Abstract
ينظر لجريمة الإرهاب على أنها جريمة ذات بعد دولي وإقليمي، وأنها ظاهرة تاريخية عرفتها أغلب الحضارات والثقافات، ولا تأخذ شكلاً أو صورةً معينة نظراً لاختلاف الأُسلوب والوسيله، والتي فيها انتهاك لحقوق الإنسان والحريات والمبادئ القانونية.
بدأ الاهتمام الدولي بهذه الجريمة من عصبة الأُمم المتحدة بإقرار مشروع اتفاقية دولية لعام 1937، واستمرت في محاربة الإرهاب من خلال المعاهدات والاتفاقيات الدولية، وأجهزة الأمم المتحدة مثل مجلس الأمن وما صدر عنه من قرارات دعت إلى إنشاء لجان دولية تعنى بمكافحة الإرهاب.
وفيما يتعلق بمكافحة جريمة الإرهاب سواء في قانون العقوبات الأردني النافذ في الضفة الغربية، أو الاتفاقيات الدولية والإقليمية نجد بأنها جاءت بتدابير تمنع وقوع الجريمة، وتدابير علاجية بعد وقوع الجريمة، أي أنها تسعى إلى مكافحة هذه الجريمة من خلال الإجراءات الاستباقية قبل وقوعها
تسبب هذه الجريمة تهديداً للسلم والأمن الدوليين وأثاراً سلبية تشمل كافة مناحي الحياة، عنونت الدراسة بعنوان: " العدالة الجنائية ومكافحة الجريمة الإرهابية"، وقسمتها إلى فصلين: الفصل الأول بعنوان (قواعد العدالة الجنائية، وجريمة الإرهاب)، والفصل الثاني: (قواعد مكافحة جريمة الإرهاب).
وخلصت الدراسة إلى جملة من النتائج والتوصيات، ومن أبرز النتائج، أولاً: وجود خلط بين جريمة الإرهاب، وبعض الأعمال المشروعة المنصوص عليها في المواثيق والمعاهدات الدولية، ثانياً: عدم الاتفاق على تعريف محدد لهذه الجريمة. ومن أهم التوصيات، أولاً: ضرورة الاتفاق على تعريف محدد لجريمة الإرهاب، لأن ذلك من شأنه أن يساعد في تمييزه عن أي مصطلح مشابه له، ثانياً: الالتزام بما جاءت به الاتفاقيات والمعاهدات الدولية من تدابير خاصة بها.
وتم تقسيم الدراسة إلى فصلين، الفصل الأول: القواعد الموضوعية للعدالة الجنائية، وتم تقسيمه إلى مبحثين كالآتي: المبحث الأول: تناول ماهية العدالة الجنائية، أما المبحث الثاني: يتعلق بجريمة الإرهاب وأركانها، وجاء في الفصل الثاني تحت عنوان قواعد مكافحة الجريمة الإرهابية، وتم تقسيمه إلى مبحثين وهما: المبحث الأول: قواعد تجريم جريمة الإرهاب، والمبحث الثاني: إجراءات الملاحقة الجنائية في الجرائم الإرهابية.
As The crime of terrorism is seen an international and regional crime, and a historical phenomenon was known for most civilizations and cultures. It doesn't take a certain form or image due to the different styles and methods, which include violation of human rights, freedoms and legal principles. The international attention began with this crime from the League of United Nations by stating draft international agreement in 1937, and continued in fighting terrorism through international treaties and agreements and United Nations assemblies as Security Council that stated decisions to set up international committees care of fighting terrorism. This crime causes a threat to international peace and security also negative effects involve all aspects of life, I titled the study " Criminal Justice and Combating terrorist crime". I divided it into two sections : The first section is ( Criminal justice rules, and The crime of terrorism). The second section is ( Rules for combating the crime of terrorism). The study concluded a set of results and recommendations. The most prominent results. Firstly, there is confusion between the crime of terrorism and some legitimate and stipulated actions in international conventions and treaties. Secondly, There is no agreement for a certain definition for this crime. The most important recommendations. Firstly, The necessity of agreement on an exact definition of the crime of terrorism because this will help it stand out from any other similar term. Secondly, The commitment with the special measures of international agreements and treaties. The study have been divided into two sections, the first section: The Objective rules of criminal justice. And it has been divided into two topics: The first topic: What is the criminal justice? The second topic: The crime of terrorism and its elements, in the second section under the title "Rules for combating terrorist crime", and it has been divided into two topics which are they: The first: Rules of criminalizing the crime of terrorism. The second: "Procedures for prosecuting terrorist crimes in criminal offences.
