Abstract
تهدف هذه الدراسة إلى حصر القواعد الفقهية الحاكمة في حق العودة والتعويض للاجئين الفلسطينيين، وتتناول الدراسة بيان المفاهيم والمصطلحات الخاصة بحق العودة والتعويض واللاجئين والقرارات الأممية في ذلك، ثم التأصيل الشرعي مرورا بالتكييف القانوني، ثم بحثت القواعد الفقهية ذات العلاقة بحق العودة، والتعويض، كالقواعد المتعلقة بالضرر، ومنها قاعدة الضرر يزال، والقواعد الكلية الخاصة بالحلال والحرام، ومنها قاعدة لا يجوز لأحد أن يأخذ مال أحد بلا سبب شرعي، وقواعد الضمان المتعلقة بالملكية ومنها الحق لا يسقط بالتقادم وختاما الحلول المطروحة على اللاجئين بديلا عن حق العودة والتعويض ومنها إعادة التوطين، وبيع أراضي فلسطين والتنازل عن حق العودة، واتبعت في هذه الدراسة المنهج الوصفي ببيان قضية اللاجئين ونشأتها، مستعينة بالمنهج التاريخي والاستقرائي.
وفي ختام الدراسة أدرجت الباحثة مجمل النتائج التي توصلت إليها، ومنها: أنّ حق العودة والتعويض هما حقان للاجئين الفلسطينين لا يجوز لأي فرد أو مؤسسة التنازل عنهما، ولا يقبل الشعب الفلسطيني الحكم الذاتي لأنه تنازل عن الأرض، ومخالف للشرع وفاقد للسيادة، ولا يقبل بحل الدولتين؛ لأنه اعتراف بالمغتصب ولا يقبل بالوطن البديل؛ لأنه مقابلة الإحسان بالإساءة وهو ضد ما أمر به الشرع، وكذلك ترفض الشريعة المبادئ التي قامت عليها صفقة القرن لأنها إضاعة للوطن بكل ما تحمله الكلمة من معنى مقابل فتات من المال.
The Abstract of Thepaper the jurisprudential rules governing the right of return and compensation This study aims to limit the jurisprudential rules governing the right of return and compensation for Palestinian refugees The study dealt with explaining the concepts and terminology related to the right of return, compensation, refugees, and UN resolutions in that regard. Then, legal existence, passing through legal adaptation, and then examined the jurisprudential rules related to the right of return and Compensation as the rules related to damage, including the rule that damage is eliminated, and the general rules related to what permissible and forbidden, including the rule that no one may take anyone’s money without a legitimate reason, and the rules of guarantee related to ownership, including the right not to be extinguished by statute of limitations. In conclusion, the researcher listed all the results she concluded, including the right of return and compensation on which no one or organization have the right to give up. In this study, I followed the descriptive approach, using the historical and inductive approach. At the conclusion of the study, the researcher listed the overall results she reached, including: Palestinian people don’t accept self-rule as it entails relinquishing their right full land, which contradicts the Islamic principles, and they reject the two-state idea as it constitutes recognition of the occupation .They also reject the concept of an alternative home land, as it seen as repaying kindness with offense and stands in direct contradiction to Islamic principles. Islamic law also rejects the principles upon which the Deal of the Century is based, as it entails sacrificing the home land in Exchange for Money.
