Abstract
تهدف الدراسة إلى تتبع فقه الإمام ا لحسن بن زياد اللؤلؤي الحنفي، وبيان الأحكام الفقهية التي خالف
فيها أئمة المذهب الحنفي، واختصت بأبواب الفقه الإسلامي ب ةقلعتملا العبادات والمعاملات والأسرة
والحدود والقصاص والسير
وتكمن أهمية هذه الدراسة في جمعها المسائل التي اجتهد فيها الحسن بن زياد، من امهات كتب
الحنفية ووضعها في مؤلف واحد مستقل حتى يسهل الرجوع إليها، والإفادة منها، كما تكمن أهميتها
في بيانها مكانة الحسن في المذهب الحنفي، ومدى اعتماد آرائه الفقهية لا سيما تلك التي خالف فيها
أئمة المذهب الحنفي "أبو حنيفة وأبو يوسف والشيباني وزفر " في سبعه مسائل من مسائل العبادات ومسألتين من مسائل المعاملات وسته مسائل المعاملات وسته مسائل من المسائل المتعلقه باحكام الاسرة وسبعه مسائل من المسائل المتعلقه بالحدود والقصاص والسير
واعتمدت الدراسة المنهج الوصفي التحليلي، إذ كانت تعتمد على نقل أقوال العلماء وتحللها وتقارن
بينها بهدف الوصول إلى ما يخص فقه الامام الحسن بن زياد وتبين موقفه ومنهجه
وبعد هذا العرض لآ راء الإمام تبين للباحثة مجموعة من النتائج أبرزها :
أن الحسن بن زياد هو أحد أركان المجمع الفقهي الذي كان يرأسه الإمام أبو حنيفة، وأنّه كان واحداً من المجتهدين الذين توافرت لهم شروط الاجتهاد، وأ ن المسائل التي انفرد بها كانت نتيجة واضحة من نتائج اجتهاده، حيث تركت أثرا بارزا فيمن تلاه من الفقهاء، وتبين أن الإمام الحسن زيـاد قـد جمع بالإضافة إلى الفقه رواية الحديث وحفظه فكان محثا جليلا
وبناء على النتائج التي توصلت إليها الباحثة، يمكن أن يشكّل هذا البحث نواة تشجع القيام بأبحـاث أكثر عمقاً وشمولية، وأكثر تفصيلاً فيما يتعلّق بفقه الإمام. خصوصاً في مجال البحث عن مسـائل أخرى من أمهات كتب المذهب الحنفي لا سيما فيما خالف فيها أئمة المذهب الحنفي ، حيـث تبـرز ذلك تميزه وتفرده، ويمكن عمل أبحاث تتحدث عن مؤلفاته الكثيرة التي لم أعرض في هذه الدراسة ويأتي ذلك خدمة للتراث الفقهي الإسلامي، لأن استخراج كنوزه لن تنقطـع أبـدا ، وأ ن اسـتمرار الحاجة الى فقهاء وباحثين في القفه امر ملح حتى قيام الساعه
The study aims to address the jurisprudence (fiqh) of Imam Hassan Ibn Ziyad Al-Lu’lu’i Al-Hanafi and to illustrate the jurisprudential rulings, in which he disagreed with the provisions of the Imams of the Hanafi School (Madhab). In particular, it addresses the various sections of Islamic jurisprudence which is related to the worship (Ibadah), the transactions, the family, the prescribed penalties, the law of retaliation (Al-Qisas) and biographies (seerah). This study gathers the issues in which Imam Hassan Ibn Ziyad Al-Hanafi developed his independent judgments from main references of the Hanafi School as well as it reposes them in a single independent book for easy reference and access. In addition, it demonstrates the status of the Imam Hassan Ibn Ziyad Al-Hanafi and the approval of his doctrinal views among other imams, especially those views in which he opposed the imams of the Hanafi School including Abu Hanifa, Abu Yusuf, Al-Shaybani and Jafar. These issues include seven issues in worship matters, two issues in transactions matters, six issues in family matters, and seven issues in the prescribed penalties, the law of retaliation, and biographies matters. This study used the descriptive analytical method through transfer, analysis, and comparison of scholars in order to deduce the jurisprudence, attitude and approach of the Imam Hassan Ibn Ziyad Al-Hanafi In the end of the study, the researcher reached these findings: Imam Hassan Ibn Ziyad Al-Hanafi was one of the main pillars of the Fiqh Council which was headed by Imam Abu Hanifa. He was one of the Islamic scholars (mujtahids) who met the terms and conditions of Ijtihad (exercise of judgment). The issues, which Imam Hassan studied, were a clear result of his own Ijtihad and thus they left a significant impact on other subsequent scholars (Fuqaha’). Besides Fiqh, he also gathered and memorized hadiths. According to the study findings, the researcher recommends more comprehensive and indepth studies about the outstanding jurisprudence of Imam Hassan Ibn Ziyad Al-Hanafi, mainly the issues in which he opposed the rulings of the Hanafi School. Furthermore, the researcher calls for further research about his many books, which were not addressed in this study. Therefore, such further research will benefit the Islamic Fiqh and uncover other hidden gems and so there is always a need for more scholars and researchers in Islamic jurisprudence.
