Abstract
تناولت دراسة (العوائق الفنية أمام التجارة الدولية) وصف وتحليل العوائق الفنية الأساسية التي تواجهها التجارة على المستوى الدولي والتوجهات التي انتهجتها الدول في التحول من استراتيجية إحلال الواردات والصادرات إلى استراتيجية التوجه إلى الخارج، وذلك من خلال التعليمات الفنية والمواصفات وإجراءات تقييم المطابقة التي تقرها تلك الدول من أجل الدخول إلى الأسواق الخارجية، وتقييم مدى فاعليتها في تحرير التجارة على المستوى المحلّي والدولي.
كما بينت الدراسة أن الهدف الأسمى لهذه الاتفاقية هو حماية صحة الإنسان والحيوان والنبات والبيئة وسلامتها، والتي يجب على الدول الموقعة عليها مراعاة ذلك عند وضع أية تعليمات فنية أو مواصفات للمنتجات بشكل عام. يجب على كل دولة طرف في هذه الاتفاقية إعلام الأطراف الأخرى بهذه التعليمات والمواصفات فور صدورها، من أجل تجاوز أية عوائق قد يواجهها تبادل هذه المنتجات وتسويقها، تطبيقاً لمبدأ تحرير التجارة وتسهيل انسيابها إلى الأسواق بين تلك الدول.
مع مرور الزمن أصبح لا بد من حل مشكلة وجود عوائق فنية على المنتجات في التجارة، الأمر الذي دفع أعضاء منظمة التجارة العالمية إلى إعداد اتفاقية العوائق الفنية أمام التجارة، والتي تضمنت مجموعة من القواعد تلزم الأعضاء عند إعداد أو إصدار أية تعليمات فنية أو مواصفات للمنتجات، بحيث لا تشكل هذه القواعد عائقا أمام تدفق هذه المنتجات إلى الأسواق.
وقُسمت هذه الدراسة إلى مقدمة، وفصلين وخاتمة، تناول الفصل الأول، تحديد العوائق الفنية أمام التجارة الدولية، من خلال تحديد مفهوم العوائق الفنية وتعريف اتفاقية العوائق الفنية أمام التجارة الدولية لسنة 1995 وتاريخ نشأتها، والذي مر بمراحل متعددة إلى أن تم اعتماد هذه الاتفاقية من قبل الدول الأعضاء في منظمة التجارة الدولية، وحال هذه الاتفاقية كحال معظم الاتفاقيات؛ فقد اشتملت على العديد من المبادئ والأهداف تم التطرق لها من خلال هذه الدراسة.
كما تم بيان الآثار المترتبة على الانضمام لهذه الاتفاقية ومدى الالتزام بها، إضافة إلى أهم العوائق الفنية التي تقف أمام التجارة الدولية، وكيفية التعامل معها، والآثار المترتبة على تطبيق هذه الاتفاقية على تجارة الدول النامية.
The study (Technical Barriers to International Trade) dealt with a description and analysis of the main technical barriers facing trade at the international level and the trends adopted by countries in shifting from the strategy of substituting imports and exports to the strategy of heading abroad, through the technical regulations, standards and conformity assessment procedures that approved by those countries, in order to enter foreign markets and evaluating its effectiveness in liberalizing trade at the local and international levels.
The study also showed that the ultimate goal of this agreement is to protect the health and safety of humans, animals, plants and the environment, which the acceding countries must take into account when setting any technical regulations and standards for products in general. Each acceding country must inform other acceding countries about these regulations and standards immediately, in order to override any barriers that may face exchanging and marketing of these products, in application of the principle of trade liberalization and facilitating its flow to markets between these countries.
As the time passes, it became necessary to solve the problem of technical barriers of products in trade, which prompted the members of the World Trade Organization (WTO) to formulate and prepare the Technical Barriers to Trade Agreement, which included a set of rules obligating members when preparing or issuing any technical regulations or standards for products, not to form an obstacle to the flow of these products to the markets.
This study divided into an introduction, two chapters and a conclusion. The first chapter dealt with defining technical barriers to international trade, by defining the concept of technical barriers and defining the Agreement on Technical Barriers to International Trade for the year 1995 and its founding history which passed through multiple stages until this agreement was approved by Member States of the World Trade Organization, and this agreement, like most agreements, included many principles and objectives that were addressed through this study.
The implications of joining this agreement and the extent of commitment to it were also illustrated, in addition to the most important technical Barriers to international trade, how to deal with them, and what are the effects of application of this agreement on the trade of developing countries.
While the second chapter dealt with a statement of the mechanisms for settling disputes resulting from the existence of technical barriers that may be imposed by some countries acceding to the World Trade Organization, and the steps to be followed in the stages of settling disputes resulting from the application of the Technical Barriers Agreement under the umbrella of the World Trade Organization, including the stage of consultations and reconciliation, as well as the means alternative dispute resolution.
The study also dealt with reciprocal punitive measures between the conflicting parties through compensation or waiver and withdrawal and/or cancellation of restrictions and instructions imposed in the face of the flow of these products to their markets, in accordance with the provisions of the Agreement on Technical Barriers, which is one of the most important agreements of the multilateral trading system. This study concluded a set of findings and recommendations.
