| dc.description.abstract | تشكل الأسرة الخلية الأولى في بناء أي مجتمع من المجتمعات، ذلك أن المجتمع مكون من مجموع الأسر فيه، لذلك فإن البحث في مجال الأسرة وتكوينها وطرق المحافظة عليها وحمايتها يعد من أهم البحوث على الإطلاق. وقد أعطى الإسلام الأسرة الكثير من العناية، وبينت الشريعة الإسلامية بالتفصيل جميع ما يتعلق بها من أحكام، بل إن القرآن الكريم قد أفرد لذلك سورة كاملة، هي سورة النور، التي تناولت ما يتعلق بالأسرة من أحكام، ووقفت على الحكم العظيمة، من وراء هذه الأحكام. ويهدف هذا البحث إلى بيان الأحكام الشرعية المتعلقة بالأسرة، والتي شرعها الله تعالى للمحافظة عليها من الانهيار، وإبراز الآثار السلبية التي تنعكس على الأسرة وبالتالي على المجتمع عامة بسبب حدوث الخلافات بين الأزواج، مما يؤثر سلبًا على الأولاد، ويحدث الطلاق الذي ينتج عنه هدم هذا الصرح العظيم، وكيف أن ذلك يتعارض مع مقاصد الشريعة الإسلامية من الزواج. كما يهدف إلى بيان عناية الإسلام بالعائلة وانضباط نظامها، بالمحافظة على الأنساب، وإحكام آصرة النكاح، ثم آصرة القرابة، ثم آصرة الصهر، لأن الخلافات الزوجية معول هدم للأسرة والمجتمع، ووجودها يؤدي إلى عدم تحقيق المقصد الشرعي الرئيس من الزواج. وقد استخدم الباحث المنهج الوصفي، مع الاستعانة بالمناهج الاستنباطي والتحليلي والاستقرائي، لبيان الأحكام المتعلقة بالأسرة، وارتباطها الوثيق بمقاصد الشريعة الإسلامية، وتعارض الخلافات الزوجية مع تحقيق هذه المقاصد السامية. وقد تم في الفصل الأول بيان معنى مقاصد الشريعة الإسلامية وآثارها في الأسرة والمجتمع، كما تم في الفصل الثاني بيان الضوابط والتدابير الشرعية العامة لحماية الأسرة قبل إجراء عقد الزواج وارتباطها بمقاصد الشريعة الإسلامية، وفي الفصل الثالث بيان الضوابط والتدابير الشرعية عند إجراء عقد الزواج، وفي الفصل الرابع بيان الضوابط والتدابير الشرعية بعد عقد الزواج، أما الفصل الخامس فقد تناول موضوع الخلافات الزوجية، وأنواعها وأسبابها وطرق علاجها في ضوء مقاصد التشريع الإسلامي، كما تناول الفصل السادس موضوع انعكاس الخلافات الزوجية على الأسرة والمجتمع، وتعارضها مع مقاصد الشريعة الإسلامية. وقد توصل الباحث في ختام بحثه إلى نتائج أهمها: أن أحكام الأسرة في الإسلام من الأهمية بمكان، لذا فقد حرص الإسلام على حماية الأسرة من كل ما يؤدي إلى انهيارها أو هدمها، وأن الخلافات الزوجية تعمل على هدم هذا البناء الهام في المجتمع، وأن هذه الأحكام مرتبطة ارتباطًا وثيقًا بمقاصد الشريعة الإسلامية، وتحقيق الهدف الأسمى من الزواج وهو إيجاد نسل صالح في المجتمع، وكذلك لا بد من ربط التدابير الشرعية لحماية الأسرة بالوازع الديني الذي يعتبر أساس كل هذه التدابير، وأهمية الفحص الطبي قبل الزواج؛ لأنه يقي الأسرة من كثير من المشكلات في المستقبل. أما أهم توصيات هذا البحث فتتلخص في وجوب إيجاد الوعي لدى الأزواج ومعرفة الأحكام الشرعية المتعلقة بالأسرة، والوقوف عند حقوق وواجبات كل منهم، ومدى ارتباط وجود الخلافات الزوجية بمنع تحقق مقاصد الشريعة الإسلامية من الزواج وانعكاس ذلك على المجتمع، كما يجب زيادة الوازع الديني لدى الأزواج، لأن ذلك يؤدي إلى انحسار الخلافات بينهم، كما ينتج عنه وجود أسرة ونشئ ومجتمع خال من الجريمة والانحراف والشذوذ. The family constitutes the first cell in building any society, because society is made up of the totality of families in it. Therefore, research in the field of family and its formation and ways to preserve and protect it may lead to its destruction; It is one of the most important research ever. Therefore, Islam has given the family a lot of care, and the Sharia has been built in detail with all the provisions related to it. In fact, the Holy Qur’an has singled out an entire surah for that, which is Surat Al-Nur, which dealt with the provisions related to the family, and stood for the great rulings, behind these provisions. This research aims to clarify the legal provisions related to the family, which God Almighty legislated to preserve it from collapse, and to highlight the negative effects that are reflected on the family and thus on society in general due to the occurrence of differences between spouses, which negatively affects the children, and divorce occurs, which results in the demolition of this edifice. The great, and how that contradicts the purposes of Islamic law regarding marriage. It also aims to show the civil person’s care for the family and the discipline of its system, by preserving lineages, and tightening the marriage bond, then the kinship bond, then the in-laws bond, because marital disputes are a destructive tool for the family and society, and its presence leads to the failure to achieve the main legitimate purpose of marriage. The researcher used the descriptive approach, with the help of the deductive and analytical approaches, to clarify the provisions related to the family, and their close connection with the purposes of Islamic Sharia, and the conflict of marital disputes with the realization of these lofty purposes. This research included six chapters as follows: Chapter One: In it, he talked about the purposes of Islamic legitimacy and its effects on the family and society. The second chapter deals with the general legal controls and measures to protect the family before the marriage contract is made and its connection to the purposes of Islamic Sharia. And the third chapter: it talks about the legal controls and measures when making a marriage contract. And the fourth chapter: it talks about the legal controls and measures after the marriage contract. The fifth chapter deals with marital disputes, their types, causes and methods of treatment in light of the purposes of Islamic legislation. As for the sixth chapter, it talks about the reflection of marital disputes on the family and society, and their conflict with the purposes of Islamic Sharia. At the conclusion of his research, the researcher reached the most important results: that the rules of the family in Islam are of great importance, so Islam was keen to protect the family from everything that leads to its collapse or demolition, and that marital disputes work to destroy this important building in society, and that these provisions Closely related to the purposes of Sharia Islamic law, and achieving the supreme goal of marriage, which is to create a righteous offspring in society, as well as linking legal measures to protect the family to the religious motive, which is the basis of all these measures, and the importance of a medical examination before marriage, because it protects the family from many problems in the future. The most important recommendations of this research are summarized in the necessity of creating awareness among spouses and knowledge of the legal rulings related to the family, and standing at the rights and duties of each of them, and the extent to which the existence of marital disputes is linked to preventing the achievement of the purposes of Islamic law from marriage and its reflection on society, and the religious determination of spouses must be increased. Because this leads to the receding of differences between them, as well as results in the existence of a family, young people, and a society free of crime, perversion and perversion. | |
