Abstract
يتوافد في كل عام إلى فلسطين أعداد هائلة من السياح، ويؤثر ذلك بشكل ايجابي على اقتصادها، ولكن في الخامس من شهر آذار من عام 2020 ظهرت أول حالات الاصابة بفيروس كورونا في فلسطين وبالتحديد في مدينة بيت لحم، ومع انتشار فيروس كورونا (كوفيد-19) أثر ذلك على العديد من القطاعات المختلفة في دول العالم العربية والأجنبية ومنها فلسطين التي انعكس أثر هذه الجائحة على القطاع السياحي بشكل سلبي وخاصة على الالتزامات العقدية بقطاع السياحة، والتكييف القانوني لجائحة كورونا، والمسؤولية المدنية لوكالات السياحة واعفاء وكالات السياحة من التعويض في ظل جائحة كورونا.
وبما أن القطاع السياحي تتوافر فيه جميع الشروط المشترطة لنظرية القوة القاهرة فهي ظرف استثنائي غير متوقع ولا يمكن دفعه، وقد جعل تنفيذ الالتزام مستحيلاً لأحد اطرافه ويورث خللاً في مبدأ توزان العقد، حيث أن هذه الشروط مجتمعة وقعت على جائحة كورونا كونها غير متوقعة ولا يمكن دفعها كونها وباء انتشر على مستوى العالم ولم يكن له علاج وأثر على الناس أجمع، وبالنسبة لقطاع السياحة في فلسطين فقد أصبح على المدين غير قادر على تنفيذ الالتزام المترتب عليه، حيث أن تنفيذه أصبح مستحيلاً كونه خرج عن سيطرته، كما وأن قيام المسؤولية التعاقدية في عقد السياحة في ظل جائحة كورونا وترتب المسؤولية على أطراف العقد، ولكن هذه المسؤولية ليست مطلقة كون هناك عوارض المسؤولية التعاقدية في ضوء جائحة كورونا ألا وهي نظرية القوة القاهرة ونظرية الظروف الطارئة والتي من خلالها عند اثباتها تستخدم كعذر للتعويض عن المسؤولية أو تعديلها.
Palestine is visited by a large number of tourists every year, which in turn affects positively. the economy of the country (Palestine). However, on the fifth of March of 2020 the first case of covid-19 appeared in Palestine, particularly in Bethlehem. Since days the spread of covid-19 affected a lot of sectors in the Arab world as well as the foreign countries. In fact, this pandemse effected Palestine, especially the tourism sector with all its fields: contracts committments civil responsibilities towards the tourism agencies and free these agencies from compensation during the corona virus pandemic. Since the tourism sector already has all the terms of the theory of uncontrollable force it is considered to be an exceptional. and unexpected condition which can't be paid, so commitment has become impossible for one of its parties, as a result, it causes a defect in the contract. Because all these terms happened during this unexpected pandemic. All over the world and has had it's negative effects on all the people, the delters become have become unable to pay their uncontrollable conmmittments. The responsibility is based on the parties of the contract. However it's not absolute because of the effects of coved 19 which is considered to be the theory of the uncontrollable force and urgent circumstances which are used as an excuse for compensation of the committment.
