Abstract
تتناول هذه الدراسة الانتهاكات الجسيمة التي يتعرض لها الأشخاص ذوو الإعاقة في قطاع غزة في ظل العدوان الإسرائيلي المتواصل منذ 7 أكتوبر 2023، والذي خلّف آثارًا إنسانية مدمّرة طالت جميع فئات المدنيين، مع تصاعد حدة المعاناة لدى الفئات الأكثر هشاشة، وفي مقدمتهم ذوو الإعاقة. وتنطلق الدراسة من الإطار القانوني الذي ترسمه قواعد القانون الدولي الإنساني والاتفاقيات الدولية ذات الصلة، وعلى رأسها اتفاقية جنيف الرابعة لعام 1949، والبروتوكول الإضافي الأول لعام 1977، واتفاقية حقوق الأشخاص ذوي الإعاقة لعام 2006، بالإضافة إلى قرارات الأمم المتحدة، وفي مقدمتها قرار مجلس الامن رقم 2475 لسنة 2019.
تتبلور الإشكالية الرئيسية حول "هل تنسجم الممارسات الإسرائيلية في قطاع غزة مع الالتزامات الدولية المتعلقة بحقوق الأشخاص ذوي الإعاقة أثناء النزاعات المسلحة؟"، خاصة في ظل ما يتعرض له ذوو الإعاقة من تهجير قسري، واستهداف للمرافق الحيوية، وحرمان من الإجلاء والرعاية، وغياب الترتيبات التيسيرية، مما يكشف عن إخفاق مزدوج في الحماية القانونية والإنسانية.
اعتمدت الباحثة المنهج الوصفي التحليلي، وتوصّلت من خلال تحليل النصوص القانونية الدولية والوقائع الميدانية إلى أن الأشخاص ذوي الإعاقة يتمتعون بحماية مزدوجة في النزاعات المسلحة: كمدنيين بموجب القانون الدولي الإنساني، وكفئة هشّة وفق اتفاقية حقوق الأشخاص ذوي الإعاقة لعام 2006، ما يجعل حماية حقوقهم التزامًا قانونيًا دوليًا وليس مجرد واجب أخلاقي. وتؤثر النزاعات المسلحة على الأشخاص ذوي الإعاقة أكثر من غيرهم، حيث كشف تحليل الحالة في قطاع غزة عن انتهاكات منهجية تشمل فقدان البيئة الآمنة، وتدمير المرافق، وحرمانهم من الخدمات الأساسية، ما يبرز فجوة بين الالتزامات الدولية والممارسات الواقعية.
بناءً على هذه النتائج، توصي الدراسة بتحرك المجتمع الدولي بشكل عاجل وفعّال لضمان حماية الأشخاص ذوي الإعاقة والوصول الآمن للمساعدات الإنسانية والطبية، وفق التزامات اتفاقية جنيف الرابعة وقرارات مجلس الأمن. كما توصي بتفعيل مبدأ الولاية القضائية العالمية كآلية بديلة لمحاسبة مرتكبي جرائم الحرب والجرائم ضد الإنسانية، بما يعزز العدالة الدولية ويمنح الضحايا سبل إنصاف فعّالة رغم التحديات أمام المحكمة الجنائية الدولية.
تم تقسيم الدراسة إلى فصلين، يتناول الفصل الأول: الإطار النظري لحماية الأشخاص ذوي الإعاقة في القانون الدولي الإنساني وقانون حقوق الانسان، بحيث تم تقسيمه لمبحثين، يتناول المبحث الأول، الركائز المفاهيمية والقانونية لحقوق الأشخاص ذوي الإعاقة في القانون الدولي، بينما يستعرض المبحث الثاني، الإطار القانوني الدولي الناظم لحماية الأشخاص ذوي الإعاقة.
أما الفصل الثاني، فيسلط الضوء على الانتهاكات الجسيمة لحقوق الأشخاص ذوي الإعاقة في قطاع غزة المحتل، وتم تقسيمه لمبحثين، يتناول الأول: الجرائم الإسرائيلية بحق الأشخاص ذوي الاعاقة في قطاع غزة، أما المبحث الثاني، يبحث في التدمير الممنهج للبنى التحتية والمنشآت الصحية والاجتماعية المخصصة للأشخاص ذوي الاعاقة.
This study addresses the grave violations faced by persons with disabilities in the Gaza Strip amid the ongoing Israeli aggression since October 7, 2023, which has caused devastating humanitarian consequences affecting all segments of the civilian population, with heightened suffering among the most vulnerable groups, particularly persons with disabilities. The study is grounded in the legal framework established by the rules of international humanitarian law and relevant international conventions, foremost among them the Fourth Geneva Convention of 1949, the First Additional Protocol of 1977, and the Convention on the Rights of Persons with Disabilities of 2006, in addition to United Nations resolutions, including Security Council Resolution No. 2475 of 2019. The main research problem revolves around the question: “Do Israeli practices in the Gaza Strip comply with international obligations concerning the rights of persons with disabilities during armed conflicts?” This is particularly pertinent in light of the forced displacement, targeting of critical facilities, denial of evacuation and care, and absence of accessibility arrangements faced by persons with disabilities, which reveal a dual failure in both legal and humanitarian protection. The researcher adopted a descriptive-analytical approach and, through analysis of international legal texts and field data, concluded that persons with disabilities enjoy double protection in armed conflicts: as civilians under international humanitarian law, and as a vulnerable group under the Convention on the Rights of Persons with Disabilities of 2006, making the protection of their rights an international legal obligation rather than merely a moral duty. Armed conflicts disproportionately affect persons with disabilities, as the case analysis in the Gaza Strip revealed systematic violations, including the loss of safe environments, destruction of facilities, and deprivation of essential services, highlighting a significant gap between international obligations and actual practices. Based on these findings, the study recommends urgent and effective action by the international community to ensure the protection of persons with disabilities and safe access to humanitarian and medical assistance, in accordance with the obligations of the Fourth Geneva Convention and relevant Security Council resolutions. The study also recommends activating the principle of universal jurisdiction as an alternative mechanism to hold perpetrators of war crimes and crimes against humanity accountable, thereby strengthening international justice and providing effective remedies to victims despite the challenges facing the International Criminal Court. The study is divided into two chapters. The first chapter addresses the theoretical framework for the protection of persons with disabilities under international humanitarian law and human rights law. It is divided into two sections: the first discusses the conceptual and legal foundations of the rights of persons with disabilities under international law, while the second examines the international legal framework regulating their protection. The second chapter highlights the grave violations of the rights of persons with disabilities in the occupied Gaza Strip. It is also divided into two sections: the first addresses Israeli crimes against persons with disabilities in Gaza, and the second examines the systematic destruction of infrastructure and health and social facilities dedicated to persons with disabilities.
