| dc.description.abstract | تقوم جريمة هتك العرض بالتعدي الفاحش المنافي للآداب والخادش لعاطفة الحياء بوقوعه على جسد أو عرض المجني عليه، ولا يشترط وقوع الفعل على مكان معين من الجسم بل يشمل جميع الأماكن التي تعد من العورات من جسم الإنسان. تضمنت هذه الرسالة على عرض تحليلي لموقف المشرّع الأردني من مواجهة جرائم هتك العرض في قانون العقوبات الأردني النافذ، مع تسليط الضوء على مفهوم هذه الجرائم وصورها، وأهم أركانها والعقوبات الجنائية المترتبة عليها. هدف الدراسة هو توضيح المفاهيم التي تتعلق بجريمة هتك العرض، سواء تلك التي تتعلق بتعريف الجريمة، أو المفاهيم الملازمة لها، حتى يتسنى للقارئ الوصول إلى المعلومة الصحيحة بكل يسر وسهولة، ومعرفة متى تعتبر الجريمة الواقعة على الشخص جريمة هتك عرض، أو جريمة مشابهة لها من الجرائم الماسة بجسد المجني عليه، ولذلك تهدف هذه الدراسة للتعرف على كيفية معالجة المشرع الجزائي الأردني الإلمام بجوانب جريمة هتك العرض من حيث التجريم والعقاب. تعتمد هذه الدراسة على المنهجين الوصفي، والتحليلي من خلال دراسة وتحليل جريمة هتك العرض، من حيث صورها، وأركانها، وحماية الفئة المستهدفة من خلال الجرائم التي حددها المشرع على مرتكبها في قانون العقوبات. | ar |
| dc.description.abstract | The crime of indecent assault involves a grossly offensive act that violates morals and wounds the sense of modesty, targeting the body or honor of the victim. It is not restricted to a specific body part but includes all areas considered private in the human body. This study provides an analytical overview of the Jordanian legislator’s stance in addressing indecent assault crimes under the current Jordanian Penal Code, highlighting the concept of these crimes, their forms, key elements, and the resulting criminal penalties. The study aims to clarify the concepts related to the crime of indecent assault, including its definition and associated notions, to enable the reader to easily access accurate information and distinguish when an offense against a person constitutes indecent assault or a similar crime affecting the victim’s bodily integrity. Accordingly, this research seeks to examine how Jordanian criminal legislation addresses the aspects of indecent assault in terms of criminalization and punishment. This study adopts both descriptive and analytical approaches by examining and analyzing the crime of indecent assault in terms of its forms, elements, and the protection of targeted groups through the offenses and penalties defined by the legislator in the Penal Code. | en |
