Abstract
تناولت هذه الدراسة موضوع التحكيم المؤسسي وهدفت الى تسليط الضوء على حالة مركز التحكيم التجاري في غرفة تجارة وصناعة محافظة الخليل وعلى قواعد التحكيم الصادرة عنه، حيث أن هذا المركز هو أول مركز تحكيم مؤسسي يتبع لغرفة تجارية في فلسطين، وهو تجربة جديدة تعكس سياسة الغرفة التجارية في جلب الاستثمار وتسوية النزاعات التجارية عبر نظام التحكيم المؤسسي، وتتجلى أهمية هذه الدراسة في توفير مرجع حول نظام التحكيم المؤسسي في فلسطين.
وتكمن إشكالية الدراسة في معرفة مدى فاعلية نظام مركز التحكيم التجاري لدى غرفة تجارة وصناعة محافظة الخليل كتحكيم مؤسسي في فض النزاعات التجارية من أجل استخلاص ضوابط لاقتراحها على المشرع الفلسطيني واقتراح التعديلات على لجنة إدارة المركز.
وإستخدمت الدراسة المنهج الوصفي التحليلي المقارن من خلال تحديد المفاهيم ذات الصلة بالموضوع والتطرق للقوانين واللوائح والأنظمة التحكيمية وتحليل النصوص المتعلقة بقواعد المركز وتم الاستعانة بقواعد بعض مراكز التحكيم الإقليمية والدولية.
وفي النهاية تم التوصل الى مجموعة من النتائج التي خلصت اليها الدراسة بعد تحليل النصوص القانونية لقواعد المركز ومقارنتها مع بعض مراكز التحكيم في دول العالم، ومن ثم أوصت الدراسة بتوصيات من شأنها المساهمة في تنظيم التحكيم المؤسسي في فلسطين وتحقيق أهداف المركز محل الدراسة وتطويره.
This study dealt with institutional arbitration, a case study of the Commercial Arbitration Center in the Hebron Governorate Chamber of Commerce and Industry. The importance of dealing with this topic is to study this type of arbitration, and the arbitration rules issued by the arbitration center under study were highlighted, as it is the first institutional arbitration center affiliated with a chamber of commerce in Palestine. A new experience reflects the policy of the Chamber of Commerce in attracting investment and settling commercial disputes through this system. The researcher adopted the descriptive and comparative analytical approach by identifying concepts related to the subject and addressing the laws, regulations and arbitration systems, analyzing texts related to the center’s rules and using the rules of some regional and international arbitration centers. In order to answer the problems and questions of the study, the researcher divided this study into two main chapters, paving the way for them with an introductory study in which he addresses the nature of institutional arbitration in two sections. Then, in the first chapter, the researcher discusses the administrative organization of the Commercial Arbitration Center at the Hebron Governorate Chamber of Commerce and Industry, through two sections. In the first section, the administrative bodies that make up the Center, then in the second section, he dealt with the arbitration panel by studying its formation and powers. In the second chapter of the study, the researcher dealt with the procedures for adversarial arbitration before the Center, through two sections. In the first section, he talked about the procedural and substantive law that must be applied from Through the study of the applicable procedural and substantive law and the rules applicable to the subject of the dispute, and then in the second section, he dealt with oversight of the arbitration award by studying the procedures for issuing the award and aspects of oversight over it.
