Abstract
تناول الباحث في هذه الدراسة بيان "مدى حجية التوقيع الإلكتروني في الإثبات وفق القرار بقانون الفلسطيني رقم (15) لسنة 2017"وقد جاءت هذه الدراسة في ثلاثة فصول، تناولت في الفصل الأول بيان الذي تطرق الباحث فيه الى تعريف التوقيع التقليدي وماهية الصور التي تمثل هذا النوع من التوقيع وكذلك تعريف التوقيع الالكتروني والصور التي تمثله بالإضافة الى توضيح شروط التوقيع الإلكتروني، الشكلية منها والموضوعية.أما في فصل الدراسي الثاني كان بعنوان دور السياسات التشريعية بما يتعلق بالتوقيع الإلكتروني والذي تم دراسته من خلال بيان ماهية رخص التوقيع الإلكتروني ومن لهم إصدار تلك الرخص، وثم بيان رقابة الحكومة على رخص إصدار التوقيع الإلكتروني ورقابتها على التوقيع الإلكتروني.وأخيراً الفصل الثالث من الدراسة وأهمها الذي انطوى حول حجية التوقيع الإلكتروني في الاثبات، وتم بيان الحجية في الدراسة من وجهة نظر القوانين المقارنة التي ضمت قانون الأونيسترال النموذجي ومن ثم الحجية التي يتحلى بها التوقيع وفق القانون الفلسطيني النافذ والقرار بقانون محل الدراسة والاختلاف بين كل منهم.
This study came in Three chapters, in the first chapter the researcher dealt with the definition of traditional signature and its examples and the definition of electronic signature and its examples in addition to the formal and objective conditions for the electronic signature. In the second chapter of the study that was named the role of the government regarding the electronic signature which was studied by explaining what electronic signature licenses are and who has the authority to issue those licenses, in addition to showing the role of the government censorship over the issuing of electronic signature licenses and the electronic signature itself. Finally, the researcher, through the third chapter of the research dealt with the authenticity of electronic signature in proof according to the compared laws including Unictral Model Law, then according to the Palestinian law currently in force and then the Palestinian Decree Law subject of the study and comparison the difference between them.
