Abstract
جاءت هذه الدراسة لتلقي الضوء على النظر المصلحي في فقه السياسة الشرعية عند محمد نعيم ياسين رحمه الله تعالى، وهو من علماء فلسطين والعالم العربي، وكان له الكثير من الرؤى التي تناولت المصالح العامة للأمة من خلال القضايا المعاصرة والنوازل الفقهية المختلفة التي لم يكن لها وجود في السابق، وذلك بسبب التطورات التكنولوجية الحديثة من ناحية، وتطور الأزمان والتواصل مع الغرب والتعايش، كل هذه الظروف أسهمت في خلق رؤية لدى محمد نعيم ياسين فيما يتعلق بهذه النوازل ووضعها ضمن ميزان المصلحة ومقاصد الشرع الإسلامي الحنيف.
وتكمن أهمية الدراسة في كونها سعت إلى إلقاء الضوء على النظر المصلحي عند محمد نعيم ياسين في القضايا والنوازل الحديثة، وتتبع منهجه وبيان الطريقة التي نحاها في تأصيله للمسائل المختلفة التي ناقشها وأفتى فيها.
وخلصت الدراسة إلى نتائج أهمها أن محمد نعيم ياسين يرى أنّ المصلحة والمفسدة إنما تقاس بمقياس الشرع، فإذا لم تقاس بذلك لا تعد في باب المصلحة والمفسدة، وعند البحث في المسائل أن يتم تحديد المقصد الشرعي في المحل، إذ هناك الكثير من الحالات التي تختلط فيها المقاصد في الشيء الواحد، فقد يكون مقصدا واحدا أو اثنين أو ثلاثة أو أكثر من ذلك وبنسبة مختلفة، وأن يهتم الباحث في الكشف عن المصالح والمفاسد، وينبغي له الاستدلال بالكتاب والسنة، وأن لا يترك فيها مجالاً حتى يذهب إلى غيرها كالإجماع والقياس، فالاستدلال السريع لا يفي بالغرض إنما يجب أن يستفرغ جهده في كل طريق حتى يشعر بالعجز عن مزيد الطلب، وهو من الأمور الصعبة ولا قدرة فيها إلا لأصحاب الاجتهاد الشرعي.
كما أيد نزع أجهزة الإنعاش عن متوفي القلب، كذلك وافق على نقل الأعضاء ضمن ضوابط الشريعة، فيما وافق أيضا على حفظ الأجنة ضمن الضوابط المنصوص عليها، ويرى أنّ موت الدماغ يوافقه موت الإنسان إذا قال الطب بذلك، كونه الجهة التي لديها معرفة أكبر بالمصلحة الخاصة بالمريض.
This study aims to shed light on the pragmatic perspective in the jurisprudence of political affairs by Professor Dr. Mohammed Naeem Yassin (may God have mercy on him). He was a renowned scholar from Palestine and the Arab world who provided valuable insights into the public interests of the Muslim nation through contemporary issues and various jurisprudential challenges that did not exist in the past. This was due to technological advancements, changing times, communication with the West, and coexistence. All these circumstances contributed to the development of a unique vision by Professor Dr. Mohammed Naeem Yassin regarding these challenges, placing them within the framework of the interests and objectives of Islamic Sharia law. The significance of this study lies in its endeavor to shed light on the pragmatic approach of Professor Dr. Mohammed Naeem Yassin in modern issues and challenges, as well as to explore his methodology and elucidate the approach he adopted in establishing the foundations of the various issues he discussed and issued rulings on. The study concluded that the most important findings are that Muhammad Na'im Yasin believes that benefit and harm are to be measured by the standards of Sharia law. If they are not measured by that standard, they are not considered in the realm of benefit and harm. When examining issues, the researcher must determine the legal purpose in the matter, as there are many cases where the purposes are mixed in a single thing. There may be one, two, three, or more purposes with different proportions. The researcher must be concerned with uncovering the benefits and harms, and must provide evidence from the Quran and Sunnah, not leaving any room until resorting to other evidence like consensus and analogy. Rapid deduction is not sufficient, but rather the researcher must exhaust his efforts in every avenue until he feels incapable of further inquiry. This is a difficult matter that only those with expertise in Islamic jurisprudence can handle. He also supported the removal of life support from those who have died of cardiac death, as well as the transfer of organs within the controls of Sharia law. He also agreed to the preservation of embryos within the prescribed controls
