Abstract
For a summary This study aims to confine the rules and jurisprudential
controls related to the issues of breastfeeding, custody and guardianship over
the little child. It has been divided into an introduction, four chapters and a
conclusion. The researcher in this study dealt with explaining the meaning of
concepts and terms ,such as the rules and jurisprudential controls of
breastfeeding, custody and guardianship over the little child in terms of
language and terminology, as well as the topic of legal rooting if the rules
and jurisprudential controls contained therin each rule or jurisprudence
passed through which the researcher explained its vocabulary language and
terminology then its overall meaning ,then the legal rooting them
applications to the rules and controls with a statement of jurists of the four
schools of thoughts and the evidence for each one of possible. At the
conclusion of this study,the researcher listed all her findings including : -
The great importance of jurisprudentisl rules and controls, and their great
usefulness. They bring together the scattered branches so that they are easy
to understand, control and preserve. Also the knowledge of the rules and
jurisprudence controls helps in understanding the purposes of Islamic Law,
and its study also helps in ease of referring to various jurisprudential issues
,and knowing the seasons for the difference of jurists in some Doctrinal
issues and branches that fall under those Doctoral rules or regulations. - The
Fuqaha agreed that the mother should breastfeed her baby, if she has to,to
protect his life from loss or damage. - The Fuqaha agreed that the father is
the legal guardian of the young in soul and money, because he is the most
merciful and compassionate on him. Then I concluded the recommendations
that emerged form the study ,some of which are for teachers and Islamic
Science students and preachers, and including what is for the general
Muslims. - I recommend the utmost care of the jurisprudential rules and
regulations , especially those that require effort in studying and caring for
them, and collecting them from their ancient and modern sources. - I
recommend translating these rules and jurisprudential controls into foreign
languages so that others know the richness of Islamic Jurisprudence , and
preserve the rights of people especially young children
