Abstract
يعد تسجيل الأراضي مكونًا أساسيًا لحيازة الأراضي الآمنة والتنمية الاقتصادية والاستقرار في الضفة الغربية. ومع ذلك، وعلى الرغم من الإطار النظري المحدد، فإن التنفيذ العملي لتسجيل الأراضي يواجه تحديات عديدة، ومن هذا المنطلق، يتطرق هذا البحث إلى تعقيدات تسجيل الأراضي في الضفة الغربية، ويهدف إلى تحديد وتحليل واقتراح حلول للمشاكل متعددة الأوجه التي تعيق فعاليته.
تناولت هذه الدراسة موضوع إشكالات التسجيل الجديد في الضفة الغربية بين النظرية والتطبيق، وهدفت إلى تسليط الضوء بقدر أكبر على الإشكالات التي تتعلق بكيفيةتسجيل الأراضي الموجودة في مناطق الضفة الغربية، وقد قسمت الدراسة إلى فصلين: فبينما يتناول الفصل الأولأثرالتسجيلالجديدعلىالحقوقالمرتبطةبالملكيةالعقارية ، تناول الفصل الثاني إجراءات التسجيل الجديد، وبناءا على ما تقدم، تتمثل مشكلة الدراسة في الاتي: دراسة التحديات والاختلافات التي تنشأ في نظام التسجيل الجديد للأراضي في الضفة الغربية عند مقارنة الإطار النظري بتطبيقه العملي.
تعتمد هذه الدراسة في تحقيق أهدافها المرجوة عبر استخدام لفته من المناهج العلمية، فقد جرى استخدام المنهج الوصفي التحليلي، وذلك من خلال التطرق إلى ماهية التسجيل الجديد ومحاولة تعريفه وتوضيح الإجراءات اللازمة للتسجيل الجديد ومن ثم سيقوم المنهج التحليلي بالنظر إلى الإطار القانوني الذي يقع التسجيل الجديد ضمنه والتطرق إلى نصوص القوانين الصادرة الخاصة بالتسجيل الجديد.تظهر النتائج أن هناك عدد من المشكلات تهدد تسجيل الأراضي في الضفة الغربية، من بينها الالتباساتالقانونية وهياكل ملكية معقدة وعجز إداري وواقع سياسي يقوض مبادئ تسجيل الأراضي، وتتفاقم هذه المشكلات بسبب العقبات المالية وطول الوقت المستغرق في العملية والصعوبات في الوصول إلى الدعم القانوني.
Land registration is a foundational component of secure land tenure, economic development, and stability in the West Bank. However, despite a well-defined theoretical framework, the practical implementation of land registration faces numerous challenges. This research delves into the complexities of land registration in the West Bank, aiming to identify, analyze, and propose solutions for the multifaceted problems that hinder its effectiveness. This study addressed the issue of the problems of new registration in the West Bank between theory and practice, and aimed to shed greater light on the problems related to how to transfer and register lands in the West Bank areas. The study was divided into two chapters: while the first chapter deals with the impact of the new registration on rights Related to real estate ownership, the second chapter was devoted to iron registration procedures, and based on the foregoing, the study problem is represented in the following: Studying the challenges and differences that arise in the new land registration system in the West Bank when comparing the theoretical framework with its practical application. This study relies on achieving its desired objectives through the use of a variety of scientific approaches. The analytical descriptive approach was used, by addressing what the renewed registration is and trying to define it and clarify the necessary procedures for the new registration. Then the analytical approach will look at the legal framework within which the new registration is located. Addressing the texts of the laws issued regarding the new registration. Our findings reveal a landscape where legal ambiguities, complex ownership structures, administrative inefficiencies, and political realities undermine the principles of land registration. These issues are exacerbated by financial barriers, a time-intensive process, and limited access to legal support. Additionally, cultural, gender-related, and environmental factors further complicate the registration landscape. To address these challenges, we propose a comprehensive set of recommendations. These include legal reforms to clarify existing laws, enhanced institutional capacity through training and technology, public awareness campaigns, conflict resolution mechanisms, and strengthening the role of international organizations in supporting registration efforts. Financial recommendations advocate for fee waivers, transparent fee structures, financial assistance programs, public-private partnerships, and international financial support. Duration-related recommendations focus on streamlined procedures, digitalization, capacity building, interagency collaboration, and performance monitoring. Ultimately, this research underscores the urgent need to bridge the gap between theoretical ideals and practical realities in land registration in the West Bank. By implementing these recommendations, we aim to pave the way for a more equitable, efficient, and transparent land registration system that empowers individuals, stimulates economic growth, and contributes to the overall development and stability of the region.
