| dc.description.abstract | لم يكن الحديث عن التعامل مع الاحتلال بأدنى درجاته موضع قبول لدى الغالبية، فقدّ فُرِضَ على الشعب الفلسطيني طوال خضوعه للاحتلال الإسرائيلي وجوب التعامل مع الاحتلال لتمرير مصالحهم الاقتصادية وتلبية حاجاتهم الإنسانية، وهذا ما دفع المشرع الفلسطيني للتدخل بتحديد مكانة تلك التعاملات في التشريعات الجزائية، حيث تم تسليط الضوء على الأعمال التجارية التي يقوم بها كل فلسطيني أو مقيم داخل فلسطين لصالح الاحتلال الإسرائيلي، وقدّ تمّ تناول هذا الموضوع من جانبين: يتمثّل الجانب الأول في واقع التعامل التجاري مع الاحتلال الإسرائيلي داخل الأراضي الفلسطينيّة، وأمّا الجانب الثاني فيتمثّل في استعراض النصوص القانونيّة التي تجرّم هذا الفعل. من الناحية الواقعية، أظهر هذا العمل أنّ التعامل التجاري مع العدوّ الصهيوني ما زال يحدث داخل الأراضي الفلسطينيّة، فيمارسه من يغلّب مصلحته الفردية على حساب المصلحة العامّة، ولا يعبأ بكون أعماله التجاريّة تعود بالنفع على الاحتلال الاسرائيلي وتمكّنه من التغلّب على الشعب الفلسطيني وإضعافه وتدمير مقوّمات المجتمع الاقتصادية، فقد عكست هذه الرسالة الآثار السلبيّة المترتبة على هذا التعامل التجاري وخاصة في ظل الوضع السياسي الذي يعيشه الشعب الفلسطيني. من الناحية القانونية، تم استقراء النصوص القانونية الجزائية التي تجرّم التعامل التجاري مع الاحتلال الاسرائيلي، وذلك من خلال استعراض صور ذلك التعامل والعقوبة المترتبة على مرتكبه، وقد عدّ المشرّع بعض صور ذلك التعامل من قبيل جرائم التعدّي على أمن الدولة الخارجي، لما تحدثه هذه الأفعال من خطر على دعائم الدولة وسيادتها واقتصادها. Talking about dealing with the occupation at it's lowest level was not acceptable to the majority, it came as a result of getting their economic interests and human needs, That was prompted the Palestinian legislator to determine the status of these transactions in the criminal legislation. It highlights the commercial activities carriedout by some Palestinians or residents inside Palestine for the benefit of the Israeli occupation. This issue has been addressed from two aspects, the first aspect is the reality of commercial deals with the Israeli occupation inside Palestine, and the second one represents the revision of the legal context that criminalizes this act. From a realistic point of view, this work has shown that commercial deals with the Israeli occupation continue to take place sometimes in the Palestinian sociaty. It is practiced by those who prefer their individual interests at the expense of the public interest, and do not care that their commercial activities benefit the Israeli occupation and enable it to overcome the Palestinian people, weaken them and destroy the economic componants of the palestinian society. This thesis reflects the negative effects of these comercial deals, especially on the political situation experienced by the Palestinian people. Legally, the criminal legal texts that criminalize commercial dealings with the Israeli occupation were extrapolated, by reviewing the aspects of that dealing and punishing the perpetrator because of threat to the pillars of the Palestinian state, its sovereignty and its economy. | |
