Abstract
تتناول هذه الأطروحة إشكالية العلاقة بين المعاهدات الدولية والنظام القانوني الفلسطيني، في ظل غياب نصوص دستورية واضحة تُحدّد آليات إدماج الاتفاقيات الدولية ضمن التشريعات الوطنية، وموقعها في التراتبية القانونية. وقد ركزت الدراسة بشكل خاص على القرار التفسيري رقم (4) لسنة 2017 الصادر عن المحكمة الدستورية الفلسطينية، والذي أقرّ بمبدأ سمو المعاهدات الدولية على التشريعات العادية، مع اشتراط توافقها مع الهوية الوطنية والدينية والثقافية، مما أثار جدلًا قانونيًا حول مدى التزام فلسطين بتعهداتها الدولية. انطلقت الدراسة من فرضية مفادها أن غياب تنظيم دستوري وتشريعي دقيق لمكانة المعاهدات يؤدي إلى ازدواج في الاجتهادات القضائية، ويؤثر سلبًا على استقرار النظام القانوني. واعتمدت الأطروحة منهجية تحليلية نقدية، استعرضت من خلالها الأطر الدستورية الفلسطينية، والاجتهادات القضائية ذات الصلة، إضافة إلى مقارنات مع أنظمة قانونية عربية ودولية. كما سلّطت الضوء على التحديات التي تواجه إدماج المعاهدات الدولية في القانون الوطني، سواء من حيث الرقابة الدستورية أو من حيث التنفيذ العملي. خلصت الدراسة إلى مجموعة من النتائج، أهمها: وجود فراغ تشريعي حقيقي في فلسطين بشأن مرتبة المعاهدات الدولية، وتباين في مواقف السلطات الرسمية والقضائية بشأن إلزاميتها، وغياب استراتيجية وطنية موحدة لتطبيقها. وفي ضوء هذه النتائج، أوصت الأطروحة بإجراء إصلاحات دستورية وتشريعية شاملة، ووضع قانون خاص بالمصادقة وتنفيذ المعاهدات الدولية، وتفعيل دور المحكمة الدستورية في الرقابة السابقة، وتعزيز التنسيق بين السلطات، إلى جانب إطلاق برامج توعوية وتدريبية لضمان فهم أعمق لمكانة المعاهدات ضمن المنظومة القانونية الفلسطينية.
This dissertation addresses the complex relationship between international treaties and the Palestinian legal system, particularly in the absence of clear constitutional provisions regulating the integration of international agreements into national legislation and defining their hierarchical status. The study focuses on the Palestinian Constitutional Court’s Interpretative Decision No. 4 of 2017, which affirmed the primacy of international treaties over ordinary laws, while imposing a condition that such treaties must conform to national, religious, and cultural identity—raising critical questions regarding Palestine’s adherence to its international obligations. The research is based on the hypothesis that the absence of a clear constitutional and legislative framework governing treaty implementation leads to inconsistent judicial interpretations and undermines legal stability. Adopting an analytical and critical methodology, the study examines the relevant constitutional provisions and jurisprudence in Palestine, drawing comparative insights from Arab and international legal systems. It also explores the legal and institutional challenges in implementing international treaties, including the lack of prior constitutional review and practical enforcement mechanisms. The study concludes with key findings, most notably the existence of a legislative gap concerning the legal status of treaties in Palestine, conflicting interpretations among legal institutions regarding treaty obligations, and the absence of a unified national strategy for treaty incorporation. In response, the dissertation recommends comprehensive constitutional and legislative reforms, including the enactment of a dedicated law on treaty ratification and implementation, enhanced constitutional court oversight, and strengthened inter-institutional coordination—alongside legal awareness and capacity-building programs to ensure proper application of international treaties within the Palestinian legal framework.
