dc.description.abstractتتناول هذه الرسالة بالدراسة والتحليل موضوع حق المستهلك في العدول عن عقد البيع الالكتروني في التشريعات النافذة في فلسطين، باعتباره أحد أهم الضمانات الحديثة لحماية المستهلك في بيئة التعاملات الرقمية، ويكتسب هذا الموضوع أهميته من كون عقود البيع الالكتروني تبرم عن بعد دون لقاء مباشر بين البائع والمستهلك مما يجعل المستهلك عرضة للتسرع أو التضليل أو الخطأ في التقدير. فحق العدول هو آلية قانونية لحماية المستهلك في عقود البيع الالكتروني، حيث يمكن هذا الحق المستهلك من إرجاع السلعة أو إلغاء الخدمة خلال مهلة محددة وبإرادته المنفردة كضمانة أساسية للطرف الضعيف في التعاقدات الالكترونية وهو المشتري، وهذا خروج عن القواعد العامة ويشكل خرق لمبدأ القوة الملزمة للعقد وذلك لعدم إمكانية معاينة السلعة فعليًا قبل إبرام العقد عبر الانترنت، ولكن تتضمن هذه الآلية قيودًا قبل عدم استخدام السلعة أو الخدمات، ووفقًا للتشريعات الناظمة لحق العدول يكون المستهلك غير مسؤول عن تكاليف الإلغاء ما لم يستخدم السلعة أو الخدمة بالفعل. تهدف هذه الدراسة إلى تحديد الأساس القانوني لحق العدول وبيان مدى اعتراف التشريع الفلسطيني بهذا الحق مقارنة بالتشريعات العربية والأجنية مع تحليل النصوص ذات الصلة في قانون حماية المستهلك رقم (21) لسنة 2005، وقرار بقانون رقم (17) لسنة 2024 بشأن المعاملات الالكترونية الفلسطيني، وكذلك القرار بقانون رقم (21) لسنة 2025 بشأن التجارة الالكترونية، حيث اعتمدت الدراسة المنهج التحليلي المقارن من خلال تحليل النصوص القانونية الفلسطينية ومقارنتها مع نظيراتها كالأردن ومصر والاتحاد الأوروبي واستعراض الاجتهادات الفقهية والقضائية ذات الصلة. وقد خلصت الدراسة إلى أن التشريعات الفلسطينية لم تنظم حق العدول بشكل صريح مما يؤدي إلى ضعف حماية المستهلك الالكتروني ويجعل من الضروري إدخال تعديلات تشريعية تكفل هذا الحق بصورة واضحة وذلك من خلال إدخال نص تشريعي صريح يمنح المستهلك حق العدول خلال مدة لا تقل عن سبعة أيام من تاريخ تسلم السلعة أو إبرام العقد، وإلزام المزود أو البائع الالكتروني بإعلام المستهلك مسبقًا بحق العدول وشروطه قبل إتمام عملية الشراء، وضرورة تطوير الإطار القانوني للتجارة الالكترونية في فلسطين فتناول موضوع حق العدول لا يعد تزيدًا قانونيًا بل ضرورة تشريعية ومجتمعية ملحة، تمليها وتفرضها متطلبات الواقع الرقمي المتسارع، مما يحقق التوازن العقدي بين المستهلك والمزود ويعزز الثقة والمصداقية في السوق الرقمية ولاسيما القدرة على الحد من النزاعات القانوينة. ar
dc.description.abstractThis thesis examines and analyzes the topic of the consumer’s right of withdrawal from electronic sales contracts under the applicable legislation in Palestine, as one of the most important modern guarantees for consumer protection in the digital transaction environment. The significance of this topic stems from the fact that electronic sales contracts are concluded remotely, without direct contact between the seller and the consumer, which exposes the consumer to risks such as haste, deception, or error in judgment. The right of withdrawal is a legal mechanism designed to protect the consumer in electronic sales contracts. It enables the consumer to return the product or cancel the service within a specific period, based solely on their unilateral will, as a fundamental safeguard for the weaker party in electronic transactions—the buyer. This represents a departure from general contractual principles and constitutes an exception to the principle of the binding force of contracts, due to the consumer’s inability to physically inspect the goods before concluding the contract online. However, this mechanism includes restrictions, such as the condition that the product or service must not have been used. According to the legislation governing the right of withdrawal, the consumer is not responsible for cancellation costs unless they have actually used the product or service. This study aims to identify the legal basis of the right of withdrawal and to determine the extent to which Palestinian legislation recognizes this right, in comparison with Arab and foreign legislations. It also analyzes the relevant provisions in the Consumer Protection Law No. (21) Of 2005 and the Decree-Law No. (17) Of 2024 concerning Palestinian electronic transactions and Decree Law No. (21) Of 2025 on Electronic Commerce.The study adopts a comparative analytical methodology by analyzing Palestinian legal texts and comparing them with their counterparts in Jordan, Egypt, and the European Union, as well as reviewing related legal and judicial doctrines. The study concludes that Palestinian legislation does not explicitly regulate the right of withdrawal, which leads to weak protection for electronic consumers. Therefore, it is necessary to introduce legislative amendments that clearly guarantee this right by enacting an explicit legal provision granting consumers the right to withdraw within no less than seven days from the date of receiving the goods or concluding the contract. The electronic supplier or seller should also be obligated to inform the consumer in advance of the right of withdrawal and its conditions before completing the purchase process. Moreover, developing the legal framework for e-commerce in Palestine is essential. Addressing the right of withdrawal is not a redundant legal measure, but rather an urgent legislative and societal necessity imposed by the accelerating digital reality. Such measures would achieve contractual balance between the consumer and the supplier and enhance trust and credibility in the digital marketplace, particularly by reducing legal disputes.en
