| dc.description.abstract | Execution of judicial rulings constitutes a basic support for justice, whether through forced or voluntary execution. Execution is considered the end that every litigant seeks, whether he is a person of private law or a person of public law, to resort to the court to take his right after the judgment without delay. Addressing the problem of seizure of public funds in the context of implementing judgments issued by Palestinian courts requires a lot of effort, given the importance of these funds in securing and ensuring the proper functioning of the public facility on the one hand, and the necessity of maintaining them for the sake of the continuity of the state and the preservation of what its sovereignty requires. On the other hand, the implementation of judicial rulings raised a number of questions from the legal and practical aspects, including on the issue of not being implemented at the required speed, as well as how to implement this ruling. Finding effective solutions in line with the preservation of legitimate rights and freedoms. What each litigant aspires to by filing his case with the judiciary is not to enrich the jurisprudence, but to issue a ruling in his favour that protects the victim from the state, with the translation of its utterance on the ground by its implementation. | en |
| dc.description.abstract | إن تنفيذ الأحكام القضائية يشكل دعما أساسيا للعدالة سواء عن طريق التنفيذ الجبري او الاختياري ويعتبر التنفيذ الغاية التي يتوخاها كل متقاضي سواء كان شخصا من أشخاص القانون الخاص او شخصا من أشخاص القانون العام من الالتجاء إلى المحكمة لأخذ حقه بعد الحكم دون تأخير إن معالجة إشكالية الحجز على الأموال العمومية في إطار تنفيذ الأحكام الصادرة عن المحاكم الفلسطينية تتطلب الكثير من الجهد بالنظر لما تكتسيه هذه الأموال من أهمية تأمين وضمان حسن سير المرفق العمومي من جهة، ولما تستلزمه ضرورة صيانتها من أجل استمرار الدولة والحفاظ على ما تقتضيه سيادتها. ومن ناحية أخرى فأن تنفيذ الأحكام القضائية أثار مجموعة من التساؤلات من الناحية القانونية والعملية منها حول موضوع عدم تنفيذها بالسرعة المطلوبة و كذالك كيفية تنفيذ هذا الحكم، فبقاء الأحكام و القرارات القضائية دون تنفيذ هو ضرب في مبدأ الشرعية في الدولة، فما الجدوى من اجتهاد القاضي في إيجاد الحلول الناجعة بما يتلاءم و صون الحقوق و الحريات المشروعة، فما يطمح إليه كل متقاض من رفع دعواه لدى القضاء ليس هو إغناء الاجتهاد القضائي بل استصدار حكم لصالحه يحمي المعتدى عليه من طرف الدولة مع ترجمة منطوقه على أرض الواقع بتنفيذه | ar |
