| dc.description.abstract | نبحث في هذه الرسالة في موضوع حديث. ومهم، ألا وهو عقد الإيواء الإلكتروني، حيث جاء هذا العقد ليلبي رغبة وحاجات الأفراد، وليكون مواكبا للتطور والازدهار التكنولوجي الحاصل في عصرنا هذا. من خلال هذه الدراسة سوف نتناول عقد الإيواء الإلكتروني من حيث ماهيته وخصائصه وجميع الجوانب المتعلقة به، فعقد الإيواء الإلكتروني يقوم على تأجير حيز من خادمات متعهد الإيواء إلى أحد المستخدمين، أي أن هذا العقد ينطوي على تقديم خدمة ما. فعقد الإيواء الإلكتروني هو عقد غير مسمى، ولا يوجد قواعد قانونية خاصه به تنظمه كما في العقود الأخرى مثل عقد الوكالة، ومن هنا دعت الحاجة إلى دراسة هذا العقد والوقوف على جميع جوانبه القانونية من أجل الوصول إلى تكيف مناسب له والقدرة على تمييزه عن العقود الأخرى الحديثة المشابهة. ولقد تم اتباع المنهج الوصفي التحليلي في هذه الدراسة وذلك من خلال دراسة النصوص والمفاهيم المتعلقة بعقد الإيواء الإلكتروني والتي في الغالب منها غير محلية. وقد جاءت هذه الرسالة ضمن فصلين الأول تطرقنا فيه إلى الإطار المفاهيمي والنظري لعقد الإيواء الإلكتروني والثاني الآثار المترتبة على عقد الإيواء الإلكتروني وخاتمة وفي النهاية توصلنا إلى عدة نتائج وتوصيات هامة وهذا ما سوف يتم بيانه لاحقا. | ar |
| dc.description.abstract | This thesis is a recent and important topic, the hosting contract, which is to meet the needs of individuals and to be a match for the technological development and prosperity of our time. The study will address hosting contract, its quality, characteristics and all aspects of e-accommodation, and the hosting contract is based on the lease of accommodation from a quartering contractor to a user, i.e., the contract involves the provision of a service. The electronic hosting contract is an indefinite one, and there are no legal rules of its own that regulate it, as in other contracts such as the Agency's contract. Hence, the need to study this contract and to identify all its legal aspects in order to achieve an appropriate adaptation of the hosting contract and the ability to distinguish it from other similar modern contracts The descriptive analytical approach was followed in this study By examining texts and concepts related to Electronic hosting contract, which is mostly non-domestic. This thesis included two chapters. The first chapter, which addressed the conceptual framework of the hosting contract. While the second chapter focused on the implications of the hosting contract as well as the conclusion. Eventually, we reached several important conclusions and recommendations, which will be discussed later. | en |
