Abstract
تركّز الدراسة بشكل أساسي على حصانة الحقيبة الدبلوماسية كقاعدة دولية معترف بها في القانون الدولي، ودورها في تعزيز حماية أمن الدول المستقبِلة ودول العبور من التجاوزات غير المشروعة.
تهدف الدراسة إلى استعراض وتحليل الحصانات الدبلوماسية الممنوحة لحاملي الحقائب الدبلوماسية وفقاً لاتفاقية فيينا، التي تُعَدّ الوثيقة الأساسية للعلاقات الدولية. كما تسعى الدراسة إلى تحديد الآليات القانونية المتاحة لمواجهة أي تجاوزات تتم من خلال الحقيبة الدبلوماسية، وتقديم بدائل قانونية لسد الفجوات الموجودة في الأنظمة والاتفاقيات الدولية ذات الصلة.
وتكمن مشكلة الدراسة في الإجابة على التساؤل الرئيسي الآتي: هل يمكن للقانون الدولي تحقيق التوازن بين حرمة الحقيبة الدبلوماسية من ناحية، وحماية أمن الدولة المستقبِلة ودولة العبور من إساءة استعمال تلك الحقيبة من ناحية أخرى؟
استنادًا إلى المنهج الوصفي والتحليلي، توصلت الدراسة إلى أنّ الحقيبة الدبلوماسية تعتبر أداة أساسية في التواصل بين الدول، حيث تشمل محتويات مخصصة للاستخدام الرسمي. ومع ذلك، يمكن أن يؤدي استغلال حصانتها في أنشطة غير مشروعة إلى توتر العلاقات بين الدول.
وتوصي الدراسة بتعزيز التنسيق بين مؤسسات السلطة الوطنية الفلسطينية ومنظمة التحرير الفلسطينية لضمان تمثيل دبلوماسي موحد في مختلف المحافل الدولية، ووضع قواعد قانونية للحد من إساءة استخدام الحقيبة الدبلوماسية.
The study focuses mainly on the immunity of the diplomatic bag as an international rule recognized in international law, and enhancing its role in protecting the security of receiving and transit countries from illegal violations.
The study aims to review and analyze the diplomatic immunities granted to holders of diplomatic bags according to the Vienna Convention, which is considered the basic document of international relations. The study also seeks to identify the legal mechanisms available to confront any violations committed through the diplomatic bag, and to provide legal alternatives to fill the gaps in the relevant international systems and agreements.
The problem of the study lies in answering the following main question: Can international law balance the sanctity of the diplomatic bag on the one hand, and protect the security of the receiving state and the transit state from misuse of that bag on the other hand?
Based on the descriptive and analytical approach, the study concluded that the diplomatic bag is an essential tool in communication between countries, as it contains contents intended for official use. However, exploiting its immunity in illegal activities can lead to tension in relations between countries.
The study recommends enhancing coordination between the institutions of the Palestinian National Authority and the Palestine Liberation Organization to ensure unified diplomatic representation in various international forums, and establishing legal rules to limit the misuse of the diplomatic bag.
