| dc.description.abstract | تناقش هذه الرسالة موضوع "التنظيم القانوني في إطار رخصة البناء" في فلسطين، حيث تسلط الضوء على الإطار القانوني والإداري الذي ينظم عملية منح رخص البناء، بالإضافة إلى التحديات والنزاعات التي تنشأ نتيجة لذلك. تتناول الدراسة مجموعة من الجوانب الأساسية المتعلقة بحقوق الأفراد والمصالح العامة، وتأثير الظروف السياسية والاقتصادية على هذه العملية. تبدأ الرسالة بتحديد مفهوم رخصة البناء وأهميتها كمكون أساسي في حق ملكية الأرض، حيث يكفل القانون للأفراد حرية استخدام ممتلكاتهم. ومع ذلك، فإن هذه الحرية مقيدة بمصالح المجتمع وقوانين البناء، مما يتطلب تنظيمًا دقيقًا لضمان حماية البيئة والمصالح العامة. تستعرض الرسالة الأطر القانونية المتعلقة برخص البناء، مشيرة إلى القوانين السارية في الضفة الغربية وقطاع غزة، مثل قانون تنظيم المدن والقرى رقم (79) لسنة 1966. وتوضح كيف أن هذه القوانين تتضمن إجراءات معقدة تتطلب من الأفراد الالتزام بشروط محددة للحصول على رخص البناء. كما تبرز الرسالة دور الجهات المختصة في منح رخص البناء، حيث يتم تقسيم المسؤوليات بين اللجان المحلية واللجان الإقليمية. ومع ذلك، يظهر أن هذا التعدد في الجهات يؤدي إلى تضارب في القرارات وشكاوى من الأفراد الذين يشعرون بأن حقوقهم لا تُحترم. تتناول الرسالة أيضًا القضية الشائكة المتعلقة بالتحديات التي يواجهها الأفراد نتيجة الاحتلال، حيث تشير إلى كيف أن الاحتلال يفرض قيودًا على البناء في مناطق معينة، مما يحرم الأفراد من حقوقهم الأساسية. هذا الواقع يعكس الحاجة الملحة لتطوير سياسات قانونية تتماشى مع الظروف الخاصة بفلسطين. كما وتستعرض الدراسة أيضًا المنازعات القضائية المتعلقة برخص البناء، مشيرة إلى أن الأفراد يواجهون صعوبة في الطعن في قرارات اللجان، فهناك نقص في آليات الطعن الفعالة، مما يحرم الأفراد من الفرصة للدفاع عن حقوقهم القانونية. | ar |
| dc.description.abstract | This thesis discusses the topic of "The Legal Framework for Building Permits" in Palestine, highlighting the legal and administrative structures governing the issuance of building permits, as well as the challenges and disputes that arise as a result. The study explores key aspects related to individual rights, public interests, and the impact of political and economic conditions on this process. The thesis begins by defining the concept of the building permit and its importance as an essential component of property rights, where the law guarantees individuals the freedom to use their property. However, community interests and construction regulations, requiring precise organization to ensure environmental protection and the safeguarding of public interest, restrict this freedom. The thesis reviews the legal frameworks related to building permits, referring to the laws in effect in the West Bank and Gaza Strip, such as the Cities, Villages, and Buildings Planning Law No. (79) Of 1966. It explains how these laws involve complex procedures that require individuals to comply with specific conditions to obtain building permits. The thesis also highlights the role of the competent authorities in granting building permits, where responsibilities are divided between local and regional committees. However, this multiplicity of bodies often leads to conflicting decisions and complaints from individuals who feel their rights are not respected. The thesis also addresses the complex issue of challenges faced by individuals as a result of the occupation, noting how the occupation imposes restrictions on construction in certain areas, thereby depriving individuals of their basic rights. This reality reflects the urgent need to develop legal policies that align with Palestine’s unique circumstances. The study also examines legal disputes related to building permits, noting that individuals face difficulties in appealing committee decisions due to a lack of effective appeal mechanisms, depriving them of the opportunity to defend their legal rights. The thesis concludes that there is a pressing need to unify and modernize building-related legislation in accordance with contemporary urban planning standards, reorganize the powers of the competent authorities responsible for issuing permits, and enhance transparency and oversight, in a way that balances the individual's right to build with the community's interest in regulation | en |
