| dc.description.abstract | يعد الفساد مشكله العصر وآفة المجتمع واسع النطاق والانتشار، إذ تعاني منه أغلب الدول وخاصة البلدان النامية، التي تسعى دائما للنهوض بمؤسساتها وبمواطنيها، سيما وأن آثار هذه الظاهرة تنعكس بشكل سلبي على المستوى المعيشي للمواطنين، وتضعف ثقته بمؤسسات الدولة وبفاعليتها في مكافحة الفساد، مما يقف حائلا دون النهوض بدولة قانونية يتمتع فيها الجميع بكامل الحقوق المدنية والسياسية، ويشعر فيها بالعدل والأمن والامان، والمساواة في المراكز القانونية التي يتمتعون بها، وباستمرارية ظاهرة الفساد تنتهك حقوق الانسان نتيجة استنزاف موارد الدولة واستغلالها بصورة غير مشروعة، مما يؤدي ذلك إلى إهدار المال العام وتقويضه، نتيجة للسيطرة عليه بصورة غير مشروعه، ممثلا ذلك بسلب وتهريب الاصول العامة بالفساد، وأمام كل ذلك كان لابد تظافر جهود وطنية ودولية، في مكافحته ممثلا باسترداد الأصول المسلوبة على الصعيدين الوطني والدولي، وذلك من خلال استراتيجيات وتشريعات قانونية وطنية ودولية تعزز وتنمي آليات مكافحة الفساد واسترداد الأصول المسلوبة المتحصلة منه، وإعادة هذه الأصول الى أصلها أي للمنفعة العامة وللدولة، وحتى يتحقق الردع العام ووقف نزيف استنزاف موارد الدولة . | ar |
| dc.description.abstract | Corruption is deemed the troubling issue of the current Age, the plague of society, widespread and encompassing. Most countries suffer from corruption and the impacts thereof, in particular, those developing countries that aspire to evolve on the institutional level and on that of the citizens, especially given the fact that impacts of corruption reflect negatively upon the livelihood of citizens. Moreover, they, i.e. those impacts, weaken the citizens’ trust in the institutions of their own country and in the ability thereof to fight corruption, forming thus a block preventing the development of a state based on law wherein all citizens enjoy, fully, their civil and political rights, wherein too they can live in security and peace, enjoying both justice and equality each according to his/her legal status. Additionally, corruption encroaches upon the rights of people as it drains the resources of countries, illegally exploiting them, which leads to wasting public wealth as a result of illegally acquiring public wealth and leaking public assets by way of corruption. Therefore, there must be national and international efforts to fight corruption and re-acquire leaked public assets on both the national and international levels by way of legal legislations and strategies, both national and international, to support mechanisms of fighting corruption and recovering stolen public assets, placing them back where they belong, i.e. the public good of the state and society, leading to public deterrence of corruption and stopping the exploitation of states’ resources. | en |
