| dc.description.abstract | هذه الدراسة تسلط الضوء على واقع العمال الفلسطينيين في الداخل المحتل، في ظل الظروف الاقتصادية القاسية والاحتلال الإسرائيلي المستمر الذي يتحكم بمصادر الرزق، ويمنع الفلسطينيين من تحقيق تنمية اقتصادية شاملة. حيث يعانون العمال الفلسطينيون من أوضاع قانونية ومعيشية صعبة من أهمها ارتفاع معدلات البطالة، وعدم وجود حماية اجتماعية، وظروف عمل غير آمنة، وانتهاكات مستمرة لحقوقهم. كما أنهم يواجهون تمييز عنصري من قبل المشغلين والجهات الرسمية المسؤولة عن تنفيذ قوانين العمل وحماية حقوق العمال الفلسطينيين، وهذا يجعلهم عرضة للاستغلال والانتهاك اليومي دون وجود رقابة فعالة. تتمثل إشكالية هذه الدراسة في بحث القانون الإسرائيلي الذي يقوم بتنظيم العلاقة بين العامل الفلسطيني والمشغّل الإسرائيلي، ومدى كفاءة القانون والقضاء في حماية حقوق العامل، وتحديد الحقوق التي يتم انتهاكها وطرق الحصول عليها، والبحث في مدى إمكانية تطوير الوسائل القانونية اللازمة لحماية الفئة العاملة. كما تقوم الدراسة بإثارة تساؤلات حول طبيعة القوانين واجبة التطبيق، وبين طريقة المطالبة بالحقوق، وإمكانية الوصول إلى العدالة في ظل نظام وجود احتلالي. تكتسب هذه الدراسة أهميتها من الناحيتين النظرية والعملية؛ فمن جهة، حيث تقوم بتقديم إطاراً قانونياً ومعرفياً مهماً يحتاجه الكثير من الباحثين والعمال بأنفسهم، وتُعد مرجعاً قانونياً ومعرفياً يثري المكتبة القانونية في مجال حساس ومغيّب. ومن جهة ثانية، فإنها تخدم فئة واسعة من العمال الفلسطينيين العاملين في الداخل المحتل، وتساهم في تعزيز الوعي القانوني لديهم، مما يساعد في تمكينهم من القيام بالمطالبة بحقوقهم ووضع حد للانتهاكات الواقعة عليهم. استخدم الباحث في دراسته المنهج الوصفي التحليلي، من خلال قيامه بتحليل النصوص القانونية الإسرائيلية ذات الصلة، واتفاقيات العمل الجماعية والفردية، وقرارات المحاكم، مع الاستعانة بدراسات سابقة. الكلمات المفتاحية: العمال الفلسطينيون، الداخل المحتل، حقوق العمل، التمييز العنصري، القانون الإسرائيلي، الحماية القانونية، انتهاكات العمال، العدالة الاجتماعية، علاقات العمل، القوانين الدولية، ظروف العمل، الاحتلال الإسرائيلي. | ar |
| dc.description.abstract | The thesis examines the legal status and the working conditions of Palestinian laborers employed in Israel, highlights the structural inequalities and the legal vulnerabilities they face under Israeli occupation. Despite contributing significantly to both of the Israeli and the Palestinian economies, these workers are sometimes deprived of their basic labor rights, includes fair wages, safe environments for work, and access to legal remedies. Their situation is more complicated by discriminatory permit systems and lack of the consistent legal protections, particularly for those who are working without formal authorization. This study seeks to analyze the extent to which Israeli labor laws and judicial decisions protect-or fail to protect-the rights of the Palestinian workers. It questions whether the laws are applied fairly, and to what degree the Palestinian workers are able to access the justice when their rights are violated. This research also explores the systemic barriers that prevent the workers from exercising their rights, ranging from the legal ignorance to the institutional bias and racism in the law enforcement and labor oversight. From the theoretical perspective, this research contributes to a relatively understudied area of labor law in the conflict zones, specifically in context of the occupation. From the practical point of view, it addresses the need for the legal empowerment among the Palestinian workers and provides recommendations to improve their protection within the current legal framework.
