| dc.description.abstract | The industrial designs and drawings are considered the results and creations of the human brain, including the innovations in the form of goods and products, and are moral rights that represent a financial value that deserves to be protected as the rest of the rights of the industrial property. As a result of the industrial designs and drawing being factors of the industrial property, It gives its owner an exclusive right to face everyone as well as giving him the right of exploitation and the right to prevent anyone from cloning or using without the permission of the original creator, however this kind of protection is not given to the industrial designs and drawings unless they are officially registered in the competent departments according to the laws of each country. This essay will discuss the subject of legal regulations for the industrial designs and drawings in Palestine in a comparative study between the Jordanian, the Egyptian legislation and the Palestinian industrial property draft law of 2012, whereas this study came in light of the efforts of the Palestinian National Authority to develop the Palestinian intellectual property laws and join the international treaties. In the first chapter, the study has touched upon the features of the industrial designs and drawing legal system by explaining the concept of industrial designs and drawings, as well as the formal conditions for obtaining protection. For the second chapter, the study has dealt with the elements of the legal protection of the industrial designs and drawings, at the domestic and international levels. After that, the researcher has presented the results and recommendations that would amend the Jordanian patent and design law of 1953 applied in the Palestinian territories. The researcher also suggested some recommendations for the texts and articles of the Palestinian Industrial Property Law Project of 2012. | en |
