| dc.description.abstract | تناولت هذه الدراسة موضوع حرية الإعلام في فلسطين، مركزةً على العلاقة بين التنظيم والتقييد من قبل السلطة الفلسطينية، وتأتي أهمية الدراسة في ظل ما تواجهه وسائل الإعلام الفلسطينية من تحديات تتّمثل في التوفيق بين الحفاظ على حرية التعبير من جهة ، ومتطلبات التنظيم الرسمي من جهة أخرى، وهدفت الدراسة إلى تحليل كيفية تأثير السياسات والإجراءات التي تتبناها السلطة الفلسطينية على الإعلام المحلي، ومدى توافقها مع المعايير الدولية لحرية الصحافة. استعرضت الدراسة القوانين واللوائح المتعلقة بالإعلام التي وضعتها السلطة الفلسطينية، وناقشت تأثيرها على قدرة الصحفيين والمؤسسات الإعلامية على ممارسة دورهم بحرية واستقلالية ودورها بوصفها حامية لحرية التعبير وممارسة الصحافة وحرية الإعلام ، تشير الدراسة إلى أن هناك ممارسات تقييدية تؤثر بشكل مباشر على هذه الحرية، بعيدًا عن تأثير الاحتلال الإسرائيلي تهدف الدراسة إلى استكشاف الإجراءات القانونية والتنظيمية التي تتبناها السلطة الفلسطينية تجاه المؤسسات الإعلامية والصحفيين، وكيفية تأثيرها على مبدأ حرية الصحافة، كما تسلط الضوء على استخدام السلطة لمبررات مثل الأمن القومي، وحفظ النظام العام لتبرير التدخلات في عمل الصحفيين والمؤسسات الإعلامية وهذه التدخلات وصلت إلى حدود الانتهاكات، و خلصت الدراسة إلى أن التقييد المفروض على الإعلام الفلسطيني من قبل السلطة يشكل تحديًا كبيرًا أمام حرية التعبير، ويؤثر سلبًا على تطور إعلام مستقل يمكنه أن يساهم في بناء مجتمع ديمقراطي. كما قدمت الدراسة توصيات بضرورة إعادة النظر في التشريعات الإعلامية لضمان تحقيق توازن بين تنظيم الإعلام وحماية حرية الصحافة، بما يتماشى مع المعايير الدولية لحقوق الإنسان خصوصاً أن هناك تداخلًا ملحوظًا بين التنظيم الضروري لحفظ النظام وبين التقييد المفرط الذي يحد من حرية الصحافة. على الرغم من وجود قوانين تنظيمية. إلا أن ممارسات السلطة الفلسطينية تتّسم في كثير من الأحيان بغياب الشّفافية، واستخدام القوانين كأداة للسيطرة على الخطاب الإعلامي والسياسي؛ مما يضعف قدرة الإعلام على ممارسة دوره كأداة رقابية فعّالة في المجتمع الفلسطيني . | en |
| dc.description.abstract | This study examines the topic of media freedom in Palestine, focusing on the relationship between regulation and restriction imposed by the Palestinian Authority. The importance of the study lies in the challenges faced by Palestinian media, which must balance preserving freedom of expression and meeting formal regulatory requirements. The study aims to analyze how the policies and procedures adopted by the Palestinian Authority impact local media and their compliance with international standards of press freedom. The study reviews the laws and regulations related to the media established by the Palestinian Authority and discusses their impact on the ability of journalists and media institutions to operate freely and independently, as well as the authority's role as a protector of freedom of expression, journalism, and media freedom. The study indicates that restrictive practices directly affect this freedom, away from the influence of Israeli occupation. The research explores the legal and regulatory measures taken by the Palestinian Authority toward media institutions and journalists and how these measures affect the principle of press freedom. In addition, It highlights how the authority uses justifications such as national security and maintaining public order to legitimize its interventions in the work of journalists and media institutions, interventions that have at times amounted to violations. The study concludes that the restrictions imposed on Palestinian media by the Authority pose a significant challenge to freedom of expression and negatively impact the development of an independent media capable of contributing to the building of a democratic society. The study offers recommendations, emphasizing the need to reconsider media legislation to ensure a balance between media regulation and the protection of press freedom, in line with international human rights standards. Notably, there is a clear overlap between necessary regulation to maintain order and excessive restriction that limits press freedom. Despite the existence of regulatory laws, the practices of the Palestinian Authority often lack transparency, using laws as tools to control media and political discourse, which weakens the media's ability to act as an effective watchdog in Palestinian society. | en |
