Abstract
بِالْعَدَالَةِ يَسُودُ اَلْمَلِكُ وَتَسْمُو اَلْأُمَمُ، وَمِنْ وَسَائِلِ تَحْقِيقِهَا اَلْحُصُولِ عَلَى أَدِلَّةِ اَلِْْثْبَاتِ فِي اَلْمَادَّةِ ا لجَ اَ زئِيَّةِ
بِوَسَائِلَ شَرْعِيَّةٍّ لَا تُغَالِطُ اَلشُّعُورَ اَلْبَشَرِيَّ، وَمِنْهَا وَسَائِلُ اَلِْْ ثْبَاتِ اَلْعِلْمِيِّ اَلْحَدِيثَةِ اَلَّتِي يَسْتَخْدِمُهَا مَأْمُورُو
اَلضَّبْطِ اَلْقَضَائِيِّ في مَرْحَلَةِ اَلْبَحْثِ وَالتَّحَرِّي لِلْوُصُولِ لِلْجُنَاةِ وَتَقْدِيمَهُمْ لِلْعَدَالَةِ وَقَدْ لَاقَتْ اَلْوَسَائِلُ اَلْحَدِيثَةُ
اَلْكَثِيرَ مِنْ اَل تَّأْيِيدِ وَالْمُعَارَضَة؛ مِمَّا يُعْطِي اَلْمَوْضُوعُ أَهَمِّيَّةَ كَوْنِهِ مَحَلَّ جَدَلٍّ وَنِ ق اشٍّ مُسْتَمِر، وَلِذَا فَقَدْ تَمَثَّلَ
هَدَفُ اَلْ د ا رسةِ حَوْلَ مَعْرِفَةِ تَأْثِيرِ اِسْتِخْدَامِ اَلتِّقْنِيَّاتِ اَلْحَدِيثَةِ فِي اَلْبَحْثِ اَلْجِنَائِ ي عَلَى اَلْعَدَالَةِ اَلْجِنَائِيَّةِ مِنْ
وُجْهَةِ نَظَرِ اَلْقَضَاءِ وَالنِّيَابَةِ اَلْعَامَّ ةِ ، مِنْ خِلََلِ اَلتَّعَرُّفِ عَلَى مَاهِيَّةِ اَل تّقْنِيَّاتِ اَلْحَدِيثَةِ، وَمَا اَلْأَنْوَاعَ اَلْمُسْتَخْدَمَةِ
فِي اَلْبَحْثِ اَلْجِنَائِيِّ مَا بَيْ ن تِقْنِيَّاتٍّ مُسْتَحْدَثَةٍّ وَأُخْرَى تَقْلِيدِيَّة، وَكَيْفَ أَسْهَمَتْ فِي سَيْرِ عَمَلِيَّا ت اَلْبَحْثِ اَلَّتِي
تَقُومُ بِهَا اَلنِّيَابَةُ ا لعَامَّةُ لِلْوُصُولِ إِلَى اَلِاقْتِنَاعِ اَلْقَضَائِيِّ فِي اَلْمَحْكَمَةِ، وَلِذَا طَرَحَ اَلتَّسَاؤُلُ اَلرَّئِيسُ حَوْلَ مَا
تَأْثِيرُ اِسْتِخْدَامِ اَلتِّقْنِيَّاتِ اَلْحَدِيثَةِ فِي اَلْبَحْثِ ا لجِ نائِيِّ عَلَى اَلْعَدَالَةِ اَلْجِنَائِيَّةِ؟ وَ لِلِْْجَابَةِ عَلَيْهِ تَمَّ اَلْبَحْثُ
بِاسْتِخْدَامِ اَلْمَنْهَجَيْنِ اَلْكَمِّيِّ وَالنَّوْعِيِّ مِنْ خِلََ لِ تَوْظِيفِ أَدَوَاتِ اَلِاسْتِبْيَانِ وَالْمُقَابَلَةِ لِلْحُصُولِ عَلَى
اَلْمَعْلُومَات، فَالِا سْتِبْيَانُ صُمِّمَ لِلتَّعَرُّفِ عَلَى عَيِّنَةِ اَلدِّ اَ رسَةِ فَقَدْ قُسِّمَتْ إِلَى جُزْئِيَّيْنِ: اَلْأَوَّلَ اَلَّذِي يَحْتَوِي عَلَى
اَلْبَيَانَاتِ اَلدِّيمُغْ اَ رفِيَّةِ وَالثَّانِي عَلَى مَحَاوِرَ وَفِقْ اَ رتِ اَلدِّ اَ رسَةِ . وَبَلَغَ عَدَدُ عَيِّ نةِ اَلدِّ اَ رسَةِ ) 50 ( فَرْدًا، اِسْتَجَابَ ) 43 ( مِ نْهُمْ بِشَكْلٍّ مُلْتَزِمٍّ تَمَّ اِعْتِمَادُهُمْ بِالْعَيِّنَةِ اَلْقَصْ ديَّةِ، وَتَمَّ
تَحْلِيلُ إِجَابَ اتِهِمْ فِي خِلََلِ اِسْتِخْدَامِ بَرْنَامَجِ اَلرِّزَمِ اَلِْْحْصَائِيَّةِ ( SPSS ) لِمُعَالَجَتِهَ ا وَالتَّوَصُّلِ إِلَى اَلنَّتَائِجِ
اَلْمُتَوَقَّعَ ةِ، كَمَا تَمَّ إِجْ اَ رءَ اَلْمُقَابَلََتِ مَعَ اَلسَّادَةِ اَلْقُضَ اةِ ذَلِكَ لِلتَّأْكِيدِ عَلَى نَتَائِجَ اَلدِّ اَ رسِيَّةِ وَاَلَّتِي كَانَ أَبْرَزُهَا
أَنَّ اِسْتِخْدَامَ اَلضَّابِطَةِ اَلْقَضَائِيَّةِ لِلتِّقْنِيَّاتِ اَلْحَدِيثَةِ مِنْ وُجْهَةِ نَظَرِ اَلنِّيَابَةِ اَلْعَامَّةِ وَالْقَضَاءِ جَاءَتْ بِدَرَجَةٍّ
مُرْتَفِعَةٍّ بِثِقَةٍّ عَالِيَةٍّ تَصِلُ إِلَى ) 77.6 %(، وَأَنَّ أَهَمَّ اَلْحُلُولِ تَطْوِيرَ اَلتَّشْرِيعَاتِ وَتَدْرِيبِ اَلْكَوَادِرِ مِنْ ا لعَ امِلِينَ
فِي اَلنِّيَابَةِ وَالْقَضَاءِ عَلَى اِ ستِخْدَامِ اَلتِّقْنِيَّاتِ اَلْحَدِيثَةِ مِنْ خِلََلِ تَوْفِيرِ بِنْيَةِ تِقْنِيَّةِ وَتَحْتِيَّةً مُتَطَ ورَةً تَسْتَطِيعُ
