| dc.description.abstract | لا شك أن هدف المشتري أو المستهلك هو الإنتفاع بالمبيع بشكل كامل وآمن لأطول مدة ممكنة لتحقيق الغرض المرجو منه، ويعتبر الإلتزام بصيانة المبيع وإصلاحه من أكثر الوسائل فاعلية في تحقيق رضا المشتري او المستهلك، فإذا حدث خلل او عيب في الشيء المبيع يلتزم البائع او المُنتج بإصلاحه وصيانته، وهذا ما دفع بالتجار والبائعين إلى إدراج هذا الالتزام ضمن عقد البيع أو ضمن وثيقة ملحقة لهذا العقد وتسمى بوثيقة الضمان. وقد تم النص على هذا الإلتزام بشكل صريح في قانون حماية المستهلك الفلسطيني رقم 21 لسنة 2005، وتم النص على شرط ضمان صلاحية المبيع للعمل مدة معينة الذي يعد الإلتزام بالصيانة أحد أبرز تطبيقاته العملية في كل من القانون المدني المصري ومشروع القانون المدني الفلسطيني، أما مجلة الأحكام العدلية والقانون المدني الاردني فلم ينص أي منهما على الالتزام بالصيانة أو الضمان الاتفاقي، مما يستدعي بنا إلى معالجة هذا الامر وإكتشاف الرقعة القانونية لسد هذه الثغرة. فتناولت هذه الدراسة موضوع الالتزام بالصيانة في عقد البيع، ومن أهم النتائج التي توصلت إليها هذه الدراسة أن الالتزام بالصيانة في عقد البيع هو التزام عقدي يخضع لارادة المتعاقدين، وبالتالي فهو صورة من صور الضمان الاتفاقي او التعاقدي الذي يتفق فيه الاطراف على التزام البائع باصلاح الشيء المبيع وصيانته طوال فترة الضمان اذا ماطرىء عليه خلل او عيب مصنعي، وعليه فهو يخضع للقواعد العامة في الالتزامات التعاقدية المنصوص عليها في القوانين المدنية. | ar |

| dc.title | There is no doubt that the goal of the buyer or consumer is to benefit from the sales completely and safely for the longest possible period to achieve its intended purpose. Commitment to maintenance and repair of the sale is one of the most effective means of achieving buyer or consumer satisfaction. Therefore, any defect occurs in the sold thing, the seller or producer is obligated to repair and maintain it. This is what prompted merchants and sellers to include this obligation in the sales contract or in a document attached to this contract called the guarantee document. Guarantee obligation has been expressly stipulated in the Palestinian Consumer Protection Law number 21, year 2001. The guarantee condition was stipulated validity of the sale for a certain period of time, the commitment to maintenance is one of its most important practical applications in both the Egyptian Civil Law and the Palestinian Civil Law Draft. As for the Law of Judicial Judgments and the Jordanian Civil Law, neither of them stipulates a commitment to maintenance or guarantee agreement, which leads us to address this matter and discover the legal patch to fill this gap. This study dealt with the issue of the commitment to maintenance in the sales contract. The most important finding of this study is that the obligation of maintenance in the sales contract is a contractual obligation that is subject to the will of the contracting parties. Therefore, it is a form of the agreement guarantee or contractual guarantee, in which the parties agree on the seller’s obligation to repair and maintain the thing sold throughout the warranty period if it has a manufacturing defect. Accordingly, it is subject to the general rules of contractual obligations stipulated in civil laws. | en |
