| dc.description.abstract | هدفت هذه الدراسة إلىالتعرف على دور محاكم تسوية الأراضي والمياه الفلسطينية في تعزيز وصول النساء إلى حقوقهن الإرثية، دراسة حالة محاكم تسوية الخليل، لذلك ولإتمام هذه الدراسة فقد استخدمت الباحثة المنهج الوصفي التحليلي، وقد تم اخذ عينة الدراسة من ثلاث مجتمعات أولها جميع النساء مقدمات الاعتراضات لدى محاكم تسوية أراضي الخليل اللواتي بلغ عددهن (14562) سيدة وقد كانت العينة الممثلة لهذا المجتمع تساوي (374 امرأة) وقع عليهن الاختيار بالطريقة العشوائية البسيطة، وقضاة التسوية العاملين في محاكم تسوية الخليل هم المجتمع الثانيحيث بلغ عددهم (7) وتم اختيارهم بأسلوب المسح الشامل، والمجتمع الثالث تكون من المحامين المختصين بنظر قضايا التسوية وعلى راسها النزاعات الإرثية وعددهم (12) وتم اختيارهم بأسلوب العينة القصدية، أما عن أدوات الدراسة فقد عملت الباحثة على بناء ثلاث أدوات لإتمام هذه الدراسة فقد كانت الاستبانة أولها وتم تطبيقها على عينة النساء، والمقابلة الأداة الثانيةوتم إجراءها بشكل مباشر مع قضاة محاكم التسوية، أما مجتمع المحامين فقد تم تطبيق الأداة الثالثة عليه التي تمثلت في الحلقة النقاشية والتي تم عقدها بشكل مباشر، وقد تمت هذه الدراسة في الفترة الواقعة ما بين شهر كانون ثانِ من العام 2024 وحتى الأخر من شهر كانون اول من العام 2024. وقد توصلت الدراسة إلى مجموعة من النتائج تمثلت في ان محاكم تسوية الأراضي والمياه الفلسطينية تساهم بدرجة متوسطة في وصول النساء إلى حقوقهن الإرثية، وان القوانين والنظم المعمول بها في محاكم التسوية كانت واضحة بدرجة متوسطة لدى النساء، وان النظام القضائي وكفاءة الكوادر العاملة في محاكم التسوية اثبتت فاعلية بدرجة متوسطة كما تراها النساء، أما فيما يتعلق بمستوى الوعي لدى النساء بحقوقهن الإرثية وكيفية الحصول عليها من خلال محاكم التسوية فقد جاء بدرجة كبيرة،وقد توصلت الدراسة أيضا إلى ان التحديات والعقبات التي تواجه النساء في اللجوء إلى محاكم التسوية للوصول إلى حقوقهن الإرثية فقد جاءت بدرجة كبيرة،كما أظهرت النتائج أن المحاور وضوح القوانين والنظم المعمول بها في محاكم التسوية، وفاعلية النظام القضائي وكفاءة الكوادر في محاكم التسوية، ومساهمة محكمة التسوية في وصول النساء على حقوقهن الإرثية،كانت المحاور الحصرية وبالترتيب اللواتي كان لها علاقة ذات دلالة إحصائية على دور محكمة تسوية الأراضي والمياه في تعزيز وصول النساء إلى حقوقهن الإرثية. كما أظهرت نتائج الدراسة بان النساء لا يختلفن في موافقتهن على دور محاكم تسوية الأراضي والمياه في وصولهن لحقوقهن الإرثية باختلاف أعمارهن، والحالة الاجتماعية، كما أظهرت ان النساء يختلفن في موافقتهن على دور محاكم تسوية الأراضي والمياه في وصولهن لحقوقهن الإرثية باختلاف مستوياتهن العلمية، ومستوى المعيشة، ومكان السكن. توصلت الباحثة من خلال هذه الدراسة إلىاقتراح مجموعة من التوصيات تمثلت في وجوب عمل الجهات المختصة وأصحاب القرار على تحديث قانون تسوية الأراضي والمياه والقوانين المتعلقة بالإرث والإجراءات الشرعية، إضافة إلىإقرار تشريعات قانونية خاصة بالنساء وداعمة لها، وضرورة العمل على توعية النساء فيما يخص كيفية الحصول على حقوقهن الإرثية، وذلك من خلال تفعيل دور مؤسسات المجتمع المدني عقد الندوات والورشات لتزويد النساء بالمعلومات القانونية التي تساعدهن على المطالبة بحقوقهن، وإيجاد جمعيات قانونية تعمل على مساعدتهن وتوفير الاستشارات المجانية أو بأسعار معقولة، ولتسريع الفصل في النزاعات الإرثية والاعتراضات المقدمة أمام محاكم تسوية محافظة الخليل يجب العمل على حل جميع المعيقات والتحديات التي تواجه عملها، من رفد هذه المحاكم بعدد كافي من القضاة والموظفين وتدريبهم وتأهيلهم وتزويدهم بجميع الإمكانيات اللازمة لرفع مستوى دور محاكم تسوية الأراضي والمياه في محافظة الخليل في أداء عملها. | ar |
