriate data for the study, different sources were used; primary data was collected through a structured electronic survey of five axes and was analyzed through Survey Monkey software and (SPSS). Primary data was also generated fromgroup interviews of stakeholders while secondary data was collected through reviewing and analyzing relevant data and documents in addition to reviewing available relevant literaturein the subject matter.
The main important conclusion of the research was the need to focus on the economic reasons as an essential requirement for the success of the PPP project while the main importance challenge was related to the governmental sector ability to provide guaranties and to fight against corruption. In addition to other challenges resulted from the conflict and overlap of the various laws on the national and international levels. PPPs may result from potential contracting forms based on two scenarios; already existed facilities and to be established facilities, each scenario is formed up of a several specific contractual forms. The main important logical framework to develop PPPs policies is based on setting appropriate institutional, economic, and legal arrangements coupled with clarifying the policies and indentifying the main important water problems to be solved.
The main important recommendations of this study are as the following; the need to focus in the economic feasibility and the appropriate legal environment for the PPP projects in water sector; the need to upgrade the competencies and skills of the water sector in
analyzing and limiting the threats in order to solve them; the need to provide an appropriate legal environment with unified laws in addition to the need to enable the judiciary system with training and capacity building to deal with all forms of PPPs and their potential dispute resolutions.
