| dc.description.abstract | المسائل الفقهيّة المتعلقة بالمدارس تشكّل أهمية بالغة, ولهذا كان هذا البحث؛ فقد مهّدتُ بالتعريف بالمدرسة وتاريخها ونشأتها, كما تحدثتُ بالفصل الأوّل عن مكانة الحجاب وحُكْمه في الشريعة الإسلامية, وعن حكم خروج المعلمات والطالبات متطيبات, كما تناولتُ موضوع قصَّات الشعر الغربية للطلاب, وحكم الملابس الرياضية للطلاب والطالبات. كما جعلت الفصل الثاني عن حُكم مس المصحف وقراءته من غير طهارة لتعليم الطلاب, وتحدّثتُ عن حكم كتابة بعض الآيات القرآنية بغير الرَّسم العثمانيّ في التعليم, مُشيراً إلى وجوب تعظيم القرآن واحترام الكتب المشتملة على آيات قرآنية, كما تناولت في الفصل الثالث بعض أحكام التمثيل والتصوير والمصافحة والتصفيق والاختلاط. وقد أفردتُ فصلاً تحدثتُ فيه عن المسائل التي تخص النّشاطات المدرسيّة العامة؛ كحكم تولّى المرأة إدارة المدرسة, وحرمان الأهل أولادهم من دخول المدارس, وتدريس الأبناء في المدارس التنصيرية و تعطيل المدارس في الأعياد النصرانية, وحكم المسابقات الرياضية والعلميّة المدرسيّة وأخذ الجوائز عليها, ومسألة الغش في الامتحانات, والسلام الوطني والوقوف له, أخذ المدرّس إجازة بدون مسوّغ, والفطر في رمضان لأجل الامتحانات, وعمّا انتشر بي الطلبة من تخصيص أدعية معيّنه عند تقديم الاختبارات, ثمّ عن حكم دفع الزَّكاة للمدارس. ثمّ ختمت الرسالة بفصل تناولت فيه المسائل الخاصة بعلاقة المعلم مع تلاميذه؛ كضرب المعلّم للطلاب بدافع التأديب والتعليم, وقيام الطلاب للمدرّس عند دخوله, وحكم غيبة الطلاب للمعلّم وتقليد حركاته استهزاء, والهدايا المقدَّمة من الطلاب والمعليمن لبعضهم. This research was prepared to discuss the jurisprudence judgments of schools which are very significant. This research began with introducing the school, its history and establishment. Chapter (1) addressed the status of “Hijab” (headscarf) and its judgment in Islamic law, as well as the use of perfume among female teachers and students. The research also discussed the issue of strange haircuts among students, as well as the judgment of sportswear for both male and female students. Chapter (2) addressed the judgment of touching and reading the Holy Quran without having purified oneself for the purpose of educating students. It also discussed the judgment of writing some Quranic verses in other scripts other than the Ottoman script in education; indicating the necessity of glorifying Quran and respecting the books which include Quranic verses. Chapter (3) addressed some judgments of acting, photography, shaking hands, clapping and mixing between both sexes. The research also included a chapter which addresses the judgments concerning general school activities; such as the judgment of appointing a woman as a school principal, parents’ deprival of their children from being enrolled at school, educating children in Christian schools and taking vacation in Christian holidays, in addition to the judgment of school athletic and scientific competitions and taking rewards. It also discussed the judgment of cheating in examinations, national anthem and standing for it, as well as taking a vacation by the teacher without any justification, breaking fast in Ramadan for exams, in addition to allocating certain prayers “Du’aa” during exams among students, then the judgment of paying Zakat for schools. The final chapter addresses the judgments concerning the teachers’ association with his students; such as beating students by the teacher as a sort of discipline and education, students’ standing-up when the teacher enters to the classroom, and the judgment of backbiting of the teacher by students and imitating him mockingly, as well as the gifts exchanged between students and teachers. | |