تَوْظِيفَ هَذِهِ اَلتِّكْنُولُوجْيَا بِشَكْلٍّ مَنْطِقِيٍّّ وَفَعَّالٍّ مِنْ خِ لَلِ اَلِْْشْ اَ رفِ عَلَيْهَا وَمُ اَ رقَبَةِ كُلٍّّ مِنْ يَتَعَامَلُ بِهَا،
وَأَوْصَتْ اَلدِّ اَ رسَةُ بِعَدَمِ اَلِْْخْلََلِ بِثِقَةِ اَلنِّيَابَةِ اَلْعَامَّةِ وَ لكِنْ أَيْضًا عَدَمُ اِنْتِهَاكِ حُقُوقِ اَلْمُتَّهَمِينَ فِي سَبِيلِ تَنْفِيذِ
أَوَامِرِهَا لأَنَّ هَذَا يُعْتَبَرُ اِعْتِدَاءٌ عَلَى اَلْأُسُسِ اَلَّتِي قَامَتْ عَلَيْهَا اَلْعَدَالَة اَلْجِنَائِيَّة، وَالْعَمَل عَلَى اَلْمُوَازَنَةِ مَا
بَيْنَ حَقِّ اَلدَّوْلَةِ وَحَقِّ اَلْمُتَّهَمِ .
With justice, kings rule, and nations prosper. One of the ways to achieve justice is through the collection of evidence in criminal matters by legitimate means that do not contradict human sensibility. Among these means are modern scientific techniques employed by judicial officers during the investigation and inquiry phase to identify criminals and bring them to justice. These modern techniques have received both support and opposition, making the subject a matter of con. Thus, the objective of this study is to understand the impact of using modern techniques in criminal investigations on criminal justice from the perspective of the judiciary and the public prosecution. This involves exploring the nature of modern techniques, identifying the types used in criminal investigations, whether newly developed or traditional, and how they have contributed to the processes carried out by the public prosecution to achieve judicial conviction in. The primary research question posed is: What is the impact of using modern techniques in criminal investigation on criminal justice? To an The study sample consisted of 50 individuals, of whom 43 provided consistent responses, and were included in the purposive sample. Their answers were analyzed using the Statistical Package for the Social Sciences (SPSS) to obtain the expected results. Additionally, interviews were conducted with judges to validate the study’s findings, the most prominent of which was that the use of modern techniques by judicial officers, from the perspective of the judiciary and the public prosecution, was rated highly effective with a confidence level of 77.6%. The study concluded that the most important solutions include developing legislation and training personnel in the judiciary and the public prosecution on using modern techniques by providing advanced technical and infrastructure resources. These resources should be employed logically and effectively under supervision and oversight. The study also emphasized that while maintaining the public prosecution's trust is essential, the rights of the accused must not be violated in the process, as this would undermine the principles upon which criminal justice is based.
