| dc.description.abstract | هدفت الدراسة إلى تحديد واقع حوكمة الجهاز القضائي بأبعاده المتمثلة في (الشفافية، سيادة القانون، المشاركة والمساءلة، العدالة والمساواة، الكفاءة والفاعلية، استقلالية القضاء) وانعكاساته على تعزيز ال سلم المجتمعي في المحافظات الجنوبية الفلسطينية. استخدمت الدراسة المنهج الوصفي التحليلي؛ لدراسة الظاهرة ووصف طبيعتها ونوعية العلاقة بين متغيراتها وأسبابها واتجاهاتها، واستخدمت الدراسة كلًا من أداة الاستبانة والمقابلات لجمع البيانات الأولية، إذ تم تطبيق أداة الاستبانة داخل الجهاز القضائي باستهداف العاملين فيه، حيث تمّثل مجتمع الدراسة في العاملين في الجهاز القضائي والبالغ عددهم ( 530 ) مستجيبا ومستجيبة، حيث قام الباحث باختبار العاملين بالإدارة العليا والوسطى باتباع أسلوب العينة الغرضية (القصدية)، والبالغ ،(% عددها ( 144 )، وقد تم استرداد ( 103 ) استخدمت لأغراض التحليل بنسبة استرداد ( 71.5 وتشكل عينة الدراسة من مجتمع الدراسة نسبة ( 19.4 %)، بينما تم الاعتماد على أداة المقابلات لاستطلاع آراء مديري المنظمات غير الحكومية العاملة في المجال الحقوقي، حيث قام الباحث بإجراء ( 10 ) مقابلات مع مديري المنظمات. خلصت الدراسة إلى مجموعة من النتائج، أهمها: يوجد أثر معنوي إيجابي ذو دلالة إحصائية لحوكمة الجهاز القضائي على ال سلم المجتمعي في المحافظات الجنوبية الفلسطينية، وتمثَّلت الأبعاد المؤثرة في ال سلم المجتمعي بكلٍ من (سيادة القانون، المشاركة والمساءلة، الكفاءة والفاعلية، استقلالية القضاء)، واحتلت الكفاءة والفاعلية الأعلى من حيث التأثير بمقدار ( 42.3 %)، تليها استقلالية القضاء بمقدار ( 23.3 %)، وتليها المشاركة والمساءلة بمقدار ( 19.7 %)، ومن ثم سيادة القانون بمقدار ( 18.4 %)، بينما لم يكن لكل من (الشفافية، العدالة والمساواة) أثر معنو ي على السلم المجتمعي بالمحافظات الجنوبية الفلسطينية . كما توصلت الدراسة أيضا الى عدم وجود فروق ذات دلالة احصائية في استجابات المبحوثين تعزى للمتغيرات الديمغرافية (المؤهل العلمي، العمر، المسمى الوظيفي، عدد سنوات الخبرة) حول متغيري حوكمة الجهاز القضائي والسلم المجتمعي باستثناء وجود فروق خاصة بالمتغير الديمغرافي (عدد سنوات الخبرة) في استجابات المبحوثين تجاه حوكمة الجهاز القضائي. وأوصت الدراسة بضرورة تعزيز المشاركة الف عالة لجميع مكونات المجتمع الفلسطيني من جمهور ومهتمين ومؤسسات مجتمع مدني في بذل المزيد من الجهود في الإصلاح الشامل للمنظومة القضائية الفلسطينية وتوحيدها بين المحافظات الشمالية والجنوبية، بما ينعكس بشكل إيجابي على استعادة وحدة عمل الجهاز القضائي الفلسطيني، وبالتالي تعزيز ضمان حريات المواطنين، وحفظ حقوق الإنسان الفلسطيني كوسيلة لتحقيق الأمن والعدالة الاجتماعية والسلم في المجتمع. The study aimed to determine the reality of the judiciary's governance with its dimensions in the study: (transparency, rule of law, participation and accountability, justice and equality, efficiency and effectiveness, independence of the judiciary) and its implications for enhancing societal peace in the southern Palestinian governorates. The study used the descriptive analytical approach to examine the phenomenon and describe its nature and the quality of relationship between its variables, causes and trends, by using both questionnaire and interviews as tools to collect the primary data. As questionnaire tool was applied within the judicial system by targeting its employees, the study population represents the workers in the judicial system, whose number is (530) respondents and respondents, Where the researcher tested upper and middle management employees by following the method of objective (intentional) sample of (144), (103) were used for the purposes of analysis with a recovery rate of (71.5%), while relied on the interview to survey the opinions of NGOs. Managers in the field of human rights, by conducting (10) interviews. The study concluded with a set of results, the most important of which were: There is a positive and statistically significant effect of the judiciary’s governance on societal peace in the southern Palestinian governorates, The dimensions affecting societal peace were represented by (rule of law, participation and accountability, efficiency and effectiveness, independence of the judiciary), efficiency and effectiveness was the highest in terms of impact by (42.3%), followed by independence of the judiciary by (23.3%), then participation and accountability by (19.7%), and the last one was the rule of law by (18.4%), while each of (transparency, justice and equality) had no moral effect on societal peace in the southern Palestinian governorates. The study also found that there were no statistically significant differences in the responses of the respondents attributed to the demographic variables (academic qualification, age, job title, number of years of experience) about the variables of the judiciary’s governance and societal peace, with the exception of the existence of differences related to the demographic variable (number of years of experience) in responses Respondents towards the the judiciary’s governance. The study recommended the necessity of enhancing the effective participation of all components of Palestinian society, including public, interested parties, and civil society institutions to make more efforts in the comprehensive reform of the Palestinian judicial system and unify the judicial system between the northern and southern Palestinian governorates, which will positively reflect on restoring the unity of the Palestinian judiciary and thus strengthening the guarantee of citizens' freedoms and protect Palestinian human rights as a means to achieve security, social justice and peace in society. | |
