| dc.description.abstract | هذه الرسالة جاءت بعنوان "اختيارات الشيخ مصطفى الزرقا في المعاملات"، وقد اشتملت على ما يراه الشيخ في مسائل مستجدة ربما كان لها شبيه في الفقه الإسلامي قديما، وربما اختار رأيا من آراء العلماء السابقين فيها ، أو استقلّ برأي جديد تخريجا على أصول المذاهب الفقهية المعتمدة، أو رأى أن المصلحة تقتضي الرجوع فيها إلى العرف الغالب الذي لا يصطدم مع النصوص الشرعية، وتقرّه القوانين المعمول بها في مجتمع معين. وقد ظهرت اختياراته في بعض مسائل هذه الرسالة، وبرزت ملكته الفقهية، التي لا يقيّدها فيها رأي الرجال؛ كاختياره في مسألة التأمين، وإن كان الشيخ في أغلب فروعها قد خالف آراء علماء العصر، بل خالف ما استقر عليه المجمع الفقهي. كما جاءت بعض اختياراته لتبرز شخصيته التي تظهر قول العالم الرباني الذي لا يسمح لخرق النصوص الشرعية، وليكون رأيه فصل الخِطاب فيها؛ كمسألة حكم استيلاء البلديات على القبور الدوارس التابعة أصلا لمال الوقف الإسلامي، ومن ثم خضعت المؤسسات الحكومية لرأيه، وألغت قرارها بالاستيلاء . ومن المسائل التي أبدى رأيه فيها، وهي من المسائل التي يحتاج لها الناس، ويكثر فيها الاستفتاء، والسؤال: منها حكم العمل في البنوك الربوية، وحكم إيداع الأموال في بنوك غير إسلامية، ومن ثم حكم أخذ ما يسمى بالفوائد الربوية وكيفية التصرّف فيها، ومسائل أخرى في الشيكات التي انخفض سعر العملة بعد كتابتها، وردّه على من يشيع عنه بأنه يبيح الربا في التعامل مع غير المسلمين في بلاد الغرب، وبيانه بأن هذا الأمر له قيود، وشروط، وأنه اعتمد في فتواه على ما سلف من فتوى أئمة عظماء بشروطهم، ثم تخريجه على أصول الشريعة مسائل أخرى أصبحت من ضرورات العصر التي لا يُستغنى عنها كمسألة الشخصية الاعتبارية، إذ استنبط مشروعية هذه الشخصية من النصوص الشرعية العامة،ثم رأيه في مشاركة الكافر، ومشاركة المرتد، ومن كان ماله من حرام، ففيما ذُكر من المسائل وغيرها، مباحث هذه الرسالة . Praise be to Allah and peace and blessing upon his chosen servants. This thesis is titled: “Sheikh Mustafa AlZarqa choices of Jurisprudence of transactions". It encompasses the Sheikh’s view of recurring matters that the earlier scholars looked at. In these instances, he either chose one of the earlier scholars view or came up with his own based on the core of the well-established Islamic doctrines and in some instances where he saw the benefit lies within the society conventions as long as it adheres to the Islamic law and the law of the land. His choices were present in some of this thesis cases and his unique Jurisprudence character where his discussion was of a man with deep knowledge of Islamic Jurisprudence and his mastery of the Arabic language was apparent without being bound by other’s opinions; an example is his choices and views on insurance matters where he differed with current and past scholars and even with The Islamic Fiqh Academy. Some of his Jurisprudence choices showed his divine scholarity that doesn’t permit deviating from Islamic teachings, for example his view that overturned and nullified the municipalities taking over the very old cemeteries that are indeed belong to the Islamic “Waqf” before they were under the government control. One of the prevailing and persistent question that people ask and the Sheik rendered his opinion was the matter of dealings with non-Islamic banks in such matters as opening accounts, taking interests, and the matter of checks that the value of the currency diminished after issuance. Also, his rebuttal of being accused of allowing taking interests from non-Muslims in western countries where he stated that there are conditions and limitations to this opinion and it was based on well-known and respected scholars own conditions. Also, he rendered opinions on other current necessary matters such as “juridical person” where he inferred its legality from general Islamic texts in addition to his views on partnering with a non-believer, partnering with an apostate or with a person whose capital is illegally derived. These matters and others were the core of this thesis. | |
