dc.description.abstractThis thesis is entitled: "The choices of Sheikh Mustafa Al-Zarqa in physical warships". Due to Sheikh Mustafa al-Zarqa's scholarly position and as he is considered a diligent scholar and contemporary jurist, this study dealt with the jurisprudential choices of Sheikh Mustafa al-Zarqa, and the opinions and preferences that he issued in the section on physical acts of worship, in comparison with the four jurisprudential schools. He rose through his choices, his approach of renewal in Fatwa (ruling or interpretation in Islam), considering the ease and tolerance of Islamic Sharia (low), and his distance from sectarian fanaticism was clearly demonstrated, with the great reverence for previous jurists. The study consisted of five chapters. The first chapter came with a comprehensive translation on Sheikh Mustafa Al-Zarqa, and a statement of his method in the fatwa. Then came the second chapter to discuss Sheikh Al-Zarqa's choices in the chapter on tahara (purification), and it contains two issues: purification and its effect on abolishing ablution, and the blood that women see after menopause. The third chapter talks about the choices of Sheikh Mustafa Al-Zarqa in prayer section, and it contains four issues: the times of prayer and fasting in the areas near the pole, Friday prayers in a factory outside the city, Muslims praying in a language other than Arabic, and covering the head of the Khatib (preacher). As for the fourth chapter, it talked about the choices of Sheikh Mustafa Al-Zarqa in the section of fasting, and it includes two issues: establishing seeing the crescent by astronomical calculation, and the difference of the sightings and its effect on establishing seeing the crescent of Ramadan. The fifth chapter ended with an examination of Sheikh Mustafa al-Zarqa's choices in the section of Hajj, and it contains five issues: the timing of Ihram for the one coming by plane, the time for stoning Jamarat al-Aqaba, the times for stoning Jamarat during the days of al-Tashreeq, and the arrangement between the actions of the Day of Sacrifice, and the smaller decomposition, and on what it depends. Each of the issues was singled out by a single request that included the choice of Al-Sheikh Al-Zarqa, with mention of the evidence on which he relied on his judgement. The thesis ended with the most important results, including: highlighting the clear scientific method of Sheikh Mustafa Al-Zarqa in his fatwas and jurisprudential research, where the Sheikh's lack of intolerance to his Hanafi school of thought was evident, and this was evident in his disagreements with many of the opinions of the Hanafi school, so his choices were based on rooting and subtraction, taking into account the shari text, and the purposes of the sharia and the interests of the people. The researcher recommends students of shari science to pursue the study of the jurisprudential choices of Sheikh Mustafa al-Zarqa in the various sections of jurisprudence, and to direct scholars who who seek knowledge to pay attention to the opinions of scholars and their choices, and to show them to people, as this is the least duty we do towards the heirs of the prophets.
