| dc.description.abstract | تناول الباحث في هذه الرسالة موافقات ابن تيمية لما تفرد به المذهب المالكي في كتاب الزكاة والصيام والحج، وتكمن المشكلة الرئيسة للرسالة في قلة الدراسات التي أولت اهتمامًا بجمع تلك المواضع التي وافق فيها ابن تيمية المذهب المالكي. وتهدف هذه الرسالة إلى بيان حدود هذه الموافقات ورصدها، والكشف عن مدى استقلالية ابن تيمية في تبني الآراء الفقهية بعيدًا عن الجمود المذهبي، وإبراز منهجه في التعامل مع النصوص والأدلة الشرعية، بما يعكس سعة أفقه الفقهي وقدرته على الترجيح بين الأقوال المذهبية. كما تسعى الدراسة إلى بيان قيمة التراث الفقهي المالكي، ومدى أثره في تشكيل اجتهادات العلماء من خارج المذهب. اتبع الباحث في هذه الرسالة المنهج الوصفي؛ وذلك بوصف المسائل الفقهية التي انفرد بها المذهب المالكي عن بقية المذاهب ووصف رأي ابن تيمية في تلك المسائل. مستعينًا بالمنهجين التحليلي والاستقرائي؛ حيث تم تتبع المسائل الفقهية المتعلقة بالزكاة والصيام والحج، وجمع الآراء الفقهية للإمام ابن تيمية ومقارنتها بالمذهب المالكي، مع تحليل الأدلة النصية التي استند إليها الطرفان. وتوصل الباحث في هذه الرسالة إلى أن ابن تيمية لم يكن أسيرًا للمذهب الحنبلي، بل كان يختار القول الذي يراه أقرب إلى الدليل، حتى لو كان من مذهب آخر، وقد وافق المالكية في عدد من المسائل المدروسة، مما يعكس انفتاحه على المذاهب الفقهية الأخرى. كما أظهرت النتائج أن هذه الموافقات لم تكن تبعية للمالكية، وإنما نابعة من اجتهاد مستقل، التقى في بعض نتائجه مع ما ذهب إليه المالكية. ويوصي الباحث بكتابة دراسات من قبل الباحثين تتعلق بموافقات ابن تيمة لما تفرّد به المذهب المالكي في باقي الأبواب الفقهية. | ar |
| dc.description.abstract | This thesis explores Ibn Taymiyyah’s agreements with the distinctive rulings of the Mālikī school in the areas of akat (almsgiving), ṣawm (fasting), and ḥajj (pilgrimage). The central problem addressed in this study lies in the scarcity of research devoted to identifying the specific instances in which Ibn Taymiyyah concurred with Mālikī jurisprudence. The study aims to define and document these agreements, to highlight the extent of Ibn Taymiyyah’s independence in adopting juristic views beyond rigid adherence to a single school, and to shed light on his methodology in engaging with textual and legal evidences. This, in turn, reflects his broad juristic outlook and his ability to weigh between differing doctrinal opinions. Furthermore, the research seeks to underscore the significance of Mālikī legal heritage and its impact on shaping the reasoning of scholars outside the school. The researcher employed the descriptive method by outlining the juristic issues in which the Mālikīs differed from other schools, along with Ibn Taymiyyah’s positions on those issues. In addition, analytical and inductive methods were applied: tracing juristic questions related to akat, fasting, and pilgrimage, collecting Ibn Taymiyyah’s legal opinions, comparing them with Mālikī views, and analyzing the textual evidences relied upon by both sides. The findings reveal that Ibn Taymiyyah was not bound by Ḥanbalī doctrine; rather, he selected the view he deemed most consistent with the evidence, even if it originated from another school. He thus concurred with the Mālikīs on a number of issues examined in this study, which reflects his openness to other legal traditions. The results also demonstrate that his agreements with the Mālikīs did not stem from mere imitation but from independent juristic reasoning that, in some cases, coincided with Mālikī conclusions. The researcher recommends further studies on Ibn Taymiyyah’s agreements with distinctive Mālikī positions in other branches of Islamic jurisprudence. | en |
