Abstract
إن موضوع الدراسة عن محاضر الضابطة القضائية " دراسة مقارنة " حيث انصب
حول انجاز هذه المحاضر وقيمتها القانونية في الدعوى العمومية، وقد تضمن البحث مقدمة
تعريفية بالمحضر وتاريخه وتمت الدراسة بفصليين وهي : الفصل الأول انجاز محاضر
الضابطة القضائية من حيث الشروط الموضوعية والشكلية وأنواع المحاضر، والفصل الثاني
وضحت الدراسة دور المحاضر في الإثبات حيث حجيتها وكذلك البطلان.
وتنبع أهمية دراسة المحاضر التي يحررها رجال الضابطة القضائية، كونها تتمخض
عن مرحلة ما قبل المحاكمة، والتي يحررونها بمناسبة قيامهم بعملهم في التثبت من وقوع
الجريمة، وجمع الأدلة حولها، وإلقاء القبض أو إيقاف كل شخص له علاقة بالجريمة . هنا
تتجلى الأهمية الحيوية التي تحظى بها هذه الوثيقة ليس فقط كوسيلة إثبات، وإنما كآلية سخر
لانجازها سلطات واسعة بيد مأموري الضبط القضائي .
والهدف من وراء هذه الرسالة " البحث " أن تكون مادة قابلة للتداول في المجالس
العلمية لأهل الاختصاص، وكي لا تبقى قضية محاضر الضابطة القضائية حكرا في ذهن
مأمور الضابطة القضائية يتصرف فيها كيف يشاء، بل لا بد من أن تعمم على المستوى
التعليمي . القصد من ذلك ومن خلال الممارسة العملية في المجال الشرطي وخبرتي، رغب
الباحث في نقل هذه الخبرات وما يحيطها من تفصيلات إلى دراسة مستقلة بذاتها لتصبح ثقافة
دارجة في الأوساط القانونية .
يستمد هذه البحث أهميته كونه يحاول طرح مادة محاضر الضابطة القضائية تحت
الضوء، بحيث يعالجها معالجة مقارنة معتمدا على الأحكام والقرارات القضائية الصادرة في
هذا الشأن وأراء الفقه وأثره في قانون الإجراءات الجزائية الفلسطيني، وكذلك أسلوب
المقارنة أينما وجدت مجالا مع تشريعات الدول العربية والأجنبية الأخرى، وصولا إلى
تعريف محاضر الضابطة بجدية الموضوع وأهميته في الوقت ذاته ولعله من الضروري
وخدمة للإجراءات القانونية أن يطلع كل طرف من المعنيين على هذه الدراسة سواء كان
مأمور ضبط قضائي أم المحامي وحتى النيابة وإثراء لمادة الإجراءات الجزائية .
اتبعت الدراسة المنهج البحثي التحليلي والوصفي المقارن والذي يعتمد على استعراض
النصوص القانونية المنظمة لموضوع الدراسة، مع دراسة آراء الفقهاء والباحثين والتعليق عليها،
وترجيح الرأي الصائب مع الحجة والمنطق القانوني السليم.
أما حدود الدراسة فقد تناولت دراسة محاضر الضابطة القضائية في كل من قانون
الإجراءات الجزائية الفلسطيني رقم (3 (لسنة 2001 مع مقارنة ذلك بتشريعات الإجرائية
التي كانت سارية قبل القانون الفلسطيني وخاصة قانون الإجراءات الجنائية المصري ،
وقانون المحاكمات الجزائية الأردني ، مع الإشارة لبعض التشريعات الإجرائية المقارنة
ألأخرى .
خلصت الدراسة إلى العديد من النتائج والتوصيات وذلك نظراً لقلة وندرة النصوص
القانونية المتعلقة بتنظيم محاضر الضابطة القضائية في قانون الإجراءات الجزائية
الفلسطيني، ويقترح الباحث على المشرع الفلسطيني العمل على وضع نصوص واضحة
ومحددة بتنظيم المحاضر، بحيث يضمن حسن ودقة الأخذ به، نظراً إلى خصوصية
وأهمية محاضر الضابطة القضائية في الإثبات الجنائي، حيث نجد تنظيم وكيفية انجاز
تلك المحاضر مبنيا في الأغلب على تطبيقات قضائية واجتهاد فقهي.
This study discusses and tackles comparatively the proceedings ('proc'es verbals) of the judicial police, where the theme of this study concentrates on the performance and fulfillment of these proceedings as well as their legal importance of the public law suit. The research includes an introduction to the proceedings ('proc'es verbals) and its history. The study has been conducted in two chapters: the first chapter discusses the fulfillment or the achievement of the judicial police 'proc'es verbals in respect of formal and informal conditions and the types of 'proc'es verbals (proceedings). The second chapter clarifies the role of 'proc'es verbals in establishing the validity with respect of authentication or cancellation. The importance of 'proc'es verbals, written by judicial officers, comes from being emerged from the pre‐trial stage. They write them during their work to prove the crime, to collect evidences about it and to arrest or detain anyone who has relation to the crime. Here appears the vital importance of this document not only as a means of proof, but also as a mechanism by which vast authorities granted to the judicial police officers, have been exploited to achieve it. The aim of this research is to be as a material that can be circulated in the scientific councils for specialists. Therefore, the issue of judicial police 'proc'es verbals will not be restricted to the judicial police officer, but it should be generalized on the educational level. The researcher intends‐through his practical experience in the police field‐ to convey these experiences with their details to an independent study by itself in order to become a common culture in the legal offices. The importance of the research comes out from spotting some light on the subject of judicial police proceedings to deal with them comparatively, depending on the legal provisions and judicial resolutions issued in this context, and on the views of jurisprudence and its influence on the law of Palestinian criminal procedures. It also depends on the comparative approach wherever it finds room with the legislations of the other Arab and foreign countries until we reach to a comprehensive definition for judicial police proceedings and its importance in the same time. To serve the legal procedures, it may be necessary that every concerned party, either a judicial police officer or a lawyer or even the prosecution should be introduced to this study to enrich the material of criminal procedures. In my research, I adopt the comparative analytical‐descriptive approach, which depends on surveying the legal texts organized the subject of study, in addition to the views of scholars and researchers as well as the comments on them. Then, I outweigh the right opinion mentioning the evidence and the right legal logic. For the limits of study, it discusses the proceedings of judicial police in the Palestinian Criminal Procedures No.(3) for the year (2001) in comparison with other procedural legislations which were in execution and valid before the Palestinian law was enacted, especially the Egyptian Criminal Law and the Jordanian Criminal Trial Law, with reference to some other comparative procedural legislations. The study concludes with a lot of results and recommendations; the most important one is the lack and the scarcity of legal texts related to the organization of judicial police proceedings in the Palestinian Criminal Procedures Law. The researcher suggests that the Palestinian legislator should work on laying out obvious and definite texts to organize proceedings in a manner that ensures excellence and accuracy to be taken into account, for the privacy and the significance of the judicial police proceedings in criminal evidence, where we commonly see that most of these proceedings were organized and performed on judicial applications as well as on jurisprudence diligence.
