Abstract
Since the occupation of Jerusalem, Israel has sought to follow certain policies, impose legislation, or continue implementing valid legislation. All of these procedures aim to restrict the Palestinian in Jerusalem, by targeting him by following policies that contribute to depriving him of his basic rights, such as the right to housing. The right to housing is one of the human rights with which the individual's enjoyment of other rights is guaranteed. It is one of the basic rights by which human dignity is guaranteed. The right of housing is connected directly to the land, so it meets a lot of marginalization, and the claimant of this right faces obstacles and difficulties before achieving it, as the land has always been the main goal that directs Israel and determines its policies.
With regard to the land, Israel applies Ottoman laws, mandatory laws, and in turn imposed Israeli laws. This system affects the right to housing in direct ways, as it is either related to the confiscation of the land on which the building is intended to be constructed, or to the subsequent measures to complete the construction process, which are represented by the planning and building system. The approach of the State of Israel, its authorities, and its apparatus expresses its essence aimed at restricting the Palestinian human being and depriving him of his basic rights.
