Abstract
تهدف الدراسة إلى التعرف على الدور المهم للجنة الدولية للصليب الأحمر، وذلك من خلال دراسة معمقة للاتفاقيات والمواثيق الدولية التي منحت اللجنة الحصانة في أداء مهامها والتعرف على إختصاصات ومهاماللجنة الدولية للصليب الأحمر أثناء فترة النزاعات المسلحة، والإحاطة بالآثار المترتبة على قيام اللجنة الدولية للصليب الأحمر بدورها على تطبيق قواعد القانون الدولي الإنساني ومناقشة الإشكاليات والقصور في جهود اللجنة الدولية للصليب الأحمر، ومن خلال اتباع المنهج الوصفي التحليليسعت الدراسة إلى معالجة الإشكالية التالية: ما هي معوقات عمل اللجنة الدولية للصليب الأحمر في عدوان غزة عام 2023؟
لقد خلصت الدراسة إلى عدد من النتائح الرئيسية تتمثل في أناللجنة الدولية للصليب الأحمر تعتبر أحد المنظمات غير الحكومية التي يسند اليها الحفاظ على القانون الدولي الإنساني، والحيلولة دون الانتهاكات التي يتعرض لها الانسان والدول، كما وجاء النظام الأساسي للجنة الدولية للصليب الأحمر قاصراً عن مواجهة التحديات التي تتعرض لها اللجنة في ممارسة مهامها، كما أن دور اللجنة الدولية للصليب الأحمر يقتصر على العمل على التحذير دون أن يمتد إلى وقف الانتهاكات، ولم تعطِاتفاقيات جنيف الأربع لعام 1949 وبروتوكولاتها الملحقه بها لعام 1977 الصلاحيات الكافية للجنة الدولية للصليب الأحمر في وقف الانتهاكات المرتبطة بحقوق الانسان.
كما توصلت الدراسة إلى ضرورة تعديل اتفاقيات جنيف الأربع لعام 1949 وبروتوكولاتها الملحقه بها لعام 1977 وذلك ببلورة الصلاحيات الحصرية للجنة الدولية للصليب الأحمر ومنظمات الإغاثة بصفة عامة وضرورة تعديل النظام الأساسي للجنة الدولية للصليب الأحمر بما يزيد قدراتها على التصدي للتحديات التي تواجهها، وتعزيز وجود اللجنة الدولية للصليب الأحمر في الأقاليم المحتلة ميدانياًوعلى اللجنة الدولية أن تقوم بتعزيز وجودها وتوسيع نشاطها وتكثيف انتشارها ميدانياً في كافة أنحاء الأراضي المحتلة في فلسطين على وجه التحديد لحماية المدنيين وتقديم المساعدات الإنسانية والطبية الطارئة لهم خصوصاً في ظل حقيقة مؤداها أن الاجراءات التعسفية لدولة الاحتلال الاسرائيلية تؤدي بشكل ملحوظ إلى تدهور ظروف المعيشة اليومية لهؤلاء المدنيين من ناحية ومن ناحية أخرى لمراقبة ما تقترفه قوات الاحتلال من جرائم بحق المدنيين العزل وما ينقل بشكل يومي من صور مروعة في فلسطين .
This study aimed to identify the important role of the International Committee of the Red Cross, through an in-depth study of the international agreements and charters that granted the Committee immunity in performing its tasks. To identify the powers and tasks of the International Committee of the Red Cross during the period of armed conflicts, and to take note of the implications of the establishment of the International Committee of the Red Cross. In turn, to apply the rules of international humanitarian law and discuss the problems and shortcomings in the efforts of the International Committee of the Red Cross, By following the descriptive and analytical approach, the study sought to address the following problem: To what extent did the intervention of the International Committee of the Red Cross protect the rights and freedoms guaranteed to citizens during the period of the international armed conflict taking place in the Gaza Strip? The study concluded with a number of main results, namely that the International Committee of the Red Cross is considered one of the non-governmental organizations entrusted with preserving international humanitarian law and preventing violations to which people and countries are exposed. The statute of the International Committee of the Red Cross also falls short of confronting the challenges that it faces. to which the Committee is exposed in the exercise of its duties,Also, the role of the International Committee of the Red Cross is limited to working to warn without extending to stopping violations, and the four Geneva Conventions of 1949 and the two protocols attached to them of 1977 did not give the International Committee of the Red Cross sufficient powers to stop violations related to human rights. The study also concluded that it is necessary to amend the four Geneva Conventions of 1949 and the two annexed Protocols of 1977 by crystallizing the exclusive powers of the International Committee of the Red Cross and relief organizations in general. The necessity of amending the statute of the International Committee of the Red Cross in a way that increases its capabilities to address the challenges it faces.Strengthening the presence of the International Committee of the Red Cross in the occupied territories on the ground. The International Committee must strengthen its presence, expand its activity, and intensify its deployment on the ground in all parts of the occupied territories in Palestine, specifically to protect civilians and provide emergency humanitarian and medical assistance to them, especially in light of the fact that the arbitrary measures of the occupying state IsraeliIt leads significantly to the deterioration of the daily living conditions of these civilians on the one hand, and on the other hand to monitor the crimes committed by the disturbance forces against defenseless civilians and the horrific images transmitted on a daily basis in Palestine.
