| dc.description.abstract | تعدُّ الأدلة الجنائية الركيزة الأساسية في الدعوى الجنائية حيث يبنى على أساسها الحكم الجنائي، وإن الأدلة الخفية تمثل تحديًا كبيرًا في مجال الإثبات الجنائي، وذلك لما تثيره من إشكاليات تتعلق بالموازنة بين مصلحة العدالة في كشف الحقيقة،وأهمية حماية الحقوق والحريات الفردية، وعلى رأسها حق الخصوصية. حيث جاءت هذه الدراسة لتوضح آليات التحصل على الوسائل بشكل خفي، وما هي الطرائق للتحصل على هذه الأدلة، كما أن هل يوجد لهذه الأدلة حجة قانونية كدليل إدانة أم براءة أم لا، وفي حال التحصل على الدليل بطريقة هل يؤخذ به كقرينة للبراءة أم يعد دليل باطل ولا يصح الأخذ به. كما تمثلت إشكالية الدراسة في كيف عالج المشرع الجزائي الفلسطيني إستخدام وسائل خفية في الإثبات الجزائي؟، وإنطلاقاً من ذلك تبرز أهمية الدراسة العملية في القانون الذي خصص نصوصاً تنظم ما الأدلة وما الطرق للتحصل على هذه الأدلة لتعد أدلة قانونية يؤخذ بها أمام القضاء، أماا عن الأهمية النظرية فتكمن في مدى أهمية مشروعية الدليل المقدم أمام القضاء وآالية التحصل عليه، ومدى مشروعيته ليعتد به كدليل. وخلصت الدراسة إلى أنَّ نظام الإثبات في فلسطين هو نظام إثبات حر، ومع ذلك فإن التسجيلات الصوتية لا يؤخذ بها كدليل وحيد لبناء الحكم، إلا أنه يوخذ به كقرينة لدليل أساسي، وقلة ما يؤخذ بها كدليل إثبات وحيد دون دعائم أخرى. جاءت هذه الدراسة لتوصي المشرع الجزائي الفلسطيني بوضع نصوص واضحة وصارمة، لكل من يتعسف في استخدام سلطته في اخراق الحق في الخصوصية. | ar |
| dc.description.abstract | Criminal evidence constitutes the cornerstone of criminal proceedings, as the judgment is based upon it and justice is achieved through it. Evidence obtained by covert means represents one of the most controversial issues in criminal proof, as it raises challenges concerning the balance between the interest of justice in uncovering the truth and the protection of individual rights and freedoms, foremost among them the right to privacy. This study aims to examine the legality of evidence obtained covertly within the Palestinian legal system, to clarify the mechanisms and methods used in acquiring such evidence, and to determine the extent of its legal validity as proof or as supporting circumstantial evidence on which the judge may rely. It further investigates whether evidence obtained through unlawful means should be considered invalid and inadmissible, or whether it may serve as supporting evidence alongside other legitimate proofs. The central problem of this study lies in the question: How did the Palestinian legislator address the use of covert means in criminal proof? Accordingly, the theoretical significance of this research lies in highlighting the concept of the legitimacy of evidence, the means by which it is obtained, and the extent to which it meets the conditions of legality to be admissible before the court. The practical significance, on the other hand, lies in analyzing the Palestinian legal provisions that regulate methods of investigation and evidence collection, ensuring the fairness of proceedings and preventing abuse of power. The study concludes that the Palestinian system of proof is based on the principle of the judge’s freedom of conviction, yet audio recordings alone cannot constitute sufficient proof for conviction; rather, they may be considered as corroborating evidence in support of other proofs. The research recommends that the Palestinian criminal legislator adopt explicit and stringent provisions to criminalize any misuse of authority that infringes upon the right to privacy and undermines the principles of procedural justice. | en |
