Abstract
تناولت هذه الد ا رسة موضوع تأديب القضاة وفق نصوص وأحكام الق ا رر بقانون رقم 40 لسنة 2020
والذي عدل كثير من نصوص قانون السلطة القضائية الاصلي رقم 1 لسنة 2002 ، بحيث انقسمت هذه
الد ا رسة الى فصلين بخمسة مباحث.
واعتمدت الد ا رسة المنهج المقارن بشكل رئيسي لمقارنة أحكام ونصوص الق ا رر بقانون رقم 40 لسنة
2020 مع قانون السلطة القضائية الفلسطيني رقم 1 لسنة 2002 من ناحية وطنية محلية، وبين القوانين
المقارنة كل من قانون استقلال القضاء الأردني رقم 29 لسنة 2014 وتعديلاته، وقانون السلطة القضائية
المصري رقم 46 لسنة 1972 وتعديلاته، مستعينة ايضاً بالمنهجين الوصفي والتحليلي للوقوف على
المفاهيم ولتحليل النصوص الواردة فيها.
ودارت الد ا رسة حول نظم وصور تأديب القضاة وطبيعتها، بالإضافة الى تعريف مفهوم القاضي والوظيفة
القضائية، ومن ثم تطرقت الد ا رسة الى ط ا رئق تأديب القضاة ومناط ذلك، وعرجت الى تعريف المخالفة
و/أو الجريمة التأديبية ووضحت إج ا رءات وضوابط مساءلة القضاة وتأديبهم، وبحثت ضمانات واج ا رءات
التأديب من خلال ضمانات توقيع العقوبة والضمانات اللاحقة لتوقيعها، وانتهت الد ا رسة بشرح طبيعة
ق ا رر التأديب والآثار المترتبة عليه وانقضاء المخالفة التأديبية ختاماً.
وفي النهاية توصل الباحث من خلال هذه الد ا رسة الى عدة نتائج وتوصيات وجهها للمشرع الفلسطيني
لغايات الاخذ بها، وكان أهمها "الغاء الق ا رر بقانون رقم 40 لسنة 2020 والعودة الى القانون الأصلي
قانون السلطة القضائية رقم 1 لسنة 2002 "، لما فيه مصلحة للسلطة القضائية وللسادة القضاة
This study addressed the subject of disciplining judges according to the texts and provisions of Law Decree No.40 of 2020, which amended many texts of the original judicial Authority Law No.1 of 2002, so that this study was divided into two chapters with five topics. The study adopted the comparative approach mainly to compare the provision and texts of Decree - Law No.40 of 2020 with the Palestinian Judicial Authority Law No.1 of 2002 from a national and local perspective, and between the comparative laws, the Jordanian judicial Independence Law No.29 of 2014 and his amendments, and the Egyptian Judicial Authority Lae No.46 of 1972 and its amendments, also using the descriptive and analytical approaches to identify the concepts and analyze the texts contained therein. Thy study revolved around the system forms of disciplining judges and their nature. In addition to defining the concept of the judge and judicial function. Then the study addressed the methods of disciplining judges and the basis for that, and touched on defining the violation and/or disciplinary crime and clarified the procedures and controls for questioning and disciplining judges, and examined the guarantees and procedures of discipline through the guarantees of imposing the penalty and the guarantees subsequent to its imposition. The study concluded by explaining the nature of the disciplinary decision and the consequences resulting from it and the expiration of the disciplinary violation in conclusion. Finaly, the researcher reached several results and recommendations through this study, which he directed to the Palestinian legislator for the purpose of adopting them. The most important of these was the cancellation of Decree-Lae No.40 of 2020 and returning to the original law, Space Authority Law No.1 of 2002, in the interest of the judiciary and the honorable judges.
