Abstract
في إطار الدراسة التي هدفت إلى إظهار القيمة القانونية لقرارات مجلس الأمن الدولي الصادرة تجاه القضية الفلسطينية جرى البحث بدايةً في الإرادة الدولية بإيجاد تنظيم دولي لكافة القضايا من خلال المؤتمرات والمعاهدات الدولية وتبعها إنشاء عصبة الأمم وصولاً لهيئة الأمم المتحدة، وتناول البحث تأسيس هيئة الأمم المتحدة وأجهزتها الرئيسية، بالإضافة إلى أبرز القرارات الصادرة عن مجلس الأمن الدولي تجاه القضية الفلسطينية والتعقيب عليها ودراسة قيمتها القانونية ومدى الاستفادة منها.
فتمت الإشارة في الفصل الأول إلى تأسيس هيئة الأمم المتحدة وتعريف أجهزتها الرئيسية، بما فيها مجلس الأمن الدولي وتعريفه وتوضيح كيفية اتخاذ القرارات والتصويت عليها، كما تم توضيح المرجعية القانونية لاتخاذ القرارات ومدى إلزامية تطبيقها.
وفي الفصل الثاني تم ذكر أبرز قرارات مجلس الأمن الصادرة تجاه القضية الفلسطينية والتعليق عليها، وبيان الرؤية الدولية عبر مجلس الأمن فيما يتعلق بالقضية الفلسطينية، والتي ركزت جميعها على مطالبة إسرائيل بالانسحاب من الأراضي التي احتلتها عام 1967م بما فيها القدس الشرقية وأكدت على عدم شرعية الاستيطان وعدم قانونية كافة الإجراءات التي تتخذها الحكومة الإسرائيلية في القدس، إضافة إلى بيان أبرز مشاريع القرارات التي لم تقر بفعل الرفض الأمريكي بالفيتو وشرح تبعياتها، وفي المبحث الثاني شرحنا آليات تنفيذ قرارات مجلس الأمن الصادرة تجاه القضية الفلسطينية والاعتماد عليها كمرجع قانوني في ادارة الصراع الفلسطيني الإسرائيلي ومعوقات تنفيذها.
وخلصت الدراسة إلى نتائج وتوصيات حول ضرورة تعديل ميثاق الأمم المتحدة إضافة إلى الانحياز الأمريكي للمصلحة الإسرائيلية وبيان اجراءات يتوجب على الشعب الفلسطيني اتخاذها.
Within the framework of the legal status of the UN Security Council resolutions issued towards the Palestinian issue, the study aimed to show the legal value of these resolutions. The research was initially conducted in the international will to find an international organization for all issues through international conferences and treaties, followed by the establishment of the League of Nations, leading to the United Nations, and the research dealt with the establishment of the United Nations and its main organs, in addition to the most prominent resolutions issued by the UN Security Council regarding the Palestinian issue, commenting on it, studying its legal value and the extent to which it is used. In the first chapter, reference was made to the establishment of the United Nations, the definition of its main organs, including the Security Council, its definition, clarification of how decisions are taken and voting on them, and the legal reference for decision-making and the extent to which they are obligatory. In the second chapter, the most prominent Security Council resolutions issued towards the Palestinian issue were mentioned and commented on, and the international vision statement through the Security Council regarding the Palestinian issue, all of which focused on Israel’s demand to withdraw from the lands it occupied in 1967, including East Jerusalem. It emphasized the illegality of settlement and the illegality of all the measures taken by the Israeli government in Jerusalem, in addition to a statement of the most prominent draft resolutions that were not approved due to the American veto and explaining its consequences, And In the second topic, we explained the mechanisms for implementing Security Council resolutions issued regarding the Palestinian issue and relying on them as a legal reference in managing the Palestinian-Israeli conflict and the obstacles to their implementation. The study concluded with conclusions and recommendations about the necessity of reforming the United Nations Charter, the American bias towards the Israeli interest, and a statement of measures that the Palestinian people must take.
