Abstract
تناولت الدراسة موضوع ضمان التَّعرض والاستحقاق والعيوب الخفيًّة وفق قانون حماية المستهلك، حيث هدفت الدراسة إلى التعرفِ إلى طبيعة التعرض والاستحقاق والعيوب الخفيَّة من خلال قوانين حماية المستهلك.
استخدمت الباحثة العديد من المناهج في دراستها منها: "المنهج الوصفي التحليلي"، الذي يعتمد على استنباط خصائص المشكلة، ثم تتبع طبيعتها وتحديد أسبابها، وذلك بهدفِ الوقوف على المسؤولية الواقعة على البائع "المزود" عن ضمان التعرض والاستحقاق والعيوب الخفيَّة، وذلك من خلال العديد من القوانين محل الدراسة ومنها "القانون الفلسطيني"، و"القانون الأردني، و "القانون المصري". كما اعتمدت الباحثة في دراستها على "المنهج المقارن"، والذي بدوره يعمل على المقارنة بين عدد من التنظيمات والتَّشريعات محل الدراسة، وهذه التشريعات هي "التًّشريع الفلسطيني"، "والتَّشريع الأردني"، والتَّشريع المصري"، ومدى ملائمة هذه التَّشريعات للتطورات العلمية والتكنولوجيَة والتقنيَّة المستحدثة بشكلٍ متسارع ومتطور.
وتوصلت الدراسة لعدد من النتائج منها؛ إنَّ حاجة المستهلك للوسائل الالكترونية في ظل التطور التكنولوجي والعلمي والذي بسببه أصبح من الضَّرورة الملحة مواكبة المستهلك لهذه التَّطورات، مما يجعل الحاجة أكبر لابتكار طرق مختلفة لحمايته من العيوب والغش. كذلك إنَّ ضمان الاستحقاق يشيرُ إلى قيام الغير بمنازعة المشتري على حقوقه سواء بشكل جزئي أو كلي مما يحرمه من هذه الحقوق. أيضا تطرقت العديد من قوانين حماية المستهلك إلى حق المستهلك في اللجوء إلى القضاء وإقامة الدعاوى المختلفة بسبب الضًّرر الذي لحق به نتيجة عيوب السلعة التي قام بشرائها.
وقد أوصت الباحثة بعدة توصيات وهي: حث المشرع الفلسطيني لمواكبة التَّطورات التَّقنية وإضافة العديد من البنود والمواد القانونية لقانون "حماية المستهلك" بسبب هذا التَّطور والتي يفتقر إليها القانون لتتماشى مع الوضع القائم. كذلك: توصي الباحثة المشرع الفلسطيني بالقيام بإضافة بعض البنود المتعلقة بموضوع تعويض المستهلك بسبب التَّطورات التي زادت من تعرضه للغش والخداع وغيرها.
This study addressed the topic of the guarantee of quiet possession, ownership, and latent defects according to consumer protection law. The study aimed to identify the nature of quiet possession, ownership, and latent defects through consumer protection laws. The researcher used several methodologies in her study, including: the "descriptive-analytical approach," which relies on deriving the characteristics of the problem, then tracing its nature and determining its causes, with the aim of determining the responsibility of the seller "the supplier" for the guarantee of quiet possession, ownership, and latent defects, through many of the laws under study, including the "Palestinian Law," the "Jordanian Law," and the "Egyptian Law." The researcher also relied in her study on the "comparative approach," which in turn works to compare a number of regulations and legislations under study, and these legislations are the "Palestinian Legislation," the "Jordanian Legislation," and the "Egyptian Legislation," and the extent to which these legislations are suitable for the scientific, technological and technical developments that are emerging in a rapidly evolving manner. The study reached a number of results, including: that the consumer's need for electronic means in light of technological and scientific development, which has made it imperative for the consumer to keep pace with these developments, which makes the need greater to develop different ways to protect him from defects and fraud. Also, the guarantee of ownership refers to a third party disputing the buyer's rights, whether partially or wholly, which deprives him of these rights. Also, many consumer protection laws addressed the consumer's right to resort to the judiciary and file various lawsuits due to the damage he suffered as a result of defects in the goods he purchased. The researcher recommended several recommendations, including: urging the Palestinian legislator to keep pace with technical developments and add many legal clauses and articles to the "Consumer Protection" law due to this development, which the law lacks to be in line with the current situation. Also: the researcher recommends that the Palestinian legislator add some clauses related to the issue of consumer compensation due to developments that have increased his exposure to fraud, deception, and others.
