Abstract
تُعد هذه الدراسة من اوائل الدراسات على المستوى المحلي، حيث تناقش جانباً مهماً يرتبط بالأضرار البيئية التي تكون الإدارة مسؤولة عنها وعن التخطيط لحلها، ووضع اليات لضبط تلك الاضرار وصولاً للتحقيق المهام الواجبة على الإدارة وهي حماية الامن العام والذي تعتبر البيئة وحمايتها وجمالها جزاء من هذه المهام التي تقع على عاتق الإدارة.
القت هذه الدراسة الضوء على الأساس القانوني لمسؤولية الإدارة عن مختلف الأضرار بالبيئة التي تؤثر على الوسط الحيوي الذي يعيش فيه الانسان وباقي الكائنات الحية، وتم عرض البعض من هذه الاضرار وحاولنا التوصل لحلها، وصولاً للتشريعات الفلسطينية البيئية التي تُحفز على حماية الحقوق البيئية، لكن الواقع مخالف وبعيد كل البُعد عن تلك التشريعات فتوجه العالم نحو التطور التكنولوجي والتنمية المستمرة التي أدت لنتائج وخيمة على عناصر البيئة، وتسببت في الاضرار البيئية التي أثرت على حق الانسان في بيئة نظيفة وسليمة.
ويظهر في الدراسة بأن الضرر البيئي يتميز بخصوصية كبيرة وعليه تتمثل اشكالية هذه الدراسة في تعريف الضرر البيئي ومخاطره وتحديد الأساس القانوني للمسؤولية الادارية البيئية، وما مدى كفاية التشريعات واليات الادارة في حماية البيئة.
وتتمتع الإدارة في مجال حماية البيئة بسلطات وامتيازات قانونية هامة، أبرزها آليات الضبط الإداري البيئي، التي تلعب دور فعالاً، في تقويم سلوك الأفراد وتقييد جزء من حرياتهم، وفق ما تقتضيه ضرورات التنمية وحماية مكونات البيئة ومختلف عناصرها، وعلى ذلك تثور مسؤوليتها عن الأضرار البيئية الحاصلة.
ولإنجاز هذا البحث تم الاتجاه للعمل بالمنهج الاستقرائي بالإضافة للمنهج التحليلي، فتم جمع المعلومات والدراسات بالاستعانة بالتشريعات الفلسطينية والتشريعات المقارنة الاخرى ومعالجتها بالنقد والتحليل، وتصميم استبيان خاص بالاضرار البيئية استهدف بشكل عام طلاب الجامعات وبشكل خاص كليات الحقوق.
خرجت الدراسة بنتائج ومنها التأكد بأن الضرر البيئي يتفاقم يوماً بعد يوم، وتأثيره لا يقتصر على البيئة وانما يؤثر على الإنسان بشكل مباشر كجزء من هذه البيئة.
This study is considered one of the first studies at the local level, as it discusses an important aspect related to the environmental damages for which the administration is responsible and for planning to solve them, and developing mechanisms to control these damages in order to achieve the duties required of the administration, which is to protect public security The public, in which the environment, its protection and its beauty are considered part of these tasks that fall upon the administration. This study shed light on the legal basis for the administration’s responsibility for various damages to the environment that affect the biological environment in which humans and other living organisms live. Some of these damages were presented and we tried to reach a solution to them, leading to Palestinian environmental legislation that stimulates the protection of environmental rightsBut the reality is different and far removed from these legislations. The world has moved towards technological development and continuous development, which has led to disastrous consequences for the elements of the environment, and has caused environmental damage that, has affected the human right to a clean and healthy environment.To accomplish this research, the inductive approach was used in addition to the analytical approach. Information and studies were collected using Palestinian legislation and other comparative legislation and treated with criticism and analysis. A questionnaire was designed specifically for environmental damage, targeting university students in general, and in particular, law schools.The study produced results including confirmation that environmental damage is worsening day after day.
