Abstract
تناولت في هذه الد ا رسة موضوع النظام القانوني لاتحاد الملاك في قانون الشقق والطبقات
والمحلات الفلسطيني رقم ) 1( لعام 1996 , وقد اتبعت منهج الوصف التحليلي في هذه الد ا رسة ,
وقد تبلورت اشكالية الد ا رسة في مدى احاطة المشرع الفلسطيني لجميع جوانب تنظيم نظام اتحاد
الملاك والية عمله في قانون الشقق والطبقات والمحلات الفلسطيني رقم ) 1( لعام 1996 ,وقدمت
هذه الد ا رسة إجابة عن هذه الإشكالية فنصت هذه الد ا رسة على ان كان قصور في جوانب عدة
تخص نظام اتحاد الملاك لم ينص عليها قانون الشقق والطبقات والمحلات الفلسطيني رقم ) 1 )
لعام 1996 واحتوت على توصيات لحل هذه الإشكالية .
وقام الباحث بتقسيم الد ا رسة الى فصلين، وكان عنوان الفصل الأول ماهية اتحاد الملاك وإج ا رءات
إدارة اتحاد الملاك للأج ا زء المشتركة وقسم هذا الفصل إلى مبحثين، تم توضيح تعرف اتحاد الملاك
والطبيعة القانونية لاتحاد الملاك ومن ثم تم التطرق لالت ا زمات الاتحاد اتجاه العقار والأج ا زء
المشتركة، أما المبحث الثاني قد تناول انشاء اتحاد الملاك وانقضائه ومدى صلاحيات اتحاد
الملاك.
وقد تطرق الفصل الثاني بعنوان مكونات اتحاد الملاك لإدارة الأج ا زء المشتركة وحقوق والالت ا زمات
الملاك التي ترد على العقار , وقسم هذا الفصل لمبحثين عالج في المبحث الأول مسألة مكونات
الاتحاد التي تساعد وتمثل الاتحاد في إدارة العقار متمثلة في الجمعية العمومية وم دير الاتحاد
)مأمور الاتحاد( , ووضح في هذا المبحث اختصاصات الجمعية والعمومية و اختصاصات مدير
الاتحاد , والمبحث الثاني تطرق الى توضيح حقوق والت ا زمات ملاك الطبقات او الشقق اتجاه الج ا زء
المشتركة والمفرزة والقيود التي وردت على هذه الحقوق في القانون الفلسطيني .
وقد توصلت في نهاية هذه الد ا رسة الى العديد من النتائج كان ابرزها ان المشرع اغفل العديد من
جوانب نظام اتحاد الملاك ومن اهم هذه الجوانب تنظيم اجتماعات الجمعية العمومية فلم ينص
القانون الفلسطيني على م ا رحل الدعوة لاجتماع الجمعية العمومية مثل من يجب ان يستلم ال دعوى
او في أي مكان يجب الاجتماع او موضوع الاجتماع لم ينظم القانون الفلسطيني أي نقطة من
هذه النقاط , لذلك قام الباحث بوضع بعض التوصيات , ومن هذه التوصيات ان يقوم المشرع
بتحديد م ا رحل والية الدعوى لاجتماع الجمعية العام في تعديل لقانون الشقق والطبقات والمحلات
لعام 1996 رقم ) 1 .)
This study addressed the topic of the legal framework of the Owners' Association under the Palestinian Apartments, Floors, and Shops Law No. (1) of 1996. The analytical descriptive approach was adopted in this study. The research problem centered around the extent to which the Palestinian legislator comprehensively regulated the Owners' Association system and its operational mechanisms under the said law. The study provided an answer to this research problem, concluding that there were shortcomings in several aspects related to the Owners' Association system that were not addressed by the Palestinian Apartments, Floors, and Shops Law No. (1) of 1996. The study also presented recommendations to resolve these shortcomings. The researcher divided the study into two chapters. The first chapter was titled "The Concept of the Owners' Association and the Procedures for Managing the Common Parts" and was divided into two sections. The first section clarified the definition of the Owners' Association and its legal nature, then addressed the Association's obligations towards the property and the common parts. The second section dealt with the establishment and dissolution of the Owners' Association, as well as the extent of its powers. The second chapter, titled "The Components of the Owners' Association for Managing the Common Parts and the Rights and Obligations of Owners Over the Property," was also divided into two sections. The first section addressed the components of the Association that assist and represent it in managing the property, namely the General Assembly and the Association Manager (or Association Commissioner). This section also explained the powers of both the General Assembly and the Association Manager. The second section discussed the rights and obligations of the owners of floors or apartments regarding the common and private parts, along with the restrictions imposed on these rights by Palestinian law. At the conclusion of the study, several findings were reached, the most prominent of which was that the legislator overlooked many aspects related to the Owners' Association system. One of the most critical omissions was the regulation of the General Assembly meetings; the Palestinian law did not specify the stages of calling for a meeting, who should receive the call, where the meeting should be held, or the topics to be discussed. None of these procedural details were organized under the Palestinian Apartments, Floors, and Shops Law. Accordingly, the researcher proposed several recommendations, including that the legislator should specify the stages and mechanisms for calling and holding a General Assembly meeting through an amendment to the Palestinian Apartments, Floors, and Shops Law No. (1) of 1996
