| dc.description.abstract | عالجت هذه الدراسة مسألة خصوصية المسؤولية المدنية عن الضرر البيئي في فلسطين، في ظل القوانين الناظمة لأحكام المسؤولية المدنية، والمتمثلة في قانون المخالفات المدنية رقم (36) لسنة 1944م وتعديلاته لسنة 1947م، ومجلة الأحكام العدلية، والتشريعات الخاصة ذات العلاقة بحماية البيئة، سواء الهوائية أم المائية أم التربة، وعلى رأسها قانون البيئة الفلسطيني رقم (7) لسنة 1999م. هدفت الدراسة إلى تحقيق أكبر حماية ممكنة للمتضرر من الأضرار البيئية، والتعرف إلى مفهوم علاقة السببية بين الخطأ والضرر وسبل إثباتها لقيام المسؤولية المدنية، مع توضيح أحكام التعويض عن الضرر البيئي، وبيان مدى أهمية إيجاد تنظيم قانوني خاص بالمسؤولية المدنية عن الأضرار البيئية وما تخلفه من انعكاسات سلبية على الأفراد والدول. وانطلقت الدراسة من فرضية مفادها أن التشريعات ذات العلاقة بالبيئة لم تعالج هذا الموضوع بالقدر الكافي، مما يجعل المتضرر بيئياً يلجأ إلى تطبيق القواعد العامة في المسؤولية المدنية عن الفعل الضار للحصول على التعويض عن هذه الأضرار. وتوصلت الدراسة إلى أن خصوصية الضرر البيئي تحدّ من إمكانية تطبيق الأسس التقليدية للمسؤولية المدنية، الأمر الذي أدى إلى ضرورة البحث عن قواعد مستحدثة للمسؤولية المدنية. ونتيجة لذلك، تم تبني أحكام المسؤولية الموضوعية في العديد من المجالات، ومنها مجال التعويض عن الأضرار البيئية، على أساس تحقق الضرر دون الحاجة إلى إثبات الخطأ. كما أكدت الدراسة ضرورة تحديث الأحكام العامة للمسؤولية المدنية بما يتناسب مع خصوصية الأضرار البيئية المستجدة، وصولاً إلى بناء نظام قانوني يمكن بمقتضاه مساءلة المتسبب بالأضرار البيئية وإلزامه بتعويض المتضرر عن الأضرار التي لحقت به، سواء كانت مادية أم معنوية. الكلمات المفتاحية: الضرر البيئي، المسؤولية المدنية، التعويض، قواعد المسؤولية المدنية. | ar |
| dc.description.abstract | This study examines the specificity of civil liability for environmental damage in Palestine under the legal framework governing civil liability, including the Civil Wrongs Ordinance No. 36 of 1944 and its amendments of 1947, the Majalla (Journal of Judicial Rulings), and the special legislation related to environmental protection, particularly the Palestinian Environmental Law No. 7 of 1999. The study aims to provide the highest possible level of protection for individuals harmed by environmental damage by examining the concept of the causal relationship between fault and damage and the methods of proving it for the establishment of civil liability. It also analyzes the provisions governing compensation for environmental damage and highlights the importance of creating a special legal framework for civil liability arising from environmental harm and its negative impacts on individuals and society. The study argues that existing environmental legislation has not adequately addressed this issue, forcing victims of environmental damage to rely on the general rules of civil liability for wrongful acts in order to obtain compensation. Therefore, there is a need to update and develop the traditional rules of civil liability to accommodate the unique characteristics of environmental damage and to establish an effective legal system capable of holding polluters accountable and requiring them to compensate victims for both material and moral damages. The study concludes that the distinctive nature of environmental damage limits the effectiveness of traditional civil liability principles and necessitates the adoption of modern liability rules. Consequently, strict liability has become increasingly recognized in the field of environmental damage compensation, allowing liability to be established without the need to prove fault.
