Abstract
تناولت هذه الدراسة موضوع (وقف عقد العمل في التشريعات الفلسطينية)، وقد هدفت الى إظهار أهمية وجود نظام لوقف عقد العمل في التشريعات الفلسطينية، كون أن هذا النظام يعمل على حماية عقود العمل من الانقضاء، أثناء حدوث موانع تعيق تنفيذ الالتزامات المترتبة على أطرافه، سواء كانت هذه الموانع عائدة للعامل أو لرب العمل، أو لظروف خارجة عن إرادة الطرفين، وأيضا لقلة الدراسات المتعلقة في هذا الموضوع، حيث أن أغلب الدراسات المتعلقة به تتحدث عن التشريعات المصرية والأردنية، ووضحت الباحثة رأيها بكون نظام وقف عقد العمل هو نظام مستقل وله خصائصه التي تميزه عن غيره، ولذلك اهتمت الباحثة في هذا الموضوع من أجل توضيح وتبيان نظام وقف عقد العمل وجميع المواضيع المتعلقة به، وأيضا اعتمدت الباحثة مصطلح الطبيعة القانونية لنظام وقف عقد العمل فقها وقضاءً، وقد تناولت هذه الدراسة حلا للإشكالية المطروحة المتعلقة بموقف المشرع الفلسطيني من نظام وقف عقد العمل، وهل نص عليه صراحة أم بصورة ضمنية، وقامت الباحثة بجمع التطبيقات القانونية لنظام وقف عقد العمل في كل من التشريعات المصرية والأردنية والفلسطينية، وانتهجت الباحثة في دراستها المنهج الوصفي التحليلي المقارن (تحليل المضمون) من خلال التعرف على موقف المشرع الفلسطيني من هذا النظام، بعد إجراء المقارنة مع قانون العمل المصري والأردني ومناقشتها وتحليلها وتدعيمها بالآراء الفقهية، وخلصت الرسالة لمجموعة من النتائج والتوصيات، وأهم هذه النتائج أنه ليس فقط الظروف الطارئة والقوة القاهرة وحدها التي تدفعنا لتطبيق نظام وقف عقد العمل، وإنما توجد موانع ومبررات أخرى تعود لأطراف العقد تؤدي لوقف عقد العمل كما في إجازة الأمومة وإجازة الدراسة، وأنه من الممكن أن يقرر القاضي إعمال نظام الوقف في غير الحالات المقررة تشريعيا واتفاقيا، متى استنبط أن في الوقف مصلحة لأطراف العقد، أما التوصيات فأهمها:ضرورة النص على نظام وقف عقد العمل بشكل صريح في التشريعات الفلسطينية.

This study addresses the topic of "Suspension of the Employment Contract in Palestinian Legislation." It aims to highlight the importance of having a system for suspending employment contracts within Palestinian legislation, as this system works to protect employment contracts from termination during the occurrence of obstacles that hinder the performance of obligations by the parties involved. These obstacles may arise from the employee, the employer, or from circumstances beyond the control of both parties. Additionally, this study is motivated by the scarcity of research on this subject, as most studies discuss Egyptian and Jordanian legislations. The researcher clarified her view that the system for suspending the employment contract is an independent system with characteristics that distinguish it from others. Therefore, the researcher focused on this topic to explain and clarify the suspension system and all the issues related to it. The researcher also relied on the term "the legal nature of the suspension system of the employment contract," in both legal theory and case law. This study also provided a solution to the issue concerning the stance of the Palestinian legislator on the suspension system, questioning whether it is explicitly stated or implicitly included. The researcher collected legal applications of the suspension system in Egyptian, Jordanian, and Palestinian legislations. The researcher adopted a descriptive, analytical, and comparative methodology (content analysis) to examine the Palestinian legislator's stance on this system, after comparing it with the Egyptian and Jordanian labor laws and analyzing them, supported by doctrinal opinions. The study concluded with several findings and recommendations. The most important findings include that it is not only emergency circumstances and force majeure that lead to the application of the employment contract suspension system. There are also other obstacles and justifications arising from the parties to the contract that lead to the suspension of the employment contract, such as maternity leave and study leave. The study also found that the judge may decide to apply the suspension system in cases not explicitly provided for legislatively or by agreement, whenever the judge finds that such suspension serves the interests of the parties involved. Among the most important recommendations was the necessity of explicitly including the suspension of employment contracts in Palestinian legislation.
