Abstract
This study examines the legal regulation of the emitter in penal legislation. The Emitter is an external stimulus that moves the motives within the individual, which makes him perform a voluntary behavior, and it is a type of external stimuli that stimulates the defense and satisfies him at the same time, and it is also a form of external temptation, and does not affect the behavior unless the desire and innate motives respond to it. This Study deals with th Emitter and its types, the theoretical framework of the emitter, the elements of mass intent, the distinction of the emitter from what is suspected, the position and degree of th Emitter in the science of criminology and law, the types of the emitter and its effect on the punishment, and it touched upon the two laws that took the Emitter and the laws that did not take it and the effect of the emitter on the discretionary power of the criminal judge. This study followed the method of description and analysis, as it described the texts of the law and issued some recommendations regarding them, meaning that it followed the descriptive analytical approach, and this study came within three chapters and a conclusion, and mentioned in the conclusion some of the results that it reached and some of the recommendations.
