| dc.description.abstract | تنبع أهمية الدراسة في أنها تلقي الضوء على آليات حماية حقوق الإنسان سواء التعاقدية وغير التعاقدية على المستوى الدولي، من حيث تحليل النصوص القانونية والبحث في آليات المساءلة عن انتهاكات حقوق الإنسان الفلسطيني. وتندرج إشكالية الرسالة في السؤال الرئيس الآتي: هل ساهمت آليات حماية حقوق الانسان بالحد من الانتهاكات الجسيمة لحقوق الانسان على المستوى الدولي؟ تم اعتماد المنهج الوصفي التحليلي من خلال تقسيم الدراسة إلى فصلين، وهما: الفصل الأول، ويبحث في "ماهية حماية حقوق الإنسان"، حيث خصص لتوضيح مفهوم حماية حقوق الإنسان، ودور منظمة الأمم المتحدة في حماية حقوق الإنسان. وتناول الفصل الثاني: "آليات حماية حقوق الإنسان على المستوى الدولي"، وخصص للبحث في تطور آليات حماية حقوق الإنسان في الاتفاقيات الدولية. وخلصت الدراسة إلى مجموعة من النتائج أبرزها: 1) وجود آليات دولية فعّالة لحماية حقوق الإنسان، لكنها تقف عاجزة عن مساءلة ومحاسبة مرتكبي الجرائم الخطيرة بحق أبناء الشعب الفلسطيني. 2) إنّ العمل على تدعيم آليات العدالة الدولية لمساءلة ومحاسبة منتهكي الجرائم الخطيرة يعني الحد من إفلات المجرمين من العقاب. وتوصي الدراسة بأنه من المهم عند تنفيذ آليات حقوق الإنسان أن يؤخذ بعين الاعتبار الحيادية، إذ ما نشهده اليوم عند تطبيق آليات حقوق الإنسان ينحاز إلى فئة دون أخرى. ومن المهم والضروري أن لا تبقى مؤسسات وأجهزة الأمم المتحدة وجامعة الدول العربية قائمة على الاستنكار والشجب فيما يتعلق بالجرائم المرتكبة بحق الشعب الفلسطيني، وعليها أن تتخذ موقفا حاسما وقوبا تجاه العمل على تنفيذ آليات حماية حقوق الإنسان وصولا للعدالة الدولية في مساءلة وملاحقة مرتكبي الجرائم الدولية. | ar |
| dc.description.abstract | The current study aims at examining the contractual and non-contractual mechanisms of protecting human rights at the international level in terms of analyzing legal texts and examining the mechanisms of accountability for violating Palestinian human rights. The problem statement of the study lies in the following main question: Have human rights protection mechanisms contributed to reducing gross human rights violations at the international level? The study used the descriptive analytical approach through dividing the study into two chapters: The first chapter examines the nature of human rights protection, which is devoted to clarifying the concept of human rights protection and the role of the United Nations in protecting human rights. The second chapter deals with the mechanisms for protecting human rights at the international level; it traces development of mechanisms of protecting human rights in international agreements. The study concluded with a set of results, most notably: (1) There are effective international mechanisms to protect human rights, but they are incapable of holding perpetrators of serious crimes against the Palestinian people. (2) Strengthening mechanisms of international justice to hold perpetrators of serious crimes accountable means reducing the impunity of criminals. In light of these findings, the study recommends in taking into account neutrality when implementing human rights mechanisms, as what we witness today when implementing human rights mechanisms is clearly bias to one group at the expense of another. Also, it is important for the institutions and agencies of the United Nations and the League of Arab States not to just be satisfied with condemning the crimes committed against the Palestinian people; they must take a decisive and strong stance towards working to implement mechanisms for protecting human rights to achieve international justice in holding accountable and prosecuting perpetrators of international crimes. | en |
