Abstract
تمثل هذه الدراسة التي جاءت تحت عنوان: "قرارات مجلس الإفتاء الأعلى في فلسطين المتعلقة بالأحوال الشخصية: دراسة فقهية" رسالة علمية؛ للحصول على درجة الماجستير من عمادة الدراسات العليا، بجامعة القدس، في فلسطين.
وتهدف هذه الدراسة إلى شرح قرارات مجلس الإفتاء الأعلى المتعلقة بالأحوال الشخصية، وما توصل إليه في قراراته، ومناقشة هذه القرارات بذكر الأدلة المؤيدة، والمعارضة، والتوصل إلى نتيجة هذه المسألة إما موافقةً أو مخالفة لقرار المجلس من وجهة نظر الباحث.
وقد اتبع الباحث في دراسته مناهج علمية مختلفة؛ للوصول إلى النتائج، وهي: المنهج الوصفي: حيث قام الباحث بتقديم وصف حول كل قرار للمجلس ضمن الدراسة موضحاً الأدلة التي اتخذها المجلس للوصول إلى القرار، ومن ثم المنهج الاستقرائي والذي قام الباحث فيه باستقراء آراء العلماء من خلال كتبهم، ووضعها أمام أدلة المجلس للمقارنةبين ما ذهب إليه المجلس، ومن وافقه من العلماء، ومن خالفه من العلماء، وصولاً إلى الراجح من وجهة نظر الباحث.
وقد جاءت هذه الدراسة في مقدمة، ومبحث تمهيدي، وفصلين، وخاتمة.
المبحث التمهيدي: اشتمل هذا المبحث على التعريف بمجلس الإفتاء الأعلى، والحديث عن قرار إنشائه، وآلية عمله، والمهام المطلوبة من المفتي، وأخيراً بعض الإنجازات الخاصة بدار الإفتاء الفلسطينية.
الفصل الأول تم تخصيصه للحديث عن قرارات الزواج وأحكامه، والمحرمات من النساء، وحقوق الزوجين، والتلقيح الصناعي، والنسب، وشرحها، والفصل الثاني خُصص للحديث عن قرارات الفرقة الزوجية، وأحكامها: كالطلاق، والظهار، والنشوز، ومن ثم قرارات المجلس المتعلقة بالميراث، الوصية.
وانتهت الدراسة إلى عدة نتائج منها: اهتمام المجلس بالقضايا التي تحيط بالشعب الفلسطيني، وأن هناك بعض القرارات التي بحاجة لإعادة نظر فيها؛ لتغير حال المسلمين، وبعض القرارات التي وافق فيها الباحث المجلس، وقرارات أخرى خالف الباحث فيها المجلس من وجهة نظره.
أما التوصيات التي قدمها الباحث تتمثل في ضرورة مراجعة بعض المسائل، وعمل أرشيف خاص بالقرارات؛ منعاً للتكرار، وأن بعض المسائل ليس هناك داعٍ لشرحها؛ لأنها من المعلوم من الدين بالضرورة.
This study, entitled “Decisions of the Supreme Ifta Council in Palestine Related to Personal Status: A Jurisprudential Study”, is a scientific thesis submitted to obtain a master’s degree from the Faculty of Graduate Studies at Al-Quds University in Palestine. This study aims to explain the Supreme Ifta Council's decisions related to personal status, examine these decisions, their evidence, supporting and opposing opinions, and determine whether these decisions are consistent with jurisprudential principles from the researcher’s point of view. The researcher used various scientific approaches to reach his findings. These include the descriptive-analytical method, where the researcher describes and analyzes each council decision within the scope of the study, explaining the evidence adopted in reaching each ruling. He also used the comparative method, reviewing the opinions of other scholars and comparing them with the council’s decisions. He then evaluated the council’s evidence and the strength of the opinions from the researcher’s point of view. The study is divided into an introduction, a preface, three main chapters, and a conclusion: • Introduction: focuses on defining the Supreme Ifta Council, its structure, decision-making process, role, and the religious tasks assigned to it, as well as a review of some relevant fatwas issued by the Palestinian Dar Al-Ifta. • Chapter One: is dedicated to decisions about marriage and its rulings, such as engagement, dowry, and artificial insemination. • Chapter Two: deals with issues of divorce, including Talaq (formal divorce), (divorce initiated by the wife), separation, and others, followed by council decisions regarding wills. The study concluded with several findings, including that some of the council’s decisions align with Palestinian society’s needs, while others contradict the researcher’s view. The study also found a need for reviewing certain decisions, and for establishing a special archive to avoid repetition and clarify unresolved issues, especially those requiring urgent religious rulings.
