dc.description.abstractتُعَدّ ظاهرة الفساد من أخطر التحديات التي تواجه المجتمعات المعاصرة، لما تمثله من تهديد مباشر لمبادئ العدالة والمساواة وحقوق الإنسان، وفي السياق الفلسطيني حيث تتسم البيئة السياسية والمؤسسية بقدرٍ من “اللادولانية” وضعف البنية القانونية الموحدة، يبرز الدور المحوري لمنظمات حقوق الإنسان الوطنية في التصدي لمظاهر الفساد وتعزيز منظومة النزاهة والشفافية. تكمن مشكلة الدراسة في بيان حقيقة الدور الذي تضطلع به المنظمات الحقوقية في تعزيز وترسيخ ثقافة حقوق الإنسان، ومدى فاعليتها في مواجهة الفساد المؤسسي، مع الوقوف على الآليات المعتمدة في أداء هذا الدور، والتحديات التي تواجهها في بيئة تتسم بالتعقيد السياسي والمؤسسي. وتهدف الدراسة إلى تحليل العلاقة بين مكافحة الفساد وحقوق الإنسان في السياق الفلسطيني، عبر دراسة الأطر التشريعية الوطنية، واستكشاف طبيعة التفاعل بين منظمات المجتمع المدني والهيئة المستقلة لحقوق الإنسان في تعزيز قيم النزاهة وحماية الحقوق الأساسية. كما تهدف إلى فهم الإشكاليات المترتبة على ازدواجية الصلاحيات وضعف سيادة القانون في هذا السياق. واعتمدت الدراسة على المنهج الوصفي والتحليلي لتوصيف الدور المؤسسي للمنظمات الحقوقية وآليات عملها، وعلى المنهجين الاستقرائي والاستنباطي في فحص المعطيات النظرية والعملية واستخلاص النتائج، بالإضافة إلى المنهج المقارن لمقارنة التجربة الفلسطينية بتجارب دولية مماثلة. وتكوّن مجتمع الدراسة من المؤسسات الوطنية العاملة في مجال حقوق الإنسان في فلسطين، بما في ذلك الفروع المحلية للمؤسسات الدولية، واختيرت عينة نوعية مكونة من خمس عشرة مقابلة معمقة. كشفت النتائج عن الدور الحيوي الذي تؤديه منظمات حقوق الإنسان الوطنية، وعلى رأسها الهيئة المستقلة، في ترسيخ مبادئ الشفافية وتعزيز المساءلة من خلال المتابعة القانونية، وبرامج التوعية، والمراقبة الدورية لأداء المؤسسات العامة. كما بينت الدراسة أن التحديات الرئيسة أمام مكافحة الفساد في فلسطين تتمثل في غياب سيادة القانون، وضعف استقلال السلطة القضائية، وتداخل الصلاحيات بين المؤسسات، مما يعيق تحقيق التكامل بين حماية الحقوق وإنفاذ القانون. وأظهرت النتائج أن العلاقة بين هيئة مكافحة الفساد والمنظمات الحقوقية تتسم أحيانًا بالتوتر بسبب تباين الأولويات، وأن التشريعات القائمة رغم أهميتها لا تزال تعاني من قصور في التطبيق، ساهمت هذه الدراسة في توضيح الصلة الجوهرية بين مكافحة الفساد وتعزيز حقوق الإنسان في السياق الفلسطيني، وأبرزت أن النجاح في أحد المجالين مرهون بالتكامل والتنسيق في الآخر. ar
dc.description.abstractThe phenomenon of corruption is considered one of the most serious challenges facing contemporary societies, as it poses a direct threat to the principles of justice, equality, and human rights. In the Palestinian context—characterized by a degree of “statelessness” and a weak, fragmented legal framework—the pivotal role of national human rights organizations emerges in confronting manifestations of corruption and promoting integrity and transparency. The problem addressed in this study lies in examining the actual role undertaken by human rights organizations in promoting and consolidating a culture of human rights, and in assessing their effectiveness in combating institutional corruption. It further explores the mechanisms employed in fulfilling this role and the challenges faced within a politically and institutionally complex environment. The study aims to analyze the relationship between anti-corruption efforts and human rights protection in the Palestinian context by examining national legislative frameworks and exploring the interaction between civil society organizations and the Independent Commission for Human Rights (ICHR) in fostering integrity and safeguarding fundamental rights. It also seeks to understand the issues arising from overlapping jurisdictions and the weakness of the rule of law in this setting. Methodologically, the study adopts a descriptive and analytical approach to delineate the institutional role and operational mechanisms of human rights organizations. It also employs inductive and deductive methods to examine theoretical and empirical data and derive conclusions, as well as a comparative approach to contrast the Palestinian experience with similar international cases. The study population consists of national institutions working in the field of human rights in Palestine, including local branches of international organizations. A purposive sample of fifteen in-depth interviews was selected. The findings reveal the vital role played by national human rights organizations—foremost the Independent Commission for Human Rights—in consolidating transparency principles and promoting accountability through legal follow-up, awareness programs, and regular monitoring of public institutions’ performance. The study also indicates that the main challenges to combating corruption in Palestine include the absence of the rule of law, weak judicial independence, and overlapping institutional mandates, all of which hinder the integration of human rights protection and law enforcement. Moreover, the results show that the relationship between the Anti-Corruption Commission and human rights organizations is at times characterized by tension due to differing priorities, and that existing legislation, despite its significance, still suffers from implementation deficiencies. This study contributes to clarifying the intrinsic link between combating corruption and promoting human rights in the Palestinian context, highlighting that success in one domain is contingent upon coordination and complementarity in the other.en