| dc.description.abstract | This study aimed to identify the roleof Palestinian Land and Water Settlement Courts in enhancing women’s access to their inheritance rights. A case study of the Hebron Governorate Settlement Courts,Therefore, to complete this study, the researcher used the qualitative descriptive approach. The study sample was taken from three communities, the first of which was all women who submitted objections to the Hebron Land Settlement Courts. The sample amounted to (374 women) who were selected by a simple random method,the settlement judges working in the Hebron settlement courts they are (7) number, were selected using a comprehensive survey. The third group consists of lawyers specialized in settlement cases, the most important of which are inheritance disputes. They are (12) in number and were deliberately chosen,as for the study tools, the researcher worked on building three tools to complete this study. The researcher used the questionnaire to apply it to a sample of women, and the interview was conducted directly with the judges of the settlement courts. As for the community of lawyers, the discussion circle was applied to them directly, and this study was conducted in the period between January 2024 and the end of December 2024. The study reached a set of results, namely that the Palestinian Land and Water Settlement Courts contribute to a moderate degree in women’s access to their inheritance rights, and that the laws and systems in force in the settlement courts were moderately clear to women, and that the judicial system and the competence of the cadres working in the settlement courts proved effective. To a moderate degree, as seen by women,as for the level of awareness among women of their inheritance rights and how to obtain them through settlement courts, it was high. The study also found that the challenges and obstacles that women face in resorting to settlement courts to access their inheritance rights were high,The results also showed that the axes clarity of the laws and systems in force in the settlement courts, the effectiveness of the judicial system, the efficiency of the cadres in the settlement courts, and the contribution of the settlement court to women’s access to their inheritance rights, were the exclusive axes and in order that had a statistically significant relationship to the role of the Land and Water Settlement Court. The results of the study also showed that women do not differ in their approval of the role of the Land and Water Settlement Courts in their access to their hereditary rights according to their age and marital status. Through this study, the researcher reached a set of recommendations, namely the necessity of the competent authorities and decision-makers working to modernize the land and water settlement law and the laws related to inheritance and legal procedures, in addition to approving legal legislation that is specific to and supportive of women,It is necessary to work to raise women’s awareness regarding obtaining their inheritance rights, by activating the role of civil society institutions, holding seminars and workshops to provide women with legal information that helps them claim their rights, and creating legal associations that work to help them and provide free or reasonable consultations ,In order to speed up the settlement of inheritance disputes and objections submitted before the Hebron Governorate Settlement Courts, work must be done to solve all the obstacles and challenges facing their work by supplying these courts with a sufficient number of judges and employees, training and qualifying them, and providing them with all the necessary capabilities to raise the level of the role of the Land and Water Settlement Courts in the Hebron Governorate in performing their work. | en |
